Ok so big update,

 

welcomes solicitors contacted us and said if we paid the £2800 in a lump sum would settle,

we refused but said we would settle on £2200 as a lump sum paid end of June and they've agreed.

 

We've had the email from solicitors with an attachment to sign that says if we pay 2200 on 28th June they'll rectify out credit file to say satisfied,

they'll relinquish any rights to the car,

 

it says they'll pay the cost of £45 to the court to submit the paperwork and request the hearing be vacated and there will be no applications for costs

 

I feel like its a victory,

even though a little bit of me thinks we should fight because we might end up paying nothing

but then we might lose the car so I'm not risking it

ok you need to ENSURE the cra file is marked SETTLED not partial settlement.

 

also, great victory yes

 

but, be aware they are known snakes in the grass.

 

badger the court like mad and ENSURE they do cancel the case.

 

DONT believe a word any solicitor says that it is done!

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

It's risky tho, if you read my posts the judge wasn't exactly wholly on our side last time and suggested we found an amicable solution out of it, if the decision had gone against us I'd be a lot out of pocket! Nearly 6k, and it's £600 less than I offered them and I have always wanted to pay what we owe just without unfair charges or their harassment!

I still think you ought to offer then at least half and say that otherwise you will still want to see what the judge thinks, after all they haven't got much paperwork have they - and there must be a ton of charges and interest added.

 

It may be risky but then you could walk out of court owing them nothing at all!

ditto gilly, if you're happy then settle. you're paying 600 less than what you originally offered which took into account all the charges etc?

and, you are saying that if it continues and you lose you'll be out 6k on top of whats on offer now?
