Just had another letter from Capquest again today.

Still with application form and the terms and conditions which I disputed are still the same plus they sent me other ones with higher apr on them.

I know I would have not had that card with such a high apr as in their terms.

Do I carry on playing letter tennis with them disputing this or does anyone have any other ideas.

i would not rely on a paperwork error to disolve a debt.

 

you need to be paying something even £1PCM

 

and time to get reclaiming

if you think the PPI reclaim will clear the debt

 

what about charges

i cannot believe a cap1 card is not littered with £12 over/late fees

ALL can be reclaimed too.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Sorry ims, was having a nap.

In August I CAA'd Capquest and they produced only a application form and the terms and conditions were not the correct ones.

So the account was in dispute.

When the Advantis letter arrived today saying Capquest was their client, I thought they must be the next desk down.

So I have already sent acct in dispute letter to them today.

Capquest know that they don't have a leg to stand on, and this fell off my credit file in November, but is not SB.

Lowell's seem to be buying a few lemons has of late, so possibly them, they will realise this and sell it on to Muck Hall who will then Sell it onto Rockwell or Activ, so you have a few years of free hamster bedding ahead of you yet :whoo:

Hi again,

Last year I CCA'd all my DCA's with various results.

Capquest had an old Capital one account to which I was paying £1 per month for about 18 months.

When they just produced an application form without the correct tems and conditions, I put the acct in dispute.

 

Meanwhile in November the default had fallen off my Cra file. (Capquest bought this debt Dec 06)

 

All was quiet till December when Advantis wrote saying Capquest were their clients and wanted payment.

 

I sent Act In Dispute letter straight away but they keep writing (I have ignored) every couple of weeks demanding payment.

 

What is the best thing to do now?

Ignore them you done all you can, this

will go further down the DCA food chain.

When exactly did yo make the last payment.

Any Letters I Draft are N0T approved by CAG and no personal liability is accepted.
