are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

well DX i got a reply from bcw which says, I write to advise that we do not hold a copy of the agreement at this office, as we are not the creditor. Under the circumstances your postal order for £1.00 is returned herewith.However, your account has been placed on hold and we have requested our client to send these docuements to you directly. what next????

if they HAD the paperwork they'd give it.

should i cancel the direct debet then even though thet say the account is on hold,they name lowell as there client could they not set a default if i dont pay keeping in mind this dept does not even appear on my credit check ????

stop payments they cannot magic up a new default on an account that is statute barred

Definitely cancel the direct debit. Never use them with debt repayments - I personally even refuse to set up a standing order. Me walks to Bank and has a nice chat to the counter staff - feel sorry for them - not like working in a real bank now. Get odd looks when paying such small amounts - just smile nicely and thank them. I my own small way hope it keeps in a job.

 

Funny they always refer to me by the debtors name even when I clearly write my name on the slip!!

would just like to a minute to thank everyone for their advice so far .i was talking to someone today and they said that under the terms in the cca 1974 i had the right to reclaim all the money that i have paid so far to BCW as it has been obtained by deception and as they can not comply with the terms of the CCA request which was sent , by law haw to return the money IS THIS TRUE????

i was told i should reply to the letter they sent me by sending a request to return all monies colleced by them as they had obtained the money by deception and had no legal right to collect it in the first place

however, without trawling the whole three pages

have you any evidence that the monies paid have actually reduced the 'debt'

 

i bet not

thats paid for 1000's of spoofing letters to other mugs.

or the company xmas dinner fund.............
