Send them an email stating you are complaining to the following organisations.

 

www.consumerdirect.gov.uk (OFT remind them they have told Toothfairy off in October last year....)

www.tradingstandards.gov.uk

www.ripofftipoff.co.uk for the Trading Standards offshoot, which is looking at this kind of behaviour

 

Then put in your complaint in your own words about harrassment, confusing and misleading emails (they can't send round Bailiffs without a court order) and complain complain complain.

Hello,

 

I have a debt with toothfairy loans, i took a loan of 300 out a week before payday and because payday was after the due date for the loan to come out i got charged alot! not there adding more on and saying about NDR to my house, will this happen?

I cant pay it now that they've added more money onto it, does anybody know where i can go from here? :/

hi all! am currently dealing with NDR, they are a joke! I had a payday loan with toothfairy, realised after rolling it for a month due to unforseen circumstances that i couldnt afford to pay it back in one go, contacted them immediately via emails phone calls etc and got sworn at, hung up on, ignored etc, so in the end i told them to pass it onto a debt agent and i would deal with them! NDR contacted me, tried to agree a payment plan, and was told that the amount i had said i could pay (although equal to what they would accept) was unacceptable to spread weekly instead of monthly! I have overpaid on my agreement and still getting emails etc to say that i havent stuck to the payment plan and bailiffs will be coming to my house, work etc to recover 9 times the value of goods?! to top it off, i had a message from a marshall hoares bailiff company to contact them, did, and apparently it was still NDR?!?! i have contacted the OFT and it is officially with them as a complaint, they are beyond a joke! my only advice is stick to your guns, only pay back what you can afford to, they won't take you to court, i asked them to take me to court and was told on the phone that they wouldn't do it if an agreement was made (which i was trying to do, they were just being awkard!)! I apparently still owe them £300, but will only be paying another £100 to cover the loan and months interest... I did owe them over £800 because of their fees, but as i wasn't ignoring it they 'ever so kindly' dropped the fees every time i contacted them regarding the emails threatening me when i am definitely up to date on payments!!! Their emails are scary, threatening, and yes they are rude... but stick to it, at the end of the day if they want their money they will agree to a payment plan like every other company out there!!!!!

Hi guys. I'm in a similar situation with MHB/TFF/NDR. I find it interesting however that I have been asked to contact Marshall Hoares via email. This is their contact details page:

I have today sent them the following request via their contact page:

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing. I have verbally requested that these stop, but I am still receiving calls and I now require all further correspondence from your company to be made in writing or email only. I am of the view that your continued harassment of me by telephone puts you in breach of Section 40 of the Administration of Justice Act 1970, and the Protection from Harassment Act 1997.

 

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine. Are they really allowed to charge two or three interest payments per month??

Bear in mind that I was made redundant shortly after I received the loan, unexpected.

I have advised that I currently receive £65 per week.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Interesting to see Toothfairy Finance featured in the Daily Mirror (for the wrong reasons) - http://blogs.mirror.co.uk/investigations/2011/09/this-wont-hurt-a-bit-says-payd.html

 

The daily mirror have done an investigation on toothfairy so why is it wrong .anyone who has issues and is being treated unfairly should be reported and I'd also advise people to email the daily mirrors investigation team and tell them ur story and this way the payday loan companys will get closed ie licence revoked eventually

What is most interesting about it is that Toothfairy will still hit your Debit Card for monthes after they moved the debt to NDR and even after NDR supposedly moved it to the Bailiffs MHB, which proves that the Debt was never moved in the first place but that rather all 3 Companies (TTF, NDR and MHB) are in fact the same Company.

 

For me they turned 300£ into more than 2000£ with their Fantasy fees, monthes later while MHB (the supposed Bailiffs the supposed Debt Recovery Company NDR sent after me) where threatening daily to visit me Toothfairy was still trying to clear out my Bank Account, so I've had to open a new Bank Account to be able to survive.

I'd finally come back to post that Mirror article - glad to see others have already seen it.

 

My issue is still unresolved - I'm currently in a payment plan with them which is admittedly stupid but regardless the stress of everything is killing me ha.

well i've read through all 6 pages of this threadon the advice of my dmp. its quite pleasing to learnt that im certainly not in the minority who have a problem with them. i had loads of problems to start with trying to tell my dmp who exactly they were supposed to be making payments to! are they speed credit/mco/nda/toothfairy/marshall? i knew they were a joke company from the get go to be honest though - contradictory emails, shocking grammar and maths that simply didnt add up were the telltale signs. my personal favourite - Loan and Interest £196Legal Fees £150Recovery Fees £200Repayments todate £0Total £211im not worried in the least, i've spoke to my dmp and i know what the score is. i will pay them out my dmp program as im obligated to up to the original amount but i wont talk to them because they wont listen and ill just escalate it further and further till they put up or shut up. it just gets a bit boring after a while! :)

Do you get the same emails and texts with the appalling grammar and spelling? for a seemingly automated message, you'd expect them to at least run a spellchecker past them... :) I've basically refused to speak to them, as the way I see it my debt management company have put in the offer from me and they might as well like it or lump it! However, after 2 months of not replying to their repeated texts and emails I did want to send a reply back(making no mention of what I owe) but instead highlighting the various spelling mistakes. It would have amused me anyway! However, like you say they claim to not recognise email or text communication.

Just so you're all aware, I've now finally paid my debt off with TFF. I have however, filed an MCO claim for the amount that I've overpaid (at worst, I guess I won't see the fee for that back) - TFF have replied with the response "We are fully compliant with all laws, legislation and the OFT Guidelines and we will defend ourselves vigorously in any action brought against us.", which they forwarded to me FIVE times. I did have to do a little chuckle!

In the case of Harrison v Link, this is what the High Court Judge had to say about the use of excessive telephone calls in respect of Debt collection.

 

 

‘I am satisfied that the claimant’s description of the way that he was hounded by his creditors is essentially correct, not least in the use of non-traceable telephone calls.

 

‘It seems to me that such conduct has no proper function in the recovery of consumer debt.’

 

He suggested the tactics seemed to be designed ‘to make the claimant’s life so difficult that he would come to heel’.

I recently had the misfortune to deal with this scandalous trio. I've never been in debt before but employer paying late and my own stupidity meant I was unable to pay the loan. I wrote to Toothfairy finance - via email and through their contact form after the usual PSE RESEND - and got no reply. Then the action started - phone calls, texts - 68 sms in four weeks. I wrote again to NDR and Toothfairy, again explaining situation, providing a payment date to clear the entire balance (I am waiting for funds to draw down from a Trust fund). The texts etc. did not abate. I then called NDR office and spoke to this woman who stated - "people like you shouldn't take loans if you can't pay them" to which I wanted to reply "people like me mean you have a job" but I bit my tongue and said instead that I hadn't been in debt before, didn't much like it and all I wanted was them to acknowledge a payment plan.

 

The day after the phone call, I started receiving 8 DAYS TO GO TO BAILLIFFS and every day thereafter a count down.

 

Yesterday in the post I received (for the first time by postal service) 3 x letters. Today another one arrived.

 

The thing is:

- they seem absolutely unwilling to acknowledge any payment arrangement

- this is way too heavy handed. I'm thick skinned and barely notice my phone but in a day....

- so many posted letters in one day

AND NOT ONE ACKNOWLEDGEMENT OF my correspondence to them asking them till end of March and initially even agreeing to pay the interest on outstanding sums (as I was mortified by the situation I was in).

 

So what do I do?

Hello Jessica :) Welcome To CAG.

 

To help with the haressment... can i ask what type of phone you have?

Depending on the OS, there are apps that can help block these SMS & Calls that you get.

You contact them when you need to.

 

MHB are still after me for £2000, i told them where to go after they wouldnt accept my payment offer of 1 month + Capital...

They dont put anything on your credit file... trust me last month i checked (Callcredit, Equifax & Experian) and no sign of them :)

 

Please hit them with the harassment templates on the forum etc, and youll do fine :)

Their baliffs are just glorified F2F Debt collectors who cant legally do anything. Toothfairy have had problems with the OFT before.

 

Dont let these guys get to you :) , fight it out :L)

Please also dont let them parm you off with extra interest, they (Although stated in their T & Cs) are not legally allowed to do this as these are classified as unfair charges.
