Hi all.

 

I'm new to the site and found it whilst researching a parking ticket. I would be very greatful for any advise from people who have been in a similar situation.

I parked legally in the Leeds Road retail park in Huddersfield whilst I went into Argos to buy a swimming pool for my grandson. After buying said pool I found the the box to be a bit on the large and heavy side for me. I left the pool on the counter and went to get my car and parked it in one of the disabled bays outside the doors. These were all empty. When I came out of the store I went to put the box in the boot. As I was doing this a parking attendant appeared from behind a parked van. He said to me is this your car sir. I replied yes, got in my car and drove off. The attendant was writing in his book or whatever at the time. He never attempted to put any ticket on my car.

 

A couple of weeks later I received a letter fron Excel stating that as I had driven away the option to pay £60 had gone and therefore I had to pay £100 within two weeks.

 

That seems a very hefty charge for the two minutes it took me to walk back into the store, pick the box up and return to my car.

Hi and welcome to CAG.

 

Disabled spaces on private land have no legal status. The 'charge' you have received has no legal status and is merely an invoice to which you can ignore. Basically what they have issued is a fine or penalty which they cannot legally recover as they do not have any powers to do so. IF they were to persue this in court, they would have to convince the judge that the 'charge' related to losses or damages caused by you parking there and at £60 or £100, the judge would consider that to be disproportinate to cover 2 minutes of parking.

 

Do not contact them. You will no doubt receive more 'threat-o-grams' and even a solicitors letter but you just file them away in the bin. In the unlikely event of you receiving an officially stamped court summons, come back for further advice.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

See if the Examiner will do a story on your unenforceable invoice.

Do not communicate with these people.

They have no powers at all, and they will not do court.

expect letters from,,roxburghe debt collectors,, then graham white solicitors,,,threatening everything,,its the same jerk sending out these letters as they are at the same address coincidentally??????guess what,,,ignore,,ignore and ignore do not reply to them under any circumstances.they have absolutely no power,, there are 1000s of us on here who wish excell would take us to court,, they wont cos they will lose.relax.
