    • If you're set on pursuing the receiver then a complaint to his governing body (if any) might be a sensible low risk first step. You need to confirm what qualifications he actually has. I don't believe an LPA Receiver necessarily needs to be a licensed insolvency practioner, although he may be. Or he may a chartered surveyor. I note you say "LPA" and "fixed charge" receiver, but aren't those two different appointments with different remits? What relevant powers are given in the mortgage terms and security? Or if that's unclear then how was the appointment described to you? Ducking back to the comment I made earlier, you consulted a solicitor who advised a claim against the receiver. How did he advise that you do so?   Some background reading (accepting it's from 2013 and you may be working off more recent preceded overturning this) ..       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Has anyone had a knock yet?

 

I've just had a really unpleasant experience from a large goon who was not only threatening, he demanded to know iif there was a reason I had not completed my census form .................... I have!!!!

 

 

And why haven't they got it!!! How would I know????

 

He then left! Didn't get asked to fill in another one or anything, so have no idea what happens now!!

 

 

So I'll phone them to complain tomorrow because it was so bad, and I live on my own and had taken some strong pain killers earlier so wasn't too with it either! Really shouldn't have answered the door, but 'someone' kept knocking and knocking........................

 

I feel mightily aggrieved!!!

That's it - they're picking on me 'cos I'm an ol dearie wot can be easily intimidated ............................ or so they thought!!!

 

 

I wasn't that bothered before - didn't like the stupid thing and it was a ridiculous waste of money and utterly pointless questions, but still filled it all in even tho I was tempted to add some very pithy comments (and yes, that is PITHY without a lithp) because it was such an appallingly thought out census.

 

Well now me caged is rattled and I feel like a big bite on some roast leg of consenus man!! I hope wads and wads of the forms go missing and the whole thing is shown up for the waste of money and shambles it is!!

Two of my three kings turned up not 10 Min's ago. One long haired greasy looking guy who looked like he had just fallen off his motor bike, and a woman who looked like a bikers moll :roll: The guy said he was the 'coordinator' to check on the behavior of the visitors !!

 

Well, I went though the list I posted on the 1st page, I don't think they knew the story behind the census and Christmas.

Anyway, they went away and then turned up at the back door two minutes later having got lost. There is only five houses here for heavens sake.

 

I can see why people could be intimated by these callers at 8 o'clock in the evening.

ok this is the only place i thought i could ask this, i filled in the form online, but have a this ruddy bloke knock on my door at the most inconvenient times ever eg just goin to get kids from school or doin tea for them, app this form is for the community me and partner have told him on several occasions to come back during day when im hope and able to do it.

 

Well today he knocked just as i walked in with our 4 kids from school and i told him well it tough now i cnat do it ive given you several chances to do this during day but now i got a job woeking days and kids off school next week so hubby taking them out he then said a more senior officer would come out to dicuss it ive made it clear to him that he calls out at inconvient times even on a sunday afternoon!!

do i have to do the community one????????????????
