    • Thanks for this! I'm still not clear if I'm facing more than 6 points on my license though. Can you explain any further please? When I accept the 2nd speeding ticket, will they just charge me £100 and 3 points, or will they be more severe concenquences since that offense took place the following day of the 1st offense? Similarly, when I accept the 3rd offense, will they look at my record or just charge me with the £100 fine and 3 points?
    • Yes of course. That's why it says cc:: BIg Motoring World at the bottom. Don't imagine that this solves the issue. It doesn't. He not have to force the finance company and big motoring world to accept the rejection to give your money back. I suggest that you get the letter off tomorrow. And let us know what you hear but on Friday you should then send a threat to the finance company.   Have a look what I have said here about your options and read the whole thread as well.  
    • Been perusing the actual figures on the polls above wondering where the '16% claimed for deform comes from? I understand that there are 'weighted' end results based on secret calculations ...   Probably going to repeat this later, but remember that the ukip/brexit/reform/deform party has ALWAYS had poll speculation FAR better than their actual  performance at elections - by large margins. SO: The labor and Tory votes come largely from simply the people who say they will vote for them - sorted Lab 43% Tory 20%, with maybe another small 1-2% coming from the weightings of the 'not sures' Greens largely get what is declared from 'other' , although with another declared green bit from the 'pressed' question   So as the share of the voting displayed in 'other' granted to reform/deform is around 11%, where does the '16% too often being reported come from? Seems that reform has been granted as beneficiary of effectively ALL the don't knows and wont says, who when pressed didn't actually declare for someone else ... effectively adding 40%+ to their reported polling % - rather strange given their consistent under-performance compared to polling - or perhaps that is the cause of the higher rating eh?   Now I admit the possibility (probability?) of wingers being ashamed of declaring their support for the yuckey lemon end of the spectrum ... but surely  that should affect the 'Torys as well? Maybe the statisticians have simply weighted in that deform wingers are simply more likely to lie?   But - without 'weightings' and assumptions that faragits will get everything that isnt declared as a definite and unequivocal 'not that Piers Morgan' - reform is on around 11% it seems.   Add to that the history of polling a lot less than the hype - and the simple fact that faragit wingers seem to be spread across the country (presumably skulking in their moms spare room despite being 45+) and greens and lib dems seem to be community minded - I think two seats will be an epic result for farage. Hardly the opposition - far more raving wingnut party.   and importantly - Has farage got a home in clacton yet?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I am in contact with her, but she is very vague! I take from that contact that we are all unlikely to hear from her again unless she or CAG has a change of heart. How much longer is the list of good Caggers leaving this site going to get before CAG stops treating people like children? My words, not hers I should add. Perhaps I should mute myself before it is done for me. :roll:

 

I am not expecting any response of the ST (or certain members of it) - the idea they would care is bordering on hilarious. Well, we know people don't like to apologise for mistakes and that's that around here these days. No offence meant to those ST members who are not party to some of the ludicrous decisions taken around here. I think this is why Dave himself did one!

 

I think the world of Bookie and would like to see her back - anyone else? It's all a bit rich coming from me because I don't post much at all, and was never very good at helping because I'm not very clever, lol, but Bookie not being around is the opposite of that and was very much part of the fabric of CAG.

 

No more Bookie is like a death to CAG! I don't deal with change very well, lol, but new CAG is nothing like it used to be. Look at the BG - am I the only one who sees the tumbleweeds? Any good threads get deleted.

 

I'm not saying this to stir up trouble, but c'mon.

Me too - come back Bookie, don't let the trolls and idiots get their own way - we all know certain elements of society would like to see CAG closed forever and the posts eliminated totally from the Internet.

 

In any community you will always get dissenters and the odd squabble, sometimes trifles get blown up....

Totally agree. I don't know what's happened though and am a bit in the dark. I had noticed her lack of posts, but I've obviously missed the bit that caused her to leave. I thought maybe she had gone on holls visiting daughter again or just been busy as we sometimes are. I know I only play in the BG but I do miss her wit and ability to cheer people up as well as help people. Whose ankle do I need to bite? :mad2:

The exodus of good people such as Bookie is rather alarming tbh. I don't do as much as I should on the debt forums anymore but then I'm a lot confused by the high turnover of site team members and regular posters :|

I agree that it's sad to lose experienced members, but the bear garden is not the be all and end all. What matters most is the main site and the advice given to members in difficulty. It's not apparent to me that this is deteriorating in any way.

Yeah I'd agree with that. I don't know really, but hope the main site is flourishing. Lord knows (so to speak) people need it more than ever. It's easy to forget all the good, when seeing silliness in here - which in the grand scheme of things.....

 

Of course most members have left due to events on the main site, but don't want to drag up some of those issues - best left to die anyway. Just have to realise the BG has died! No debate, bah bah coloured sheep have you any wool.

 

Anyway, I have nothing left to say about it - BG and content - words games and PC stuff.

 

Just hated it that Bookie has gone.... though she may choose to come back at some point in the future. :-)

 

It seems obvious to me why she has gone, but it's not for me to comment on it.

Only just seen this.

I had some comms with her not too long ago.

She is a good friend of mine both on and off the forum.

She did indicate that she was having a break from here,which I assumed is what she was doing.

Bookie is familiar with what goes on behind the scenes here,and many times has quoted those famous words "Dammed if you do-Dammned if you dont"

There has been an expectancy,and often demands,that the site team should be answering questions and dealing openly on the forums.

There are things that cant always be done this way.

Its been a difficult year for everyone,and I think the established team members will agree,its never easy to satisfy everyone.

Behind the scenes there is always things going on,which are for the most part pursuing ways to advance,to address things better,to approach things better,and to put to bed some of those things that have created tensions and mistrust.

 

I dont know a single member of the site team who would wish Bookie to leave us.

So lets get that straight.

 

We have seen lots of change and not all of those have been accepted,but we are learning and listening.

Just give us some space to show it.

I am very mindful of those who wish that CAG didnt exist,that extends beyond the banks bailiffs and DCAs

I value the help and support from Cag, but we do seem to be losing a few 'trusted' regulars who have been there and done that. We also seem to have a few members who can get a bit tetchy if they don'y like what is heard, which appears to be spoiling things.

Advice on the debt forums is certainly not what is used to be.... which might be the reason for the high number of "guests" on some threads. Certain key players used to make sure that debt advice was tight and I know I'm no longer a regular these days either but the difference is noticeable.

Thats the way we encourage things to be done.

It can be sorted and done and dusted..

If something is reported like this,its looked at and if need be refererred for the best way to deal.

Contrary to what some might think,theres no poilcy to edit or moderate at will with no consideration.

These things are done as a team not on individual levels.

When things are left unreported and unseen,and we have a free for all of members trying to add their bit,then it becomes more difficult to resolve.

Some of the things we have seen escalate in the last few months,could easily have been avoided if the team had been allowed to deal when notified.

Its nothing to do with ego's,power,or putting peoples nose out of joint.

Being a team member is demanding,tiring and unrewarding.

Just try to remember that...at the end of the day-our principle role is to look after you !
