Employer-Subcontractor Relationship

 

 

According to the Labour Law, an employer may assign a specified section of its main activity to a subcontractor for:

• operational requirements;
  
• reasons of technological expertise; or
  
• auxiliary tasks related to the production of goods and services in the workplace.
  

The employer that subcontracts the work is the principal employer and thus is jointly liable with the subcontractor for any obligations arising from the labour and social security laws or the employment contracts of the subcontractors' employees. This joint liability cannot be contractually revoked, altered or transferred. Nevertheless, any limits on the liability of the principal employer within the scope of the subcontracting contract are binding between the parties to the contract. It is further required that the principal employer's employees are not employed at the same time in the same section of the main activity that has been assigned to a subcontractor.

 

I think this clearly shows that both Natasha and Frank are equally responsible!

 

She was not even a subcontractor. I use a law firm now to do the legal work and they take full responsibility on it. That was how it was with Natasha.

i think she had a duty to warn us, but not everybody has morals i guess, when i spoke to her she already knew things had gone wrong but yet still advised me things were all good and to call back in 2 weeks as the account would have been finished, i called back and the phone lines were gone!!

only for the fact i had a rogue letter headed letter stating my account was in the final stages that i got hold of someone.

I worked for FG on his houses. He was very pleased with my work , impressd i must say. He always paid on time and i had no trouble. He told me he was a 747 pilot, i had no reason not to beleive him and ,in general talk he said he had many houses. 4 in spain, 4 in america, hence where the idea came from. I may be a common man but i dont miss much, ecept FG con man.

Rush if you live near him have you any way of finding out if he has a job flying at the moment?

 

Is there any client who would be entitled to legal aid with this?

 

A lawyer is needed to look at this and discuss the possibilities and probability of a successful outcome.

yes he did, i dident ring him. I was writing a cheque for £5000 to start a business, and he rang me to qoute for a job, i told him this , he round in 30 mins. i was not in dedt, had a good life, £15,000, on cards not much today. I had never missed any payments in my life, worked bloody hard and, played hard. He put his arm on my shoulder and said , they are high street cards, no prob"s. gave him £2400 that week. He told me to take the money from the card, i did, and more loans and here i am. broke . but im still here and what goes around comes around.. TRUST ME.. we will get him. I always wander if his wife knows.........My wife to he told her to shop til you drop, she is so ill over this. .....but stay focused any info.

Believe me you are right, what goes around comes around. He can't steal your soul. It is always possible that he believed it would work. In this industry no ethical company tells a client to max out there cards before starting the process.

Is FG a pilot , i spoke to pilot today and he was gentleman, he has been done by FG and he beleives not , nor do i. lies. I will go to a solicitors and pay, i havent much but for you FG its worth it.. i need info , anything, good thinking caroline2009.
