    • Hello all,   I ordered a laptop online about 16 months ago. The laptop was faulty and I was supposed to send it back within guarantee but didn't for various reasons. I contacted the company a few months later and they said they will still fix it for me free of charge but I'd have to pay to send it to them and they will pay to send it back to me. The parcel arrived there fine. Company had fixed it and they sent it via dpd. I was working in the office so I asked my neighbours who would be in, as there's been a history of parcel thefts on our street. I had 2 neighbours who offered but when I went to update delivery instructions, their door number wasn't on the drop down despite sharing the same post code.  I then selected a neighbour who I thought would likely be in and also selected other in the safe place selection and put the number of the neighbour who I knew would definitely be in and they left my parcel outside and the parcel was stolen. DPD didn't want to deal with me and said I need to speak to the retailer. The retailer said DPD have special instructions from them not to leave a parcel outside unless specified by a customer. The retailer then said they could see my instructions said leave in a safe space but I have no porch. My front door just opens onto the road and the driver made no attempt to conceal it.  Anyway, I would like to know if I have rights here because the delivery wasn't for an item that I just bought. It was initially delivered but stopped working within the warranty period and they agreed to fix it for free.  Appreciate your help 🙏🏼   Thanks!

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I just wanted to clarify something for my own mind, regarding the forged sinatures on the hp agreement,

When I signed my hp agreement I only remember signing once, so did they photocopy the agreement for their reference, or was it carbon copy,or would I have signed my copy and then signed their copy? What I am getting at is, should the signature on my copy be EXACTLY the same as the copy they sent in sar?

HI can anyone advise me? Postggj is off line for a few days I think, Post was going to do a specific letter (regarding commision)to send welcome, I don't know what the letter should say,

And Welcome think I am going in their office on friday, partner told them that to shut them up,they were calling all day every day upto 10pm.

Any ideas how to stall welcome until I get this 'specific letter'.

 

What should I do now? Any advise is appreciated,

How is a letter of dispute worded? Do I just list all of the things wrong with the account,? Or does it have to have any reference to consumer laws?

I really am stuck now, don't know what to do!!

Did anyone else have signatures forged in the sar, what was the outcome?

Hi abi, can't help you with a dispute letter but the signatures on my cca request were different from the original we had.

 

We queried it alongside our Insurances claim (amongst other things) but never had an answer for it. We haven''t pursued it as Welcome have agreed to pay back the ppi and other insurances and i'm pretty sure the only way to resolve the signature aspect would be to take them to court to claim damages.

We decided we were happy with claiming the insurances back as it cleared our account and we were not prepared to go to court with it as we really just wanted them off our backs and we were wary of how long it would take and how realistic an expectation of compensation from them would be considering their unstable situation at the moment.

 

Also we couldn't say with 100% certainty that we only signed one agreement, they may have had two copies we had to sign... we just can't remember. We weren't prepared to pay out for a forensic handwriting expert only to find we had made a mistake.

Hi emmilou, thanks for your response, regarding the signatures, my personal loan agreement matches exactly with their copy, but it appears that all the documents todo with my hp, the signatures don't match with the copies sent in sar, the statement of price etc. I'm sure there is something dodgy about my hp,

I will work it all out eventually, It is just a little scary when I don't fully understand all of my rights, The CAG has been a god send to me!!

i have my own thread ongoin (welcome finance unenforceable loan???), somebody has very kindly posted the dispute letter on there for me as i am soon to be at that stage, so if you go on and have a look and amend accordingly to suit your own circumstances

Hi,

I am new to this site today in desperation as I have recieved a court notice from welsome for 28000!! I only borrowed 10000 in 2005! as a secured loan. My house got reposessed by the bank a few months later and welcome say the indemnity fee does not apply as they did not force the reposession! any ideas what to do as I am loosing all hope. I have to send the court a reply asap.

a woman from local office called lastnight, spoke to her she is claiming that my hp agreement has over £800 ountstanding to get it upto date, I believe i am only outstanding by octobers payment £272, I told her that £800 doesn't sound right to me, she said i need to come into office to look at a statement! She was very abrupt with me. she said I need to pay atleast £272, she asked what i am going to about payments, I said she should give me standing order details, she said she won't give them to me, but she will send a direct debit mandate.

she said I should come into office today, I said I would try, She is going to start calling soon, as i have not been in yet! dont

know what to do anymore,and she didn't even mention my personal loan!!

hiya abi, I had a row with my account manager today told him that im going into dept management programme he wasnt happy i told him enough is enough i offered a settlement which i thought was a fair offer but they declined it so im going down the route of debt management, I totally understand where u are coming from they are a nightmare.

Hi Guys i dont know much about this or the leaglaities as am fairly new however i do know that they are bullies and will try and get to pay by pressuring you. I would never go in and see them neither would i speak to them on the phone. If they are starting to be rude and pushy then get them to put everything in writing and do not take their calls. There are letter templates in here.

 

I havent read all the thread so sorry if you knew all this already.

 

Have you sent them a CCA request or SAR'd them?

He who dares, I have done a cca and a sar, cca came in the sar, but the signatures don't match mine.

I think I will send them the harassment letter because they call so many times in a day it's unbelievable,

I don't mean to harrass you, but just wondered if you have the magic letter for me? welcome local office are now harrassing me for direct debit mandate and payment, she is claiming i owe £800+ on my car, that cant be possible, I don't know what to do!!

I have read wilson v herstanger, it's very interesting, but I just don't know how to word this letter. Welcome will start calling again tomorrow trying to get me to set up direct debit, she is becoming very pushy, please help.:)
