  1. Hi all, hope someone can help me, On the 17th I logged onto my online banking and the last £300 in my account was missing. There are2 payments which are paypal transactions to 'Aliexpress' which I looked up and they are apparantly a sister company to Alibaba.com I called Natwest who seemed thoroughly uninterested and told me it was impossible for someone to make a debit card payment online using my details as only i know the authorisation password. They said to call paypal then call them back. BTW- No transactions are showing on my paypal account Called paypal and got through 20mins of the same automated questions over and over before reaching a human. Took ages to get them to understand that the unauthorised payment used my debit card but was not reflected on my paypal account which that debit card is associated with. They said to put a stop on my debit card. They said they'd email me. i got 1 email saying they'd let me know the outcome after 10 days. 10 days??? i have no money!!!! Can anyone give advice on how long it will be before I my money refunded? I'm worried about direct debits bouncing. I cannot understand how paypal let another paypal account use my debit card as I thought cards could only be assigned to 1 account. I am also concerned that Ali express ship items to addresses other than billing address. Worst of all I am furious that my bank genuinely does not give a crap. And paypal telling me to put a stop on my card.... how do they intend to refund me then if they cant refund the card? Sorry for the rant, I just don't know what to do. Em x

Hi thanks for clearing that up, I suspected after so many years with no contact or payment it would be statute barred especially after they sent 2 offers to him, the first to pay back a small percentage of the amount due and the second offered him an opportunity to bid for his debt to buy it back!! WHo on earth would want to bid for their debt? There's no CCJ that I know of... none showing on his credit report and we've never recieved notification of one in the post. Thanks for your response
  3. Hi My partner had a credit card with Lloyd's bank over 12 years ago. He cannot remember how much of this he paid off or even if he signed a credit agreement. We have not heard from lloyds or any debt collection agencies acting for Lloyds in over 10 years. Recently after moving address I have noticed numerous searches on MY credit report from Lowells, my partner has also had some from them on his also. Following this we recieved letters from Lowells chasing the Lloyds debt, making various discounted offers. We have not contacted them. Now they have gooten hold of our number and send at least two text messages to our landline. Am I right in thinking this debt is statute barred? Many Thanks Em
  4. Hi, I bought a HP laptop last year and as a mid range model it was not cheap. Since buying it I have been having problems with the sound. At first the sound would cut out for no reason, but very rarely so it wasn't much of a problem but over the last few months it has gotten increasingly worse and now I only have sound around 5% of the time. As a result, I am unable to use the blu-ray dvd drive, skype, listen to music.... it's seriously reduced the laptop's functionality. I reported the problem to HP before the warranty run out and the first thing they had me do was update drivers and bios (?) etc. This didn't work so they asked me to restore the laptop to factory settings. This didn't work either so they picked the laptop up by courier fo repair. I recieved the laptop back, the sound worked for an hour then cut out again. According to the repair report they couldn't find a problem and all they did was restore it to factory settings again. I have emailed them again and yet again they want me... yes, you guessed it, restore it to factory settings. I'm really annoyed by all this, I rely on my laptop as i'm a student and the solutions they are offering aren't working. Restoring to factory settings requires backing up all the files and then reinstalling them again, i'm reluctant to do this again as I know it wont work and they will just pick it up and wipe the hard drive all over again. I'm not an expert but even I know this is a hardware issue, i'm sure the speakers and wiring need replacing. What are my rights here? How long can they keep offering the same solutions that don't work? Any help would be appreciated. Em
  5. Hey charger It was a good outcome as far as I can tell. The refund cleared my balance with them and I had a cheque for just over £200 sent to us. Entry was removed from my credit file and the car has been taken off the HPI register and is 100% ours now. No intervention from the FOS was needed. So we officially have nothing more to do with them which is good news. We would've had over a year left to pay if we hadn't recliamed the insurances so the difference it's made to our finances has been great.   6. Also if that is the case they are going to have to have a serious look at what you still owe them. All those fees shouldn't be on there and niether should the extra capitalisation if they have recieved all your payments. If your statements are not reflecting the payments you have made, then you must be (wrongly) on their records as being in serious arrears. Did Welcome never try and contact you to tell you this?
  7. sounds dodgy to me...if the money left your bank account and they haven't refunded it back then Welcome must have had it. Very interesting.
  8. Hi From looking at your statements it would seem that welcome have tried to take payments from your card. When they put the attempt through they credit your account. Now for whatever reason the payment hasn't been accepted which is why in the next line they have debited your account for the same amount of money. Hope that helps.

  10. Hi recieved a refund from Welcome finance for PPI (and other insurances). 1 cca request, 1 template ppi letter and their dodgy questionairre is all it took. Had 4600 of it refunded on to my account from it (at my request) and £200 sent to me by cheque. Relieved to be rid of them! Good luck to all who are in the progress of reclaiming their PPI

If you were to cancel your direct debit they would probably start calling at the cost of £10 a time and charging you returned direct debit fees BUT they would not be able to come and take your car as you have paid over a third. They would need a court order for this. In order for them to lower your monthly payments they would want to rewrite your loan which is not advisable unless you fancy spending the next 10 years paying off your car! On the bright side, you should be hearing about your ppi claim very soon if you're at the questionnaire stage
  12. Just out of interest... How many caggers on here feel they were refused a ppi refund due to filling out the questionnaire? And other than fester how many have had a refund/offer without filling out the questionnaire? I can only speak from my experience of course.... but I'm glad I filled it out. The whole process was relatively quick.... yeah I didn't get the extra £200 compensation that I would have gotten if i'd gone to the FOS...but I also didn't have to wait months and months for the FOS to sort it out.   14. Sorry but you have only made 36 x 190.57.... not 38. If you look at your statement you will notice when there is 2 direct debit transactions on the same day what has happened is they have credited your account but then the direct debit hasn't gone through so they've debited it back on.... does that make sense? For example before the 3/11/07 payment your balance was 454.53. They then tried to take the dircet debit and credited your account with 190.57 which made your balance £263.96. The direct debit failed to go through so they had to debit (add back on) the £190.57 that they had credited you with that day which made your balance £453.53 again.... so they in theory didn't take any payment that month which is why you have capitalisation and adhoc charges around that transaction. (and others... there's a couple I think). So you haven't paid more than once in a month, sorry Hope that makes a bit of sense?
  15. dawn don't believe for one second that they have cancelled those insurances until you have it in writing. Direct group will tell you over the phone if they are still active or not. They would not cancel our insurances until the misselling issue was resolved.
  16. We had PPI, Mechanial Breakdown cover and shortfall extra insurance. Total cash price of insurances was 2665.84 + charge for credit for insurances was 1537.72....so thats 4203.56. We were told we could have the refund in cheque form but as we wanted rid of them we asked them to deduct it from the account to clear it with any surplus sent to us via cheque. We were refunded £4672 which they used to clear the balance and a cheque for just under £200 so altogether the refund amounted to just under £4900. They have said this includes the 8% stat interest. Our Blance is now zero and they are closing the account which they said takes about seven days. They say they have removed the car from the HPI register which I have in writing and that the welcome entry on experian should be gone by the end of next week. They recieved our initial complaint letter on the 7th August and the cheque is clearing now so it took around 14-15 weeks and this was without FOS involvement. Hope that helps.
  17. You do need to send them some sort of reply, even if it's just to tell them to bog off so that they don't have a reason to go beyond the 4 weeks they are allowed to deal with it. However, we did fill it out mentioning only what we had already said in our original letter and we have had our PPI refund (cheque's clearing). Also even on our final response it mentioned only the PPI but we were indeed refunded for mech breakdown and shortfall extra too.

I've just checked through my paperwork Dib and it took them 3 weeks to respond to my initial complaint letter if thats any help to you... we were worried that we'd had no acknowlegment of the letter so we rang up a few days before we recieved it and they told us it had been sent out that day Might be worth ringing up with your tracking number to get confirmation that they have recieved it and ask if they've sent out a reply yet.
  20. In my opinion they will be more accomodating if they think the money they are refunding you is going to go straight back on your account so I say your idea is worth a shot. Don't be put off by the length of time it will take. Mine was sorted in three months without FOS interventaion, recieved my cheque yesterday.... just gotta bank it and hope that it doesn't bounce lol. good luck
  21. I agree with you however this is how most of welcomes agreements are calculated. Even if you take it as two seperate contracts: one for insurances and one for goods, the sums still add up. The total amount payable literally means the total amount payable before the customer pays a penny (including deposit), this is the amount for the car plus the option fee and acceptance fee and any interest payable on the car. The monthly repayments are calculated after the deposit and option fee are deducted from the total amount payable. The apr is calculated on this amount. Not the total amount payable. The 1300 has definately been deducted when taking into account the monthly payments. Which was my original point. He has had the deposit and part exchange deducted from his bill. Indeed his statements would also indicate this and would show the opening balance as 10849.92. The one thing that I do find strange about the agreement is the APR. On most of welcomes agreements that i've seen, the APR is shown and the rate of interest on credit per annum. I can't see the rate of interest per annum on here anywhere.

The way they've worked it out on the contract is that the total amount payable (S) £12149.92 consists of the total amount payable for the car (I)£9638.56 plus the total amount payable for the insurances(m) £2511.36 (I)9638.56 + (m)£2511.36 =12149.92(s) so (s) is the total amount payable before taking into account any deposit paid by the customer. Then they deduct the deposit and part exchange allowance (D)£1300 (s)12149.92 - (D)1300 = £10849.92 This amount divided into 48 monthly payments = (J+N)£226.04 which is the monthly payment for the car (J)£173.72 plus the monthly payment for insurances (N)52.32 So... (J+N)£226.04 X 48 = 10849.92 It's really unclear on the agreement I agree but it does seem to add up.
