You should send a separate letter referring specifically to the warranty and cancel it. I think you have 14 days to cancel the warranty and so you are just within time if you do it straightaway. If you have sent a letter already then let us see what you have sent. You seem to have posted up part of a report which you received. Please could we see the whole report. Upload it in PDF format. I'm not quite clear who it is produce this report. Was it somebody connected with Big Motoring World or was it from an independent inspector. Did it cost you anything? I'm aware that you have coming from Facebook and the point has been already made there that although the assertion of your right to reject it is an important step, the big problem will be getting Big Motoring World to act correctly and to accept the rejection and to refund you. How far are you away from the dealer. You bought the car 13 days ago. How many days have you actually had use of it? What date did you take it into the garage where they discovered the faults? You have told us that some of the purchase price was financed. Who provided the finance? I think my site team colleague above has asked you this question and you need to tell us.  
    • Politicians not being totally honest applies to 99% of them these days. Whoever wins the election will have to find money to pay for all of works needed to repair the damage done during the last 16 years. I say 16 years, as that is when the Banking crash made a huge dent in the UK economy. The Tories have managed a gradually declining country. At least Labour understand they need to fix Britain. The Tories are more willing to accept a broken NHS etc.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

For a good ten minutes heard repeated clip clop clip clop getting louder and looked out the window awaiting what I thought would be the police horses comming down the road. Saw this little kid getting applause as apparantly had been pogoing around the estate without putting a foot down. Had to smile this girl up down up down boucning happily down the path, sounded like group of horses moving in or hammer drill going for a walkies.

 

Wish I had that balance when a kiddy:-D

Finally the daughters pot is off. She is still limping a bit and she's not to do any jumping, but at least she's had a bath! 7 weeks seems like such a long time, and it's amazing the amount of crud that gathers, it's similar to the back of a sofa... one pot change she actually had a 1p down there!

Just Spoken to the case manager and NO N170 received from the Claimant, I dont need to do anything else the court will be in touch very soon.....

Must say after being so poorly, got out of the house for some time last few days and going through an obvious happy patch. Maybe its the sun. Gonna make the most of it before turns the other way again.

 

Decided by next year not going to be two tonne tess:lol:

The order of posts being doctored. Why would that be? Lol. I posted on Diet thread post 60 but 'somehow' the order has been edited so Booky's post is 60. Plus, it was done some time after I posted so not a cross post when peeps post at the same time. Scary!
