    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. Anyway I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?
    • The neighbour's house is built right on the boundary so the side of their house is effectively the 'wall' in our garden separating the two properties. It's a three storey house and so the mortar poses a potential danger to us. Because of the danger, we have put up an interior fence in our garden to ensure we don't risk mortar dropping on us. That reduces the garden by 25% which is not only an inconvenience, but it's the part of the garden where we had lined up contractors to install a patio and gazebo which we will use for our wedding reception in less than 2 months. We have spoken to the neighbour's caretaker who is on the case, has spoken with a roofer and possibly a scaffolding company, but there are several issues. They don't seem to understand the urgency. As long as there is a risk of falling mortar, we can't carry out any work in the garden, and unless they hurry up, we're looking at cancelling our wedding as it's not viable to book a venue because we can't use our own garden! Also, they want to put the scaffolding up in our garden which would be ok with us if it was a matter of a few days and they hurried up, but there is a tree (most likely protected by the conservation area), so most likely they can only reach part of the roof with the scaffolding if they put it up in our garden. We suggested a roofer with a cherry picker but they seem to want to use a company they've used before. Any and all comments, suggestions, advice is more than welcome.  PS. does it make any difference that the neighbour is a business (ltd) and not a private dwelling?

    • Apologies all for the late reply and info, i have been away with the Army. They have paid I accepted the offer on the 5th of May, and they paid on the 17th of May.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

And count me in for a contribution to the expert witness.

 

This is not the first time I've heard of Mishcon arriving on the scene at the last minute - I know of another case where the original solicitor left, bottled or was dumped (not sure which, but it was Brachers) a day before a trial hearing and Mischon turned up in court, with £5k of expenses - racked up in 24 hours, all neatly itemised in a nice folder.

 

This seems a deliberate tactic, in order to rack up the costs as much as possible they change solicitors at the last minute, to a firm who are very expensive and whose name is likely to intimidate some judges. Bullying basically.

 

One thing I would like to clarify, if the defendant turns up with a barrister, and the claimant loses, or withdraws, or fails to appear, are they liable to pay for the defendants barrister? If so I think we should get Shakey lawyered up. If the claimant is liable if they lose or bail then I'm very happy to stump up some fighting fund, I've seen one of these "originals" first hand and I'm very happy to back my opinion.

 

it's a good point but from what i am reading shaky is doing a far better job than he can expect from a barrister!!

I'm not suggesting he needs the barrister, just that the claimant gets a dose of their own medicine. Our supposedly impartial system allows a LiP to charge a groat a day for legal work, whilst at the same time I think the cap on hourly fees for a barrister is in the region of £215. Probably more for a Mishcon barrister, who after all are exceptional, are they not?

 

Based on my opinion of the originality of these documents the claimant is likely to try and scuttle out of this. A barrister may be a good resource to have to hand, if the document is not original the ramifications for the claimant are huge, especially as this is not an isolated case. Were it a one off they could claim it was an error, a filing mistake, but if it has happened more than once it becomes a policy, which means someone approved it.

Friends and family will help me 'sort out' arrangements for an Expert Witness - we're talking forensic science using the latest techniques. This process is already under way.

 

I can't afford a Barrister. I've noted the advice and goodwill on here and owe it to Caggers to consider offers to contribute for one, to help win this fight, for the good of all.

 

Plan A - is to consider the feasability and implementation of a plan to engage a Barrister.

 

Plan B - is to continue fighting the case myself - I'm not doing too badly, Amex have brought up their 'heavy artillery and I've thrown back their attack twice already.

 

In relation to plan A, the Barrister would really need to be a specialist expert in this field - if anyone can recommend a name, in strictest confidence please send me a pm (private message) - I'll clear down my box if it gets full.

 

Any advice on the financial aspects would be gratefully appreciated in the cause of common good (any suggestions from the site team ?)

If they haven’t maintained 2004 Terms and Conditions how the hell have they 1998.

Glad to see my assertions being corroberated :)

 

Apparently they boast on their website they have been working with Amex for quite a while .....so it's a well practised routine

At the moment I simply can't, but if things change I'd be more than happy to.

I am in same situation as DD ! I i would love to !,but am in dire finacial straits my self. and would only be able to contribute a very small token amount.

It would be great if some sort of facility could be set up on cag where we could all contribute to shakespeares cause similar to cag donation sysstem where we could all donate what we felt we were able to afford through paypal or debit card and if it was arranged and sponsered by cag we wouild feel happy making donation knowing details were safe, I would only be able to afford a small tokenamount but even caggers who could only afford to donate just a £1 or £2 or even just 50 pence if we had a collection scheme on CAG and loads of caggers symphatetic to this cause only were able to donate these token amounts it would still mount up and be a great help to shakespeare!:) As a victory for shakesepeare would be a victory for us all.

Sunflower, that's a very good idea and you are right. If everyone on CAG who might be affected by this gave just £1 it would all mount up. Even I could find £1. :)

My thoughts exactly!I must admit like you would only be able to afford a £1 at moment as my bank account only had the grand total of £5.26 in it though luckily my hubby incapacity went in it recently LOL so like you I would be able to find a £1 ! and though these sums not huge amounts of money! if everyone interested in this thread donated at least a £1 and several caggers it seems are able to donate more than this.We should be able to get a large amount together r to help Shakeepeare! It would be great if one of the site mangers who we would all trust with debit card details paypal details and the money could organise a facility on CAG for this to be able to happen!:) xx

Thats a great idea! I would be prepared to send a postal order to shakespeare ! I just wish i could afford more than a £1 but as mentioned before all these small donations will mount up!:D Worth every penny to think about that Nasty bank getting some more grief!:grin:
