    • Good evening, My husband and I are looking for some help regarding a faulty car which we have recently purchased from Big Motoring World Enfield. The details are as follows: - Make - Nissan Qashqai 2017 1.2L milage 55,349 miles.  Date purchased -   01/06/2024 Price paid - Deposit £9000, finance £4794 (this includes the 3yr Nissan extended warranty), buyers fee £249.      Total including all fees etc = £ 13794.        Initially, during the test drive, there was no problem with the car at all and this is why my husband bought the car on the day. No problems on the way home from the dealership and up to three days after purchase, the car drove smoothly. However, after day 4, occasionally we would feel a slight shudder during some gear changes (automatic car). Over the next few days these shudders worsened and then on day 5 the car would make very a very loud shudder with every single gear change. It was at this point we contacted Big Motoring World for advice as we are still under the 14 days no questions asked return.  My husband contacted BMW for advice on 06/06/2024 and stated the problems as above. He spoke to a sales person who informed him that he should only take the car to a Nissan dealership (we have now been told that this is false information). We were also promised that a courtesy car would be provided for us after the fault on the car had been identified and confirmed by their mechanic fixing the car. We took the car to the garage that Big Motoring World had told us to go. Upon arrival there we discovered it was a third-party garage, not Nissan. We took the car to the garage on day 9. The mechanic ran a diagnostic test which found no faults, but after the test drove the car and below are his findings...   we scan the car but no faults with the gearbox showing but when I test drove the car it was really juddering and jumping.I spoke to my auto transmission specialist and he said they are very common on these as the CVT belt starts jumping within the box due to pressure loss.  We had this vehicle in for diagnostics for gearbox mate but both the gearbox and battery are faulty.Gearbox supplied and fitted comes to £3500 plus vat   Where we are at now…. My husband spent all of day 10 (11/06/2024) making phone calls between the garage, Warranties2000 and Big Motoring World. He tried, unsuccessfully to find out if the diagnostic reports had been shared between all three. Everyone kept saying the report hadn’t been received and yet the garage assured us it had been sent. Eventually we were told that the courtesy car would be given to us if it was deemed the works to fix the car would take longer than 8 working hours, and that decision would be made after 48hours of receiving the report. Today is day 11 and no decision has been made as nobody is telling us any decisions as people are off sick or on holiday! Today we called the garage and told the mechanic NOT to start any work as we will be returning the car. He said none have been started and we have left the car in his storage as he has deemed the car undrivable. I have sent an email to BMW now formally stating that we want to return the car and I have used the terminology that was suggested.   What can we do next?   Thank you everyone. .  
    • Yes will do thanks Dave, I wonder what will happen at the preliminary hearing no idea what they will ask I assumed once I sent the proof they asked for about my sons condition that I would have just  been given the go ahead to be Litigation friend
    • First the judge will rule on you representing your son, which will be a doddle. After that the full hearing date will be fixed, with WSs exchanged 14 days before. So for the moment just concentrate on getting the right to represent your son.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Dreadful outfit ! How could they take money that you dont owe, thats theft ! Then when you provide proof they lead you a merry dance. How the heck did they have your bank details ? Did you ever enquire about a loan with them ? So disgusting, almost lost for words. Hope you get your money back pronto and this outfit gets whats coming.

Well After two and half months of phone calls faxes, chasing, and threatning with lawyers I have now had £280 returned into my bank.

 

Can I just say to anyone reaserching this company for a payday loan. DO NOT CALL OR EVEN EMAIL THEM. Even if you do get a loan from them the chances of them taking a double payment out is a high risk. They have no clue how to deal with phone calls, you can't talk to there accounts department, and even if you do ask for a confirmation email that the money is getting returned, they will say that it takes ten days for a BACS transfer, please tell them it doesn't it only takes three working days.

 

I am glad I got it sorted in the end.

My son used these cowboys about 18 months ago.

All money was paid back.But in june they took 2 payments out of his account,£100 & £10.

This Has been repaid, last week they took another £70 & £30 as soon as his wages went in.they tried to take money on 4 consecutive days. I think they keep trying untill some wages go into an account and they take it during the night or early morning.

Alliance and leicester have his account but they let Capital take money on a card number that has been cancelled for about six months. because his card had been lost!!!

No reply to any emails.no telephone answers.

the bank now seem to be ready to approach them because tehy allowed an old card number to be used to access the fund. another banking error.

We will give it a week then I will go to the small claims court and issue a summons if that seems to be the only way to stop these people.

A suggestion to anyone who has had grief from this company is that if everyone emails the bbc watchdog program with a complaint about them, or one of the tabloids. something may come out of it.

they need shutting down.

Hi

I used this company back in December and had no problems or so I thought.....

After reading what you guys have put I decided to check to make sure they debited the correct about.

Well the time after they debited my acount with £30.00 and then the next day £100.00. I had no idea they had done this. Then when the loan was due to be paid back they debited my account for the full amount.

 

Is their anything I can do to get this money back or is it too late?

 

Also before realising all of this I have just been approved for a loan and they are going to release funds tonight. They have my debit card details and I get paid tomorrow. I am really worried that they will debit money I have not authorised. What can I do without cancelling my card??

Pinkgems, you have another loan coming from them today ? Then have it cancel card and repay them what you owe minus what they stole from your account. The only way to stop these cowboys from taking money is to cancel card, peace of mind to wait for a few days for a new card, get the money back that they owe you and move on

DONT USE THEM - I had trouble paying and after speaking to Barry we agreed £25 a month for 3 months then a review. He took the £25 from my card then also took the whole £335 outstanding balance. I explained my situation and argued that he had agreed to only £25 but he refuses to give me my money back. I also spoke to a "manager" who also refused to refund the £335 on the grounds that i owe them the money anyway.

 

I am now writing a letter of complaint to which i hold no hope of any reply, but that will allow me to then go on to the financial ombudsman aswell as trading standards as this is unethical.

 

They promised to email me confirmation of the £25 per month but suprise, it never arrived. The only promise is that the manager confirmed that the notes on my account stated they agreed to the reduced plan but it will cost me £10 to get a copy of any info they have on me.

 

Whats worse is that once i request this they have upto 40 days to provide it, thats 40 days too much without money i need for other bills.

 

If you do or have used this company, be cautious. They have no understanding of customer service and will screw you over without a seconds thought. DO NOT give them your bank details, demand they give you either a payment book or their bank details to deposit directly.

 

Has anyone else had this problem and if so did you get your money back? How did you achieve this?

many thanks jelly cubes ,they have sent me 5 emails and texts today to tell me they are adding £75 fine to my account? i emailed back again with the header 9th email ,they then called me at work but nit until after lunch ,i advised that i had emailed them ,the guy advised they have not recieved them any of them conveniently and asked me to resend said he woud give me an alternative email address (the same one ) ,them abrubtly hung up before i chance to respond,i will again email them and keep strong i just need to find a way to stop them ringing me at work ,i dont seem to be at home when they ring me as its always during office hours ,do they work weekends? i will keep you updated .

also in reponse to some other posts on here i took the loan out when i certainly could afford to pay it ,it wasnt until i was off work sick that i then couldnt pay the loan as i dont get paid.i have learnt my lesson from this ,unfortunatlet i wasnt un the position to ask family to loan me instead i had no idea what i was getting involved in with fco and wish i had read these posts first ,my advice to any one else is dont use them.thanks again for your help jellycubs i will sleep tonight

 

If you want them to stop calling you at work state the following in a letter.

 

" I hereby request you remove the following number from my file xxxxx-xxxxxx.

This is in accordance with the Fair Credit Reporting Act. You are entitled to hold only 2 numbers for me and the numbers you can obtain me on are as follows:

1) xxxxx-xxxxxx

2) xxxxx-xxxxxx

 

If you faily to comply with this legal request then i will have no other option but to report you"

 

Please note that the company can still phone you until they have an official request in writing so send it recorded post. They have the right to hold 2 numbers for you and any other numbers must be deleted. (I gave a mobile and an old home number which i do not even have plugged in)

I was advised the funds left their account yesterday at 5.30pm and "should take 24 hours"..........any idea when I should get them? I'm abit skepitcal as they said they were paid via BACS which in my experience take 3-4 days. Also they said there is a chance I might get them over the weekend - again I doubt this as I didn't think funds could clear on non-working days.

 

It says on their website "got cash inside 24 hours" - seeing as they pay via BACS I can't see how this can be true.

 

Really need the cash today so if someone can let me know how long I should expect to wait that would be much appreciated.

Thought it was just odd occasions that it takes 48 hours but on most occasions should be within 24 hours????

 

If anyone could shed any light on this that would be appreciated.

Hi lambert, you should have the money cleared tues morn or wed latest. Weekends dont count hun. Be very careful with this company as they are awful to deal with. You d have been better off going to one of the same day deposit loans but better still having no loan at all. good luck hun x

I can only comment on personal experence and it has always taken 42 hrs

 

and like I have and Jellycubes said be careful with these ......as I'm going through problems with them now !

I had a loan of £150 (i think, cannot remember the exact amount) and I agreed to a repayment plan. Then CFO went ahead and added in the region of £100 in additional charges onto my account.

 

I have emailed them to ask for a full list of the charges, but I just wondered if anyone has had any success in claiming back the additional charges and what is the best way to go about it? Please help, could really do with the money back for Christmas!

I have had to contact them about my brother who has undergone an operation and will be on the sick for a while after discharge from hospital

I can only say that the person I spoke to didn't seem to care.

I explained that the fact they were ringing his phone everyday and texting him every day, not to mention emailing everyday was tantermount to harrassment.

Still the reply of 'It is an automated service and we can't cut that off. These calls, texts, emails etc will continue until he contacts us.'

I understand that he borrowed £250 until the end of March they now claim he owes £522.60p and it is only 13 days into the new month, these charges they claim are for sending out the emails and for trying to contact him.

My neice sent them an email explaining the situation of him being in hospital and got a reply.

 

This is a copy of the reply my neice got back.

Ok thank you for letting me know I am sorry to hear that. We will update your father’s notes on our system so our colleagues are aware of this. Please let him know it is important for him to contact us as soon as possible but we do understand the situation.

Doesn't seem to me that they understand the situation at all, except for they do not care except for getting their money back.

I shall be recommending to my brother that he goes to the CAB or the Debt advisory service as to how to deal with them.

If I could afford to I would pay the devils off, I just wish my brother had come to me to borry the £250.

Interesting you mention that they said that it is an automated service and cannot cut it off....in the High Court case of Ferguson vs British Gas they said something similar but the judges threw that out as it is still ultimately controlled by a human being....

 

Mr Porter also made the point that the correspondence was computer generated and so, for some reason which I do not really follow, Ms Ferguson should not have taken it as seriously as if it had come from an individual. But real people are responsible for programming and entering material into the computer. It is British Gas's system which, at the very least, allowed the impugned conduct to happen.

  1. Moreover the threats and demands were to be read by a real person, not by a computer. A real person is likely to suffer real anxiety and distress if threatened in the way which Ms Ferguson was. And a real person is unlikely to take comfort from knowing that the claims and threats are unjustified or that they were sent by a computer system: that will not necessarily allay the fear that the threats will not be carried out. How is a consumer such as Ms Ferguson to know whether or not, for instance, a threat such as "we will tell a credit reference agency in the next 10 days that you have not paid" (letter of 2nd January) will not be carried out by the same computer system which sent the unjustified letter and all its predecessor bills and threats? After all no amount of writing and telephoning had stopped the system so far – at times it must have seemed like a monster machine out of control moving relentlessly forward – a million miles from the "world class level of service" (letter of 9th January) which British Gas says it aims to offer.

So much for their emails supposedly being computer generated.

I have just been sent this from my neice, it was recieved with 2 others within a 20 minute period at dinnertime today.

Your account is 14days in arrears and a large fine has been added to your balance today.

If you able to make your interest payment via debit card by 5pm tomorrow I am willing to remove the recent fine and defer your balance until your next pay date. This in turn will prevent all further collections action. All calls emails and text messages will stop, no further fines will be added to your balance and we will not have to pass your account to our door to door collection agency.

Please call me on 0208 1661470 or email me directly to make payment on your account.

This is and was on reading generated by an actual person, I spoke to someone on the telephone at an advisory service and they have informed me that if I get a signed authority from my brother I can act on his behalf.

I am getting this from him this afternoon at ward visiting time.

 

Anyone know what the current punishment is for Harrassment by this sort of company?

I wonder how much the 'fine' is ? I notice that their 'charges' are £25 which to send out an automated letter seem to be excessive not only in terms of the actual cost to them, but also in relation to the size of debt...!! I wonder how long it will be before somebody challenges these excessive penalty charges in court and wins.....

Can I just say that id sooner sell my kidney then ever taking out another loan with capital finance one, their bully boy tactis are hilarious. Every day I get a different person emailing me with "I am your personal account manager, this is your last chance to pay off your loan before we pass it onto a door to door collection agency, you have till 5 pm" . Ive got about 6 of these emails, as well as rediculous charges. I know they wont pass it on, because they want to add their charges, and they know I cant afford to pay off the loan otherwise I wouldve, so whats the point of the constant emails. Theyve joined payday express on my ignore list. Ill see them in court.

does anyone know if this company cfo is still trading? i applied for a loan with them on friday of £200 was sent two emails and a text message one email said said they needed to speak to me on the phone to confirm a few more details before they can pay me the loan and the other one said the loan would be paid out that evening and would take upto 48 hours to clear in my account but after reading about this company on this site im now worried can i still cancel this loan?

Send them an email hourly stating that you do not want the loan, that you are going to ask your bank to block the money coming onto your account and that you are going to take it further if they do not accept.

 

Ring them up on Monday and state that you are returning the money immediately should it go onto your account.

 

If you can go online and check the status of your account do a printout and keep it.
