Surely if the bank writes it off to claim on insurances and then sells the debt on this would amount to insurance fraud as both the banks and the new creditor are gaining money meaning twice the amount of the debt is being paid out in the end? Surely there must be something needed in contract stating that after exhausting all avenues the company reserves the right to pass ownership of the account on. If a contract doesnt state this then where does the limit stop?
  2. Guys, sorry to place this down in the discussion but has anyone ever questioned if the ability to sell the account needs to be listed in the Contract? Surely if a contract does not state that the owner has the right to sell the account or pass to other parties then the debt will always stay with the original party? I signed to say i agree to a contract with QQ and not any other company. The contract never mentions they have the right to sell it on, just says it has the right to add charges to cover the cost of tracing address, taking me to court and for costs of communication. Any opinions on this?
  3. MMF are a pain in the back side to deal with. I have never heard of Marshall Hoarse but looking them up on here leads me to beleive they are nothing but scare mongers. They appear to use "loan shark" tactics to try and scare you in to paying. There have been hundreds of complaints logged against them so personally I wouldnt worry about them. Do not offer any payment or ackowledge the debt is yours. Submit a CCA request ASAP and see what they send back. After a heated conversation with MMF, I asked them to provide me a copy of the "original" letter they claimed to have sent me 5 months earlier stating they owned the debt. I goot an email 30 minutes later with a letter attached but the date was for the following day. This shows how these morons work as they claimed I have received that 5 months before it even existed. Let them sweat it out as they have no powers other than to try and obtain a court judgement making you pay. If they threaten balliffs then ignore it as the only way a balliff will be attending your house is if you ignore a court order for payment. Make a complaint to OFT, Trading Standards and sit back.
  4. This outfit are clowns. I asked for a copy of a letter they claimed to have sent me 3 months ago saying they now own the debt from QQ. Within 2 hour I had an email which contained what they claim they sent me 3 months ago with the letter dated with tomorrows date???? How could I have received this letter 3 months ago if it was dated 17.05.12 (email received 16.05.12). I have sent them a rather sarcastic email back saying that the letter they sent has been kept on file to show as proof in court that they are creating things as they go and that they are literally typing up letters at random with dates that have not yet passed to try and force customers to pay up. Personally I think this company needs to be shut down and fast before someone gets hurt by the tactics they use.
  5. QQ were a nightmare to deal with. The call centre kept calling me at work despite asking them not too. Debt was passed to Mucky Hall and now onto Motormile but the only communication I have received thus far is a letter from MH stating that they have sold the debt to MM. Looking at the motormile.co.uk website, it doesn't appear to give any information like the company registration number, any license numbers relating to a Consumer Credit Licence or if they are even regulated by the OFT. Surely such important information would be required to be publically available (i.e stated on the website) Also, i have sent them a message asking for this but no reply. Would this be because they are trading illegally or just because they are cowards?
  6. If you want them to stop calling you at work state the following in a letter. " I hereby request you remove the following number from my file xxxxx-xxxxxx. This is in accordance with the Fair Credit Reporting Act. You are entitled to hold only 2 numbers for me and the numbers you can obtain me on are as follows: 1) xxxxx-xxxxxx 2) xxxxx-xxxxxx If you faily to comply with this legal request then i will have no other option but to report you" Please note that the company can still phone you until they have an official request in writing so send it recorded post. They have the right to hold 2 numbers for you and any other numbers must be deleted. (I gave a mobile and an old home number which i do not even have plugged in)
  7. DONT USE THEM - I had trouble paying and after speaking to Barry we agreed £25 a month for 3 months then a review. He took the £25 from my card then also took the whole £335 outstanding balance. I explained my situation and argued that he had agreed to only £25 but he refuses to give me my money back. I also spoke to a "manager" who also refused to refund the £335 on the grounds that i owe them the money anyway. I am now writing a letter of complaint to which i hold no hope of any reply, but that will allow me to then go on to the financial ombudsman aswell as trading standards as this is unethical. They promised to email me confirmation of the £25 per month but suprise, it never arrived. The only promise is that the manager confirmed that the notes on my account stated they agreed to the reduced plan but it will cost me £10 to get a copy of any info they have on me. Whats worse is that once i request this they have upto 40 days to provide it, thats 40 days too much without money i need for other bills. If you do or have used this company, be cautious. They have no understanding of customer service and will screw you over without a seconds thought. DO NOT give them your bank details, demand they give you either a payment book or their bank details to deposit directly. Has anyone else had this problem and if so did you get your money back? How did you achieve this?
