So you've settled for paying £42.50 visits, £32 levy fee and £6.50 random number = £80 plus the debt.

 

Not bad but i'm sure you could have gone for more.

 

Like i say, i respect your decision to settle, but lets get stuck into this....

 

03/01/2008 debt £912.58

10/01/2008 visit 1 £24.50

18/01/2008 visit 2 £18.00

30/01/2008 levylink3.gif fee £51.00

30/01/2008 walking possession £12.00

30/01/2008 attendence /van £90.00

I take it there is no time pressure on this, it's all settled yes?

 

Whatever happened (lets pretend they levied correctly and turned up with intent to remove) you are still owed AT LEAST one visit and the waiting fee (£78 minimum).

ok its gone ,it was the council tax again same company and same bailiff all done and paid ,no they never seem to go for the car ,my son said it was a rust bucket that should have failed its mot.(changed it now )

the 1st time i saw this guy was 30/1/2008, i had nothing but said i get paid 0n the 01/2/2008 so he took the cardnumber and then took a note of everything.and went but i did walk that way to my car the same time as him and he had a very small car, and never saw him again.

when you paid the bailiff on 30/01/ 08

 

was this a pre arranged visit for the bailiff to collect payment

did he just turn up and you paid the amount asked for total £1,169.08

did you invite him into your home to make payment

was he aware that you were making payment in full when you invited him in

 

were you aware that full payment incling bailiff fees were total £1,169.08

before you invited him in

 

am i correct in thinking you paid it in full including bailiffs fees total £1,169.08 on the 30th

 

did he leave you a notice of seizure of goods and inventory

what did he levy

 

 

Why did he levy goods and charge a walking possession if you were making payment in full

 

you van fee and attendance fee waiting fee call it what they like

this fee cannot be charged the same day as a levy

this fee can only be following a levy

when he turned up it was 1st and lasttime i saw him, on 30/01/2008, i had no cash so he levied on roughly the same things as this time and took the cardnumber i wasnt aware of the amount owing at the time he came in and didnt really aim to pay him it all once i remember that month very well :mad:

so he took your card number and took full payment while he was levying your goods

 

and charged you a walking possession fee for a debt paid in full before he left your property

he cant do that the reason for a levy is to secure goods against the debt

in my opinion you should claim back these fees for this years debt total£213

(3) If, before any goods are seized, the appropriate amount (including charges arising up to the time of the payment or tender) is paid or tendered to the authority, the authority shall accept the amount and the levy shall not be proceeded with.
