    • Instead of ridiculing them you could point out the embarrassment they will have in the papers if they persist in being in Court with a little old lady. it also won't look good for their landowners since negative comments afffect them too.
    • I'm going to say they haven't complied with the PAP although they did write saying they would be issuing a court claim in their letter they also state I had an agreement with OVO which they have a copy of the agreement and its terms and condition which I have definitely not seen. Also I've technically never had an agreement with OVO but with SSE I didn't even realise they had sold to them until this letter!
    • I have had a pre "warning" from TM Legal regarding 2 old debts stating they are going to send a claim form in email. I was sent a PAP form which i responded to on both but like a melt i sent their PAP pack back to them in my request for CCA etc using the CAG response form. I have not to my knowledge received a response for either. my question is, will sending their pack back cause me issues in the future? can I request they send this back to me?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

It's been a troublesome year and not just for the banks. You guys and gals have had a hard time too, but the forum strength is in the team behind it and for that I wish to say thank you. Many people have joined throughout the year and some very knowledgable people have crossed our paths and given guidance.

 

We don't always agree on everything, life would get boring if we did, but the general debate, information and vehicle 24/7 which has provided such a lifeline - as do all of these forums which have sprung up across the internet, competing, copying even plaigerising, but generally all there for the same reason - to help people are a wonderful asset to the public's general good.

 

So for that and all your contributions throughout the year I thank you all, every last one of you because I can see the benefits people have gained from the community of CAG.

You have all given me the strength to take control of my debts and make a start at reducing them. You have empowered me to fight the big banks against bank charges. You have all been here 24/7 and offered me help and advice. You have picked me up when I have got stuck or down and you have made me laugh.

CAG and the members that visit this wonderful site make such a huge difference to peoples lives and I thank you all for that.

I hope that everyone can get through Christmas and New Year with family and friends around, the most priceless of all presents.

I had a very significant victory in court last week and I couldn't have done it without CAG and it's members. Alleged debt written off and defaults removed by court order.

 

This site gave me the knowledge and the courage to go into court with the bank and win.

I may be priveleged to be on the site team, but I'm also a cagger and would like to echo the sentiments on this thread. Dave and BankFodder started something special when they started CAG, but it's all caggers who continue to keep the CAG spirit going, and everyone is there for each other. I absolutely wouldn't be where I am today without the CAG.

That's the Simple fact of the matter.

 

When I found the CAG I was £15K in debt and didn't know any better

than to give in to whoever the debt collector of the day was.

 

These days, I phone the debt collectors and MAKE the threats.

 

Thanks to the knowledge I've gained from here I've learned that

£13,700 of my alleged total debts are completely unenforceable.

 

And just recently I've started doing the charges thing, with Vanquis

rolling over and offering a complete refund after just ONE letter.

 

So, thanks everyone, I'm a strong believer that we are a collective mind

acting as one.

I felt I must add my two-penneth to this, I stumbled onto this site when I was in dire need...I really was at my wits end and was sure that I would end up, homeless, jobless and bankrupt!

 

Six months later, I am self assured and almost welcome contact from DCA's in order to flex my Cagger muscles!

 

The site and specifically, 42man, ODC, Babybear, Godmother and all the others who calmed me down and walked me though the procedures of having SD's set aside etc, have been my constants this last six months..so much so that I now feel confident in giving advice to others as well as dealing with my own finances.

 

Christmas has only been possible this year in the MONX household due to the help and support I've recieved here....so from me and mine, heres to a Merry Christmas and a very happy new year!

Advice given is my opinion only, I am not a legal or financial expert (far from it).
