    • Just realized that the deadline for paying the £59.00 trial fee has passed on the May 17th. But when contacting the helpline this week, I was told the court hearing date is still on? By now, I have fully realized I have messed up. Should I just drop this case and go after Interparcel?

    • I believe it is helpful to seek guidance from a range of places and decide on the validity of the sources and frequency of responses which are most helpful. A single voice can be a dangerous thing. As, of course, can groupthink. Scott, it feels like £4k on a solicitor for a £1.5k bill is overkill. Were we back in time I'd suggest small claims court as your claim sounds like it may be straightforward? By all means add that phrase on. I also suggest you contact the court and go and sit in on a couple of similar cases to get a better understanding before you shell out.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Thats what i've been thinking but they aren't half cutting it close. but I will update you, will still send in witness statement etc just to do it properly. Thanks for the reassurance

Don't worry hun, just make sure that you get everything in on time with the courts/cobbetts. At the end of the day, they're not going to do likewise!! You're nearly there now and it must be absolutely nerve-racking even though you've done everything spot on, but get a glass of wine and relax, cos your cheque'll be with you before you can nutty west!! Cheque arrived for full amount this morning by special delivery. Wasted Costs Order Submitted and case discontinued, i will await a response from the judge.

Costs order for £299 and discontinuance letter submitted into the courts on Friday so will await a response from them. It was the same to a few i've seen on here already so will wait and see where i go with that.

well done laura ,

 

how did you manage to get a cheque , do you not have an account with nat west any longer ?? i rejected their offer but they wanted to pay it into an account and i wanted cheque.

 

i am keenly monitoring people who get refunds by cheque as they are adamant they don't refund in this manner even though i know they do.

Yeh have an account with NatWest. When rejecting the offer i indicated i only wanted it made by cheque otherwise i wouldn't stop the court claim. Its your claim not theres but is that because you are overdrawn and they want to settle your debt in which case you can still request a cheque but may be what they want to do.

If on someones agreement there is no date what so ever on the form after doing a CCA request not below my signature or anywhere printed on the copy. Does that mean the agreement is void as you wouldn't be able to confirm when the debt was etc??

 

On the 2nd page it says "For the National Westminster Bank PLC (Manager)" then a blank box where there should be a signature and there isn't one.

 

What does all this mean? Does the CCA state it must be a dated agreement? No where does it mention any date what so ever.

I have a claim going with NatWest about PPI.

 

Have been sending Prelim letters asking for it all back + interest.

 

This is what NatWest have offered and the amount left after the offer.

Total Amount repayable on Insurance £4,941

Interest on the Insurance £1,957.92

Total Amount of Insurance + Interest is £6,898.92

 

Natwests Offer

 

Amount to be taken off the outstanding loan = £3,500

This would leave a difference of £1,440 and they say in the circumstances they are prepared to refund £720 into the bank account as gesture of goodwill.

 

Total of Natwests offer = £4220

NatWests offer is only based on the original premium of £4941 and does not include any interest.

 

What is the next step? Do I accept the offer above and pursue the rest through the FOS or court?

 

The outstanding amount on the insurance plus interest is £2678.92

Assuming this is a fixed term, fixed repayment loan, and the PPI was missold, and the whole amount plus interest was front loaded onto the loan, then you are entitled to have the full amount refunded - plus interest at 8% per year, from the date the agreement started.

I didn't realise the 8% can be added onto the PPI before court.

 

So I guess I now refuse their offer or accept it in part settlement then ask for the full amount to be refunded and interest @ 8% from the date of the agreement, they will refuse so I will need to make a claim with the Ombudsman im sure.

Hello Orfoster,

 

Do you know how much interest they actually applied to the ppi premium.

 

On a premium of £4,600 they applied interest at 8.9% for ten years on my loan. This resulted in them applying a total of £4,094 interest to the ppi premuim, When the disclosed this to me, that is when they paid out.

No I don't know how much interest they applied to the PPI premium.

 

On the agreement it says

Interest on the Insurance £1,957.92

 

So would that be it in total or is something hidden?

 

Do you think I should send them a letter asking them to disclose the interest on the PPI?

How would I get them to disclose the Interest on the loan. The loan was taken out on the 8th December 2006 and the Annual Percentage Rate is 10.5%.

 

They say in their agreement that the Interest on the loan is £1,957.92 so is this correct or is there more that is applied to it??

 

Help Im getting confused now.

If it is a fixed term loan then that is the interest you were charged. You can then add 8% p/a on top of £6898.92, from the date the agreement started until the day they settle.

 

Was the loan a fixed monthly repayment - or did it vary.

Thanks for that. by the looks of it Natwest haven't even taken into account the interest that was applied to the PPI and although the loan isn't finished yet they have still already charged it so it all needs to be returned.

 

I will get deep into it all later on hopefully but how many of the PPI cases taken through court are getting to court or are they all settling out of court?

Hi,

Try using photobucket this way....

 

Scan the document onto your computer saving it on the desk top or another file where you can find it. Then go to the image and open with paint, using the 'rubber' in paint shop remove all your personal details including the loan number etc, anything which can be tracked back to you.

Go to photobucket.com and click on the image to open it. There will be four boxes of link codes so you may share the image with others and the one I use is the IMG code. You need to copy this code in its entirety and then paste that code onto your thread here. When you preview your thread it should then change from a load of letters etc to the edited CCA

Hope this helps and don't forget to edit all your personal info
