    • Wow thats incredible. Thank you so much
    • If the purchaser denies having received it then sue P2G. If you simply don't hear anything more from the purchaser then you have the purchaser's name and address – and frankly for £48 I would go ahead and sue. As long as you have good proof of delivery then your chances of success are probably better than 95% and frankly the purchaser would probably put their hands up as they would effectively be being sued for the civil equivalent of theft. I wouldn't let it go if I were you. It would be a good exercise for you and gives you confidence the next time something comes up which is may be much more valuable
    • Thank you again Emmzzi for your insight. Not only did I do the work, but as a maths tutor delivering financial literacy workshops under the Govt Multiply project, the college were paid £400 for each student I recruited, which makes it an even bigger kick in the teeth! I spoke to Citizens Advice Bureau on Friday who advised me to go back to ACAS for advice and assistance, as ACAS are the experts in employment matters. They did also mention small claims court, as being more straightforward and less complex, but surely their solicitor would just contest this and I would lose the £80 court fee? If I did submit a claim through the small claims court, would I just leave the employment tribunal running until the outcome? The deadline for me to submit my schedule of loss is tomorrow, so I will submit today so that they cannot hold me in breach.
    • Ive just checked the tracking again and its actually out for delivery today! Anyway,  I refunded the buyer on Ebay off my own back on the 2nd of June they havent opened a case or anything like that so surely i cant take action against either the buyer or P2G/ Evri can i ? Id hope the buyer would see fit and pay but you know what people are like these days ... Once its delivered I'll send him a polite message asking for payment but i suspect there'll be no reply

    • Hello,

On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.

Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

Please can you advise what I need to do today to get this done.

      Many thanks

    • We have finally managed to obtain the transcript of this case.

The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

Frankly I don't think that is any accident.

One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I posted this on a different thread but i thought it would be better here.

I was having a chat with one of the ppl on here last night and this is what we decided was a good idea.

1) Invoice each company £15 for opening reading and replying to there letters. Tell them they can take it off the bill or send a cheque direct to us.

2) Charge them a extra £5 each time we have to reply. So second letter will cost £20.

3) Charge them for each duplicate letter they need to be sent. £5 for first on then £4.99 for each one there after but this is only if the letter is one page long cause if it is more then the first one is charged at the £5/£4.99 but each addition page per letter is charged at £2.50 per page. A 3 page first letter costs £5 fir first sheet the £5 for both addition sheet totaling £10.

4) for every phone call we recieve we charge them £10 for the first 5 minute then £2.50 for each addition minute or part of. So a phone call lasting 20 minutes would cost them £47.50.

Remind them that all charges can come off the account.

Also remind them that if you have to do any type of legal reasurch, sitting on CAG, then this will cost them £50.00 for the first 30 minute then £25.00 for each additional 30 minutes after that.

This can also come off the bill.

also you must remind them that if the bill is not settled then you will take further steps to get your money back.

Please remember the only stupid question is the one you dont ask so dont worry about asking the stupid questions.

May be an idea to start a thread on the subject of billing DCA's. How much power would we have legally to bill them say £12 per letter sent to cover stamps/envelopes/paper/ink and time spent researching consumer law on here at say £10 per hour?

I billed Moorcroft for over £1000 :D

Is there any way I can actually make them pay up?

These are video links to show how I deal with Debt Collectors.

Don't forget to put the immortal words "Valid even if not read by you".

I don't speak German but a good word in Japanese is "konnan" which means 'financial difficulties.....' Just repeat that over and over and they will put the phone down.

And if they don't pay, get a DCA onto them.

If we all did this the DCA's would be so busy chasing each other for payment, that they wouldn't have time to hassle us. lol

Try these

Dutch ~ Ik ga niet u betalen.

French ~ Je ne vais pas vous payer

German ~ Ich werde nicht Sie zahlen

Italy ~ Non sto andando pagarlo

Spanish ~ No voy a pagarle

They mean "I am not going to pay you."

Just repeat these over and over again until they put the phone down.

Don't get me confused with somebody knowledgeable by all those green blobs. I got most of them by making people laugh.
