  1. I bought an item 9 months ago, it developed a fault and the shop agreed with me that they were getting another one in instead under warranty. However I have now found out that because the item has recently been discontinued they are replacing just part of it instead. (Parts are available but not the whole item I am told). I was not told or agreed to a repair instead of a replacement. The reason I am not happy is because the item had other areas that were of concern but the shop has baulked at replacing those because that is caused by normal wear and tear they say. Ideally I would like a complete new item not a refund. But what are my rights considering I was offered a full replacement and now just getting a repair without being asked? So what do I do about the items they say is down to wear and tear? Can I get new parts for that as well because I didn't agree to what they are now doing? I have looked at the T&Cs but can't find anything relevant
  2. Hi boys and girls, Need some of you expert and wise advice please. I have been dealing with Cabot for the last couple of years for a debt they bought from Barclaycard. Barclaycard has marked my report with settled. Recently I have got a credit report and have noticed that they have been marking it with AP every month. I also have been paying Llyods and they do not do this. Cabot phoned me and I asked the question about marking my credit report with AP, Cabot said they were doing this correctly. I asked "if You bought the Dept then and then agreed to accept my payment then this is a new agreement to which I am honouring. He kept talking about special agreement and they were entitled to do this. I asked about a signed copy of my agreement with them and they said I have no signed agreement with them. I was also not notified that they would mark my credit report. They bought the debt whilst I was paying the agreed amount and said they had to honour it. To my eyes I am paying a new agreement therefore I am doing nothing to warrant an AP on my credit record. I understand, I may be wrong I have two questions: Can they keep putting AP on my credit report? Can they request new income and outgoing form when they want? Thank you Blue
  3. We are paying a charge of £3054.06 at £100 per week agreed. Charges of bailiff are £25 per £100 - also charged us walking possession fee, enforcements under fee 5 disbursements under fee 12 etc totalling bill of £1255.40. This is a business rent debt that went to court and landlord agreed above terms. No possessions were taken, no letter sent to indicate court proceedings, no seizures; nothing. Can bailiffs charge on these terms and this amount? Thank you!!!

Hi I could do with some advice My sister engaged a firm called ****** (much to my dismay) to reclaim her PPI from the Nationwide on the grounds that she did not ask for it as she was employed by the NHS at the time (6months full pay in the event of sickness), nor did she realise she had it and when she did,what it was for. To cut a long story short the Nationwide refused the complaint and it went to the ombudsman who consequently sided with the Nationwide. Can she try again or is it final once the Ombudsman has been involved? I also feel she was misrepresented the CMC who wanted a quick outcome and payment,they didn't even fight an appeal. Any suggestions from you good people will be welcome Thanks for looking saranev :mad2:
  5. Hello All, Last month I ran into some unexpected money problems and lost my second income. Unable to meet my full repayments to 1monthloan I emailed them on 26th Feb offering/asking for a repayment plan. This is what I emailed: Dear sir/madam, I am writing to you to inform you that due to sever financial difficulty I am unable to meet this months scheduled payment. I have had a very unexpected change in my personal circumstance and I will be unable to pay the current open loan in one payment. I propose a repayment plan to assist in clearing the outstanding amount in the quickest means possible to me. I propose £35.00 every month for 6 months, to be re-evaluated once the 6 months has expired. I would greatly appreciate that all charges and interest are frozen to allow me to pay back this sum as promptly as possible. I have tried to log on today to see total amount owed, however access to my account seems to have been disabled. Please confirm final amount owed, with interest noted clearly up until this month. I would also ask that all communication is done by email or letter. I am not permitted to take personal calls at my work place and in doing so, could lead me to losing my job and therefore worsen my financial situation. Under no circumstances do I give you permission to call this number, please delete this number from your records. Can you please send me your account information so that I can set up a standing order for the payment to be made? I shall ensure that this is set up for payment to be received no later than the 27th of each month. I do hope that we can arrange a payment plan to alleviate the stress of my whole situation, and to also enable the repayment of the loan to your company as promptly as my finances will allow. I look forward to hearing from you and will help in any way I can to organise repayments with your company as soon as possible. I then cancelled my card and ordered a new one, as have heard they have in the past taken the full amount from customers accounts without permission and wanted to remain in control. I received this response also on 26th Feb which I believed was an acceptance of paying back £35 a month for the next 6 months then re-evaulating: Hi Michelle, Thank you for your email, We are happy to accept £35.00 per a month on the frozen balance of £312.00. please provide the following details so we can action your repayment plan; Payment date (the date you wish the money to leave your account each month) Payment amount (the specific amount for us to take from your account) We are committed to working with customers who are in genuine financial difficulty and hope that, if you are having difficulties in meeting the required payment, you will contact us with your payment proposals Please note your account remains subject to our automated collections procedure where attempts to debit from the card we hold on the system will continue. We look forward to hearing from you, I don't want to give them my new card details for reasons mentioned above, so sent the following on 27th Feb asking for them to confirm their bank details to set up a standing order and also a new contract to make sure I have the repayment plan in writing. Hi Kim, Thank you for your quick reply and acceptance of my payment proposal of £35 per month. Please can you send me the correct bank details, as requested, to set up a standing order for this amount. I will be paying this months £35 as soon as this is received, and on the 25th of each month thereafter. Please can you also send me a new contract stating these new payment terms. I am wanting to set up payments as soon as possible to get my loan repaid in the shortest time span but am still awaiting a reply. Kind regards, Michelle I am now getting really worried and don't know what step to take next. Will they just be adding interest and charges every day? Will I end up with a doorstep collection for some huge amount? I tried to do the right thing. Please help!
  6. Hello to all members and visitors Thanks to all who reply and offer any help Well here goes looking like a complete idiot to anyone bothering to read this post! Here's a little run down on my story, I stepped inside my nearest Lloyd's TSB branch back in 2005 and agreed to take out a Critical Illness insurance policy alongside the life insurance policy to cover the mortgage. The life insurance amounted too £30 and critical illness insurance £60. I was given the during the meeting the meeting summary and cover notes for these policies *please note* the summary notes concurs with the cover notes still in my possession and to the amounts stated above. The problem is the policy document sent and received via the post was then put away for safe keeping and never really read. The amount for Critical Illness Insurance in the policy received via the post was for a staggering £124 alone. I unfortunately paid this amount via direct debit and the life insurance £30 via direct debit for a total period of 2 years up until 2007. Its only now year in year 2013 I noticed whilst reading up on old documents/policies this massive discrepancy between what was requested and what was given. Where on earth do I stand, I have contacted the bank by phone and raised a complaint, I just don't know where I actually stand with this issue and the possible ways forward to reclaiming what I feel is monies owed back to me. Am I going to get the usual run around from the bank and be fobbed off as my fault for not reading my posted policy. I guess what I am trying to say is - how do I proceed with this to ensure I get back what I believe to be owed Thanks in advance to all replies
  7. Hi all, I had a payday loan with Payday UK last year. When I lost my job late last year I came to an arrangement with them to repay £250.00 back at a rate of £40.00 per month by standing order (this was the capital plus one months interest). I have had a very hectic year (new baby born in June) and to be honest, just forgot about the standing order leaving my account each month I (finally) realised that the money was still going out in August and cancelled the payment for September.. at this point I had paid back £400.00 in total. I contacted PDU and asked for a cheque to be issued for the overpayment and they contacted me back to say they only had a record that I had overpaid £40.00 not the £150.00 I have actually overpaid and they asked for my bank details to send the £40.00 back to me. I have not given them my bank details but instead sent them a list of all the payments I have made to date and repeated request for them to issue a cheque for balance... it's been two weeks now and despite chasing them, there has been no response. What (if anything) can I do? Thanks in advance
  8. Hi,help needed with PDL company CashChoice with trading name uklenders alliance. Took out the PDL at the end of may with them for £400 and contract was for 28 days with one onoff payment for £520 on 22nd of june. £400 for loan and £120 for interest. Checked my bank account few days later and found out,that money was taken £160 altough all the funds was avalible !!! My alarm bells was starting to ring and i knew that something was wrong,because £160,it`s not the interest,it`s just a odd amount of money??...gived a call to the bank and reporterd my debit card stolen.Went on holiday on 20th july and back in beginning of august i found the e-mail where they are saying that my account is in arrears for £680 on todays date.And they are giving totally different reference number!!! Basically,it looks like they made a deferral without me and my approve to drag out more money!!!I`ve got my contract what states clearly,one onoff payment on 22 of june £400 loan+£120 interest. Any ideas,how to deal with this matter?? Thanks for the replys,
