  1. Hi all. I am new to this forum. I know there has been a lot written about Parking Eye and that some people are getting quite annoyed about the quality of posts where people have not read previous threads or are repeating things. I hope that I am not doing that as I can't find much advice about my situation. I have done everything advised on other web sites and have now got a court date allocated to the small claims track. This is about 7 weeks from now. I have previously submitted a basic defence claiming that it was a penalty charge and that I would submit a further defence at least 14 days before the court hearing. My question(s) therefore are: 1. Do I submit a full defence as posted by Mummsy 'HAVE A LOOKGUYS AND LET ME KNOW WHAT YOU THINK ???' and 2. Do I submit ASAP or wait to see if it is struck out for any reason? Sorry to rake over old ground for regular readers! Regards
  2. To cut a long story short, I borrowed my Dad's car to take some stuff to the tip, came back and did some shopping en route, parked over the time limit in a car park run by parking eye by mistake and my Dad started getting invoices. He threw them away because I told him they were fishing, now he has had court papers from the County Court Bulk Centre in Northampton and the total claim is £135! His attitude is to pay it, mine is to fight it... ..any advice would be massively appreciated.
  3. Hi I have read the forums but still a little worried as I have parked in the car park a few times and had tickets but just ignored them and nothing came of them. Yesterday I received a county court claim from Northampton, however the date of the issued parking fine is 27/04/13 which is exactly 20 days after my father died and I would have probably been sorting things out in regards to his death. I probably did park longer than I should but only because of sorting things, to be honest it was all very emotional and now when I am trying to get back up this comes through the door. Please could you help me sort this out. I could do with some step by step guide to this matter as I don't want to end up getting a CCJ Regards Macsen
  4. Hi all, I parked in a car park for holiday inn, its free parking no ticket machines, but we got 3 parking tickets for two different cars which are both in my name, from parking eye claiming it was the hotel car park and not the gym which is what we thought, I have been reading peoples other stories on this subject and they all say bin the letters and do nothing ,but I have now received two letters before action from parking eye and waiting for the third to arrive, I cant afford to pay this money, let alone more if I end up going to court, I have looked and there are signs saying it is the hotel car park but I never saw them, what should I do? Please help.
  5. Received a letter from Parking Eye last year which I ignored. Got a second letter which I ignored. Just today received this letter, I assume I should just ignore it aswell? Or have the rules changed with the changes in October? Thanks in advance. EDIT by Slick - PDF doc't removed as requested by OP
  6. Hi all, I have recently had a great time in the lake district, now about a fortnight later I have had a parking charge from parking eye for a car park in Hawkshead. Through the holiday we used many car parks including the one in Hawkshead twice. So of course we had a ticket for every car park visited. surly they should provide a photograph of my car with no ticket. Of course I didn't keep the ticket, I have been driving for forty odd years and have never ever kept tickets. Comments/advise please.
  7. I overstayed by 12 mins and got a parking invoice from Parking Eye, while I waited for my son who was at a 2 hour dance class. It was the first time I had taken him there and he is just 8 so there was no way I was leaving him there until I am confortable that he is happy and it is safe for him to be left. I was in the class for the 'WHOLE' time. I have received a notice to pay which I ignored, and them a week or two later I received a letter that my mum signed saying that I will be taken to court if I didn't pay. I see mix reviews on here... do I respond, ignore or what? I don't really want it to go to court or be bothered with all of that. Are they official? Can they do this? How can I stop them in their tracks without having to go to court.
  8. Hi. I have read many posts on this site regarding this company, i myself received a notice today to pay £60.00 within 14 days or a £100 fine for parking in a doctors car park i had a dental appointment and could not park due to fire services doing routine work on the street i drove around awhile them remembered the doctors had a fair sized car park it looked empty so parked in there, it was dark and i didnt notice any signs to say the park was monitored, their camera has logged me as arriving at 16.22 and leaving at 17.17, which is right. i know people say to ignore the notice but would this be at my peril. any advise would be very helpful.
  9. I have been asked to post this here by somebody over on PePiPoo:- Ok Guys, this is a self help posting, today I spoke to a lady at parking eye who guarantees to get any PE parking charge, even at court stage cancelled if you are able to demonstrate you are a customer, I challenged her that not every one keeps till receipts, she told me there are a number of ways to determine shopper status and asks that if anyone has a PE charge to ring her department direct line on 0179 38 36 31 3 They are keen that no customer suffers, which means they only "penalise non customers"
  10. Hi like so many i am a newbie to his forum and have recieved a parking charge from Parking Eye. The notice has been isued after i had parked at the Welcome Brerak services in Oxford for a rest having drove from France for the previous nine hours. They have issued the notice demanding between £60 & £120 (dependant on when i am prepared to pay) on the basis that i had parked for 5 hours and 32 minutes without making a payment (They have also presented me with a photograph of my vehicle entering the carpark at 00:37 and leaving at 06:10 the same morning). The reason why i didnt make a ny payment for the parking is because i genuinely didnot see any signs where i pulled up, particularly as it was dark and in the morning i just set off without even going to the rest room. (Thats not to say there werent any signs, i just didnt see them at that time of night) Having read so many stories i am unsure if i should ignore, challenge or pay the charge. Any advice would be greatfully received. Many Thanks
  11. Hi all I am new to this site but wondered if anyone can help me. I recently parked in a retail car park that had previously been unlimited time. I did not see the signs stating a 2hr limit. (they are numerous and bold) I was not looking for them, just concentrating on a space near the entrance. I spent money in the shop and ate in the café. (have receipts) when I received the parking charge notice I unfortunately took advice from internet searches and ignored them all. I now have a county court notice which I have returned stating that I intend to defend the claim. (£165) My only crime taking my mother out shopping and for lunch. I just don't know where to begin and am running out of time. Can anyone please help me. NB Have been back to store but they say they can do nothing.
  12. Hi there, last November I parked in a parking eye car car park in central Manchester , and accidentally overstayed by 30 minutes, I thought I'd paid for 3 hours not two, my mistake. I get the usual letter with the £100 'fine', which would be reduced to £60 if paid within a fortnight. I read up on this through this forum and money saving expert, and took the advice to ignore them. I subsequently had debt recovery letters, which I ignored, I now have court papers which I can't ignore. I've read the advice on how to respond, which I'm going to do, just looking for a little more detailed help on how to argue against it? Any help gratefully received.
  13. Parking Eye has been churning out a lot of court papers recently, but also appear to have been using Debt Recovery as a threat. Has anyone had any papers after being threatened by Debt Recovery? Or any form of papers from anyone else other than Parking Eye directly. Just wondering, as we know Somerfield prohibited any court action in their contract, so I'm wondering, there must be others, so is it, either, if they can straight to court, if they can't, pass it on to another company, where it'll fizzle out? Anyone (who's been there), have any info?

  15. Hi all, I need some advice. I arrived home last night to a parking charge of £100 issued by 'Parking Eye' (kindly reduced to £60 if I pay within 14 days). When checking the date of the incident, it turns out that it was my birthday. This particular evening I had gone to the gym and then straight to a restaurant that was within the same retail park which incidently took me over the 3 hour maximum parking stay. May I add that this was a Wednesday evening when most of the retail outlets were shut and there was plenty of parking so I was in no way preventing other people from parking or using this free car park. I have read some posts that indicate I should just ignore the letter (before reading this I had unfortunately already e-mailed them expressing my displeasure at their underhand tactics when I was using establishments in the retail park the entire time). I am just concerned that this may get out of hand should I continue to ignore. I abhore the thought of having to pay out to these money grabbers but I have a really good credit rating and the last thing I want is it to go to court and them I am inundated with costs. Please help!!!!!!!!
  16. Hi, though this subject has been mentioned inother posts I thought I should start a new thread so as not to distract fromother peoples issues and also have chance to state my ‘particular’ situation. To my surprise I received a 'Parking Charge Notice'for £100; £60 if paid with 14days. It was a surprise as I had not been to theplace stated, but my son had. As he has just gone abroad to attend a wedding Ihave been unable to discuss this in detail with him but he told me to look inthe car for a ticket which I found. The times of the alleged offence did notcorrespond. The entry time of the car including photo was more than two hoursbefore the beginning time of the ticket but exceeded the end time by just lessthan an hour. In other words the ticket was bought late, the reason being wasthat my son had realized he had not bought a ticket and returned to buy one. Inthat sense I suppose he was guilty. Before reading as much as I could on line interms of action to take I emailed Parking Eye as I had not been informed aboutthe late purchase of the ticket. I told them that I had a valid ticket and thatmy son had been driving the car but I did not give his name or address. I askedthem to give me more information. I have received an automated reply whichstates that certain details must be given in order to get a response (I believethis wording relates to the appeal process which I was not actuallyattempting). One such detail is the registration numberwhich I had not included so I am not expecting a response. I have read and heard many messages andvideo’s saying just ‘ignore’ any communications Parking Eye may send, but Ihave also read on this forum that someone else ignoring their communication hasreceived notice of court proceedings by Parking Eye. I am also aware that thelaw has changed to the benefit of this type of company at some point. The amount of £60 or £100 is extortionate anddoes possibly reflect ‘loss of revenue’ by the owners of the car park inquestion. I also believe that contractual law, relates to this kind of issue, meaning that I, as owner of the vehicle but not the driver, did not enter intoany contract with Parking Eye as I was not even there. Another strange detail about the situation isthat I have noticed an inconsistency in the two photographs supplied to me onthe parking charge notice itself. The ‘arrival’ image is different from the‘departure’ image in that the arrival image shows a very long, jagged andobvious crack in the road/tarmac. This has disappeared in the departure imagewhich is the same view but without the crack. How this relates to the photos asvalid evidence I am unsure. Sorry about the length of this post but Ithought the details could be relevant. Iwould like the advice I am looking for to be up to date; an informed opinion onthe best way to deal with this. I hate these leach companies that extortmoney from the public for non-criminal, so called offences and get away withit. Thanks.
  17. I am looking for a bit of advice please. I received a parking charge notice from parkling eye demanding payment for £100 (£60 if paid in the next 14 days) enclosed was a protection of freedoms act 2012-changes to private parking notice. I have been reading a lot of advice to ignore this letter, but i'm worried as to what would happen if I do ignore this. could you offer me some advice please Many thanks
  18. Please advise. My wife went Christmas shopping to a shopping centre that has in excess of 15 retail units a few weeks ago. Today I have had a Parking Charge Notice from Parking eye to say my car was there for almost 5 hours! Only 3 hours is permited free. 5 hours shopping would kill me but my wife claims happily its really not that difficult to do any time but especially while Christmas shopping. I guess so, as she visited 6 of the shops and stopped for coffee and a chat to a friend she met there. She has receipts for 3 of the shops but not the other 3. So having read many posts saying ignore them I am concerned about this keepers liability and how best to respond if at all and what teeth does the new legislation of October 2012 give these thieves? Thanks Chris.
  19. Hi, First let me explain a few things about this ticket. I'm a mature student who studies in Chelmsford and due to mortgage/family commitments has no alternative but to commute. Parking in Chelmsford is expensive and I have to park five days a week most weeks for lectures. The university I study at also offers no parking for students. As a result I had been parking in a ParkingEye controlled car park that allows for 2 hours parking free. I arrive at 08:50ish and after my first lecture of 2 hours dash back to the car park (11:10ish) and move my car to a residential area that is only permit controlled between 10:00-11:00. After 2 weeks of doing this, so far so good, no problems. However one day, one of my student colleagues asked me to accompany her to a doctor appointment and I, in all honesty, completely forgot to move my car. I went back to move it over an hour after the two hour limit and duly have received a "fine" of £50 (increasing to £85 after 14 days) through the post. The general advice I know is to ignore. However they also sent a leaflet explaining that due to a law change 01/10/12 they now don't need to identify the driver and can "fine" the registered keeper. I'm very aware that I shouldn't have parked there for so long but also feel that £50/£85 is extortionate for one hour of parking. Also being a student, I'll have to work 2 extra days on top of my studies to pay it! (I already work/study 6 and 1/2 days a week!) Sorry for the length but does the new law mean it's more likely for further action to be taken against me or does it still mean.....ignore. Many thanks for taking the time to read this!
  20. Theresults of DVLA sight tests should begive to the person undergoing the test. Why you may ask? One part of the testinvolves a periferal vision test to press a button when a light spot appears. If you boob on the test by not pressing the button, they do not tell you. So you wait for the new licenceand low and behold you get a letter saying it is not being renewed!! Now how doyou appeal and how quick can retest to appeal the refusal? The answer is not clear and DVLA appear to have no sense of urgency. A neighbour of minehas not been able to drive since early October 2012. It is now 17th January2013! He sent, after considerable expense, a specialist eye report by special delivery at the begining ofDecember. Update- It is now 22 Feb and after he had written to them he has received a reply and a D1 to complete again! I ask, does this pay to declare honestly what problems you have? Does this make DVLA unfit for purpose, rather like the Home Office was described about 10 years ago?
  21. Posted on pepipoo Parking Eye were asked them about their legal standing to bring any legal action on behalf of their principal and/or in their own name and to provide detailed breakdown of their pre-estimated losses, they claimed was owed to them. VCS v Ibbotson and VCS v HMRC.were also referenced Here is their reply:
  22. I have been reading all of the threads on this forum and a few others for a few hours now, so I have a general picture of what is going on (i.e. low chance of getting to court, they need to prove the illegal parking damaged > business etc.). However, I see that all the "IGNORE" words on this forum have a link on them, and when I hover I get a message telling me to actually write to the CPP (see below). Any ideas of why this change in attitude? Should we start replying as the message indicates? If you are considering ignoring a letter from a private parking company demanding money for some alleged parking incident - you should understand that this may not be the best course of action. The best thing to do will be to reply with a brief letter denying that any money is owed at all. Ask the PPC if they have authority from their client to bring any legal action against you and are they entitled to bring a legal action in their own name. Finally tell them that depending on their answers, you may be willing to consider their demand but you require a breakdown of the figure they are demanding and an explanation as to how the sum claimed represents their administrative costs. If you reply to the PPC in this way, they will then understand that you are up for a fight, that you know your rights and that there will be no chance of an easy default victory if they decide to take you to court. Write only once and then do not respond to any other demand unless they reply to you in full. We think that this is better than merely ignoring them PS: I suspect some CPP bought advertising on the site for the word "ignore" ?
  23. Evening, I have received a parking eye parking charge notice asking me for £40 as I was over the 1 1/2 limit at the local Aldi store. I have appealed against this, and attached proof to them that I was shopping in the store and not just parking there. Do I have to pay if they refuse the appeal? As its states the following on the letter you are notified under paragraph 9(2)(b) of the schedule of the protection of freedoms act 2012 that the driver of the motor vehicle is required to pay this parking charge in full We have the right to recover any unpaid part of the parking charge from you!! Your help is much appreciated :-/ Carly
  24. Hi Guys, I parked in a hotel car park on business at the Ramada, Glasgow Airport, for (so I am told) 1 hour 38 minutes. I parked in a disabled bay with disabled badge showing, although that wouldn't appear to be the issue. I was aware that there was a meter, but as I normally do, I assumed they didn't apply to the disabled! Now having been asked for the princely sum of £100 (reduced to £60 if I cough up sooner) am I right in assuming that the normal ignore rules apply....this is private land etc and I should just ignore the letter for now and the what I assume to be follow up threats etc? Thanks for reading Frank
