It is the SDM who does the decision and they are taken into account, but I would think the taxi drviers earn a lot more, then we have the people who earn £20 dead, printed wage slips to boot, and the child minders who declare under the disregard, how dear is childmindiing these days , they sure must have a lot of overheads.

Ok first part, one week you earned the £150, £100 materials, week 2 nothing, week 3 nothing, week 4 the £150 - £100 = £100 0ver 4 weeks, so SDM would say thats £25 per week on average, so less £10 disregard so take £15 in per week from the ESA, thats an example, they would ask for your earnings over six months on average. In the winter you may be quiet, in the summer more busy so it would average out. Now CA, Carers Allowance you can earn up to £100 per week after expenses without if effecting it, so you can carry on claiming it. I would say dxerbypub, sit down now with a pen and paper see what you have made in the last three months, spent on materials, even petrol, etc for delivery and get your self a figure, divide by 12 weeks and thats what income would come off the ESA. I think you will be surprised, at how little it will be, plus you are getting something out of it.... DLA no effect or HB because ESA would take your earnings into account. The SDM will not ask for rocket science, just basic hand written accounts on a piece of paper, remember , wood, nails, glue , roof materials, delivery etc etc....# amount sold for, and how many made, thats all

I think it will cut out some fraud, the amount of self employed taxi drivers working 20 hours a week and declare £20 a week earnings is beyond a joke, however i do feel for the genuine people who are struggling, who will be hit by this i think it is unfair. if your not earning this money then your claim should not be based on this amount.

Goodness knows whats going on, paydays should have remained the same, take the last two digits of her NINO. 1-20 mon 21-40 tues 41-60 wed 61-80 thur 81-99 fri so that will tell you her payday., Right you can get form of authority to speak to the DWP on her claim, you need just need to be with her when she makes the calls, go through security and you can speak to them on her behalf..

You can work up to 24 hrs and your wife still be entitled to ESA, she would have to ring up and inform them you are going self employed, but over 24 hrs will nil the claim. You would have to inform CA if you start S/E. There is a disregard think its £10 then your self employed earning would be taken pound for pound into account. Your earnings would be looked at every six months or sp by a SDM, they would balance up what you spend on material etc to what you earn, so if you sold a hutch at twenty pounds but it cost you fifteen pounds in materials they wouldnt say you earned not £20 but £5 say etc, they average this over 16 weeks so its fair. Have a think about it, but I would say if you are doing it now declare it, before someone phones up and does it for you........

But after that you may be entitled to ESA IB if you satisfy the conditions of entitledment.

I dont honestly think it will look good, you are seperated and yet you are going to take on a mortgage thats going to tie you together maybe for the next twenty five years, it doesnt sit well. I know it be better for your self and the children, but its linking you together for the forseable future. A commitment I would say, If a living together decision was ever made on your claim I think this may go against you You are seperated, what if he wants to move on and meet someone else he cant if he still tied to you, worth thinking about as you may have to sell it then, anyway, Why are you living with your parent when you have your own flat. would you not be better there for now? It sounds wonderful on paper but may backfire -

If a person has been found fit for work by atos then who could stop them claiming JSA -
Have you stopped caring then, if not CA is paid on a Monday, why dont you wait tlll then, at least you will not have an overpayment.... You can then decide to keep on I.S for eight weeks or claim JSA straight away

You could appeal the ESA decison. -
You failed your medical so you can appeal it, you will be entitled to the appeal rate on ESA which if over 25 is £71 per week. The problem you have its Income Based so you may not be entitled to ESA untill the end of June. If you have had a student loan, even though you say you had your last payment April, the grant is attribuited over 42 weeks usually, the beginning of September to the last week in June so this may nil your claim as the loan is taken into account, but it depends what you had. you can cancel your Carers Allowance any time you like, ring cancel it say your reason is you have ceased caring, ring I.S tell them CA has ceased. You have two option now, you can then close your I.S and claim JSA you will get the carers premium for eight weeks on your new JSA Claim, or you entitled to a run on of I.S for eight weeks then your claim to I.S will close and you will put your claim to JSA. So the choice is your... Everyone on carers allowance gets a premium called the carers premium, you get a run on of eight weeks when the CA claim is closed. Your sister would be sent and IS10 for SDP when you cancel your carers claim. She will have to ring ESA to request it

Hi Adeyb sorry you are against it With regards to your ESA first were you getting a grant or loan to cover your course? Your DLA sorry to have to tell you your DLA decision has not been revised, this means they are saying you are not entitled to any rate, they have looked at it again and have come to the same conclussion

you should get ESA in payment from the end of June, Housing benefit will go on household Income but I think as you are entitled to ESA IB you will get full housing benefit as they are taking your bursary off the ESA claim and they cant whack you twice for the same income, some one will correct me if wrong. Sorry Kate is so ill and hope it goes well, if you need help with yor ESA there are loads on here to give you advice Nistagmite in particular Hopefully she will get back into the support group, if she cant there is no hope left -

Think I am going mad. What bursary figure do you get What is her entitlement Just found an on line calculator £160 x 52 = £8320 why are you not entitled, I just took your word sorry £31. O0 see it now doh!!!!! not DLA its ESA correct figure of entitlement then. think its late Yes at last lol she is entitled to £31.00 ish ESA sorry but they are right Appeal and get her back into the support group, you will be entitled to HB -

No not Nursing Bursaries thats taken in pound for pound and attribuited over the fifty two weeks, for income based benefits Student Loans or grants, yes, £350 books and a bit for travel or something like that cant remember, and thats attribuited September to end of June depending on year -

Its so sad you have enough to contend with, but unfortunately for benefit purposes it doesnt work like that. You are a couple and they have classed you as one, for ESA IB purposes, Now you have said she DLA high Care, my calc was correct, couple rate, wrag and couple EDP £160 ish. You bursary is an Income, there is no disregard they will take it into account pound for pound That Contact centre should have closed six oclock by the way But the section would be gone five. The link you have put on refers to capital, not income so doesnt not apply to your situation, sorry You have appealed to get her back into the support group I think this is your only hope, there are good people on here who can help you with this, I dont agree I think it is awful and I sure hope you win your appeal -

This could be correct, you say you are a couple but she wishes ot claim ESA IB as a single person, this is just not possible unfortunately, your Bursary is classed as household Income and I think this will nil her claim to ESA. She may be have been entitled to ESA conts you get this in your own right but ESA IB goes on household income. The figure I think they have quoted you is ESA couple plus the Wrag component, Checked this cant get it does she get higher rate care this would mean couple EDP, this would make £160 in total but if she is only on £30 as you say per week DLA this will not give her premiums, but there is no rate of DLA thats £30 They have gone from the end of June as her student loan would have niled the claim to that day. If she didnt receive on they have used the dates of the course -
You dont have to inform ESA untill you start college, but if you get a grant awarded or loan prior to going then yes inform them staright awy. eg loan awarded 1st of Sept start college the 15th...
