  1. Earnings for CA have a limit of £100 after tax deductions etc but if you claim SDP you wll lose this
  2. You can claim I.S OP eleven weeks before the baby is born. You state that you are living with your partner, you shouldnt therefore be claiming JSA as a single person unless you are on JSA conts. If you are on JSA IB then you need to declare him. Anyway when you reach 29 weeks you can claim I.S but you will claim as a couple, you can do this as your partner works under 24 hours. The claim will be processed and his wages will be taken into account, he will get to keep the first ten pounds after that it will all be taken into account pound for poun eg earns £100 then £90 will be taken into account SMP is statuatory maternity pay, sorry you would not be entitled as you have stopped work. You can go onto ESA as well, ESA conts, or if ESA IB you will have to declare your partner Conts means contribuition based, you get this if you have paid enough stamps. IB is income based..
  3. They dont check credit files for that reason. They have scans that link names to addresses, and if it provides a match then the file is checked eg single tax credit claims etc
  4. you can claim I.S when you are 29 weeks pregnant, you can claim as a couple, your partner has to work less the 24 hours a week to qualify you then can claim for up to fifteen weeks after the baby is born. and yes £10 earnings disregard for your partner, then its taken in pound for pound Why are you not entitled to SMP then?

  6. standard interview then, so no need to worry, if you only got the one account take a mini balance statement out of the wall, if they want more then you can supply, if you bank with Santander like myself then ten days for a statement so dont worry, its common you will be fine
  7. If the letter starts, a doubt has arisen about your claim to benefit then there may be a problem, if not you will be ok
  8. Its scarry and I am sory you find yourself in this position, but you can and will get through this. I cant go into to any detail but there was someone who defrauded the department out of about the same amount. That person actually worked for the department and they got twelve months suspended sentence, they had omitigated circumstances. The sentence means if they get into trouble again, they will serve that sentence, that person will not believe me. That was a while back and that person has now changed their life around.. They went through and came out the other side... Every case is looked at differently, nothing is black and white. But hopefully yours will not go to court.. And if it does you can prepare well. When you are ready to post that letter post it but keep a copy though for you records and peace of mind. You are paying back your OP, so its just a waitng game now.   10. Think you have done the right thing by seeking legal advice, the solicitor has told you that the DWP has not yet decided whether or not to take it further.. I find it strange that they said you can start making repayments and decide they may prosecute. So the solicitor said, leave things for now and if it progresses further then get in touch so thats good advice. Would it do any harm to sit down and right a letter to the Department detailing how this all came about and address it to the person who conducted the interview, I dont think it will. I think it will do you good to put everything on paper and explain how this all came about. You were in a dark place, people make mistakes... A lot of people think that because you can be a student on I.S, then its ok, of course then the grants are awarded and they think its still ok.. We see this a lot. Its like part time earnings people thing they can work up to 16 hours, yes they can but the earnings are taken into account. So benefit rules and regulations are complicated even for some one in good health, when you have ill health then they are twice as hard. So no I think writing a letter will do your case no harm. You could have appealed it, but on what grounds? I cant say what will happen if it goes to court, but if it does sounds like you have got yourself a solicitor, you will have time to get as much evidence with regards to your illness as you can, from your doctor, specialist etc. So you will have enough time to prepare. They might not take it to court, you are prepared to start paying it back, my customers OP is iro of another other property and that isnt going to court, and you know the ironic thing the OP is 74k and the property is worth 54k as its rundown. I think you are getting good support on here, you are not alone
  11. Think you are worrying about nothing.. How you spend your benefit is your own personal choice. DWP would not be interested at all, why would they be? Sounds like you manage your money well to be fair and you have got every thing covered.......
  12. Unfortunately JSA and I.S are both £71 per week. She could claim JSA up untill she reaches 29 weeks then go onto I.S, she could remain on I.S then untill she finds work or at present until the new baby reaches 5. She can work up to 16 hours while on both but after the £20 disregard then her wages will be taken into account pound for pound
  13. Its sounds like a standard complience interview, they have asked you for proof of identification and proof of address. These are common interviews, sometimes its a visit at home and somtimes a viist at the Jobcentre. You have to attend or show good reason why you cant, if not they can and will suspend the benefit. You may even be entitled to more benefit, you mention DLA, so if you are not in receipt of SDP, you may be entitled to that. Dont worry, its standard pracitice, a benefit check and all should be ok......
  14. If you have transferred over from IB to ESA and sent in your ESA 50, they have looked at it decided you didnt need a medical and found you fit for work, then you can appeal this. You need to do it straight away with one month. You will be paid ESA appeal rate whilst you wait for your medical that £71 per week if over 25. This will give you full HB, and you will keep your DLA... I am taking it you have no partner working over 24 hours and no capital over 16k....
  15. I think Hensteeths case and your case, are very different. Hensteeth had a mortgage fraud application and a benefit fraud resulting in a total of 45k. OP your OP 20k not good, but given your health issues etc may be treated a lot differently. and OP please stop winding yourself up.. Seek some help from CAB or Welfare rights. Or some legal advice. I dont know how your case will pan out but lets put this into some sort of context. I have just submitted an overpayment for 74k, cust had a property that wasnt declared.. so you are not the first or neither will be the last.
  16. It may be your ex then.. Sometimes you get a visit after a birth its not always the case though Does he claim benefits and if so from what address? Or does he work? Please stop stressing I dont think though this has arisen from the work focused interview
  17. Hi SCoutt88, they will not tell you in advance what the interview is about.. You have racked your brain trying to think why you are being called in... You have listed three reasons, last one child tax credits, it would not be about this for sure if your claim to CTC is a single claim. Your training, I dont think it would be this unless you have done some paid work. You should have notified the Dept it is a COC, change of circs. The first one your Ex, maybe....... Firstly its strange if they suspect a LTHAW, living together a compliance officer goes out to visit after some form filling has taken place, but it is common place for a visit after the birth of a baby. So I would say they have had a report maybe or allegaion if it is this, and it may not be, that you have a partner, neighbour or someone could have reported this and they have looked in to it....... So a few quick questions, does your ex then have an address of his own, is he registered here for work, doctor, dentist etc. How often does he visit, and why does he have to stay over?? Why cant he have the child at his own place. Questions they may ask It may not be because of your Ex, do you have any capital?

  19. never asked for it, but I remeber it being on the statements, plus I know they added it on to charges, which pushed it over the limit, then they defaulted it. he paid it off but they left it on the file as settled, when they said they would remove it. just think we should try thanks for reply much apprecated
  20. The Job Grant and HBRO are finshing in April. If you claim is continuos, not a days break. then yes you should get it after 26 weeks entitlement of JSA IB, think read on here not Conts
  21. A friend had a Capt 1 card for a few years and we know there was a PPI on it. The card is closed now, but we can view it on his credit file. How do we go about getting this refunded please ? Had a few texts about using a company but thought we would have a go
  22. your payments will stop, the case will be investigated to determine when they believe the overpayment due to nonreported change of circumstances began, an amount will be calculated that you have been overpaid, and this will either or both be handed over to debt collectors, and the fraud prosecution side. Not engaging with the process is almost the worst thing you can do, as it leaves them open to make decisions which you may not later be able to effectively challenge as you are out of time to lodge an appeal. See CAB, and tell your husband.....
  23. You have made the claim not him so he will not be dragged into it as such, But he will notice something going on surely He will not lose his job, does he work for Goverment or something that this could effect.......
  24. Depends on your payday.... If the course ended on the 29/6/12 you will not be entitled to JSA for the full benefit week. because of the student loan.... if your NINO ends 1-19 then you are a monday payday. So they have started your claim from the 3/7 three waiting days to the 5/7 paid from 6/7.. if this is not correct then ring them again
