TM legal? why didn't ovo do this themselves as they do but chose to sell the debt on for 10p=£1? funny debt you state you reived a letter of claim, why did you not reply too it.? also is there is no indication of the date this bill comes from on the claimform? how do you know its from 2022? what other previous paperwork have you received? please scan page 1 of the claimform and bothsides of ALL previous letters upto one mass pdf read upload carefully. .................. pop up on the bulk court website detailed on the claimform. [if it is not working return after the w/end or the next day if week time] . When you select ‘Register’, you will be taken to a screen titled ‘Sign in using Government Gateway’. Choose ‘Create sign in details’ to register for the first time. You will be asked to provide your name, email address, set a password and a memorable recovery word. You will be emailed your Government Gateway 12-digit User ID. You should make a note of your memorable word, or password as these are not included in the email.  then log in to the bulk court Website https://www.consumeractiongroup.co.uk/topic/466952-lowelloverdales-claimform-old-cap1-debt/?do=findComment&comment=5260464 .  select respond to a claim and select the start AOS box. .  then using the details required from the claimform . defend all leave jurisdiction unticked  you DO NOT file a defence at this time [BUT you MUST file a defence regardless by day 33 ] click thru to the end confirm and exit the website get a CPR  31:14  request running to the solicitors [if one is not listed send to the claimant] ... https://www.consumeractiongroup.co.uk/topic/332546-legal-cpr-3114-request-request-for-information-when-a-claim-has-been-issued/ type your name ONLY Do Not sign anything .do not ever use or give an email . you DO NOT await the return of ANY paperwork  you MUST file a defence regardless by day 33 from the date on the claimform [1 in the count] ..............

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Ok that would be good and I will reserve judgement until then and I do not mean any disrespect if I am totally wrong but at the moment not sure if I believe you are an ex employee as your response to my first question was wrong.

 

I could be wide of the mark and if proven to be so I will apologise but I'm not 100% sure of your authenticity and so please do not take offence when I tell others to beware at the moment.

Andie, I have just nearly killed myself getting down from the loft to check for more paperwork (you know that niggle that won't go away) and it was SO worth it. I am now attempting to hook up the scanner...will just put this on the open forum for everyone.

 

Blows the 'block policy' thing out the water....and wait till you read the rest. They are either telling us bull...or the FSA.

glous If you genuine please forgive out caution. We so often get trolls posing as either stressed out debtors or former, wanting to help, employees of lenders & dca's when in fact they are anything but.

 

They give bad & sometimes downright dishonest advice on the pretext they are trying to help causing some members to make mistakes.

 

Anyway as it's impossible for the mods & us long term members to patrol the site looking for those Muppets I'm sure you'll understand that it's very important your credentials are verified at the outset

Im sorry to hear that you have been part victim of the Welcome saga.

 

You wont find much love for Cattles on these boards, we have had bad experiances with people posting as sincere helpers only to find they are actually covert Welcome staff trying to draw information.

I was trying to explain to andie_303 to "prove my authenticity"...

I am an ex-CAM - I would have been the person to make those horrible phone calls and knock on doors. I have bever felt more disgusted with myself than now seeing all your posts! I am totally ashamed. basically 1-29's are accounts that are in arrears and cannot be deferred (given "payment holidays") Per's are personal loans and Asset are cars (HPs) and Secured loans. 30's are accounts in more than 2 months arrears and COF is charge off, accounts sent to the LMB (local management branch) where customers are given silly rewrites

 

OK thanks sorry I didn't understand the lingo - so again sorry if this was a stupid question but you personally did you ever do any of the sales stuff? Where you would sign someone up to an agreement etc?

sorry for??? I understand how it must come to suprise that commission wasn't earnt, after all, why would the job be done? but bonus was BIG you could earn almost double your annual wage if the branch was hitting targets

didn't mean to type that on here - and all i'm gonna say on this now is i KNOW commision is earned - and whats more I can prove it -thats why I am surprised you say no.

contracts are made to look complicated to intimidate customers, Secured Loans have to be signed on trade premises. Plus if there is no charge on your property, then the contract is unenforcable

 

 

Ok I think this needs alot more explaining if you have the time.

 

Personally mine was done via post and yes it is secured.

 

And no charge or unsecured are unenforcable??

I understand you guys have to be careful. But there are so many people still at WFS who can't leave, they feel trapped. A girl of 29 died from a heart attack from stress just before xmas, I lost all my hair etc. It is scary

surely if all the employees feel they are being bullied there are people who you can go and talk to for example ACAS and unions dont understand why you would remain in a job if this was happening. Bullying at work is a big NO NO and is not tolerated so why does no one report it

I tried and got threatened with the sack. HR cover everything up so there is no proof.

I am sorry if I seem sceptical but I am a social worker and have worked with a few people who have taken cases to tribunal and they have kept recordings and e mails and other proof when the company has denied it and all have won their cases and these have been 1 person fighting the company but if all the employees are being bullied then there is a voice in numbers

To all the long term people on here the information you have all supplied has been great I have been fighting with Welcome for over 2 years on my own about mi selling of PPi and have learnt a lot to help me with my fight a very BIG thaank you for all your hard work and the hours you put in on here I have only been following for a short while and it has already taken over my life.
