    • Yep let us have a good laugh eh from today’s Telegraph 🤣😂🤣 the rest must try harder    Farage won Friday’s election debate, a poll finds Nigel Farage won Friday night’s seven-way BBC election debate, according to a poll.  A snap poll of 1,031 voters by More in Common found most thought Mr Farage won the debate, followed by Angela Rayner. Mr Farage received 25 per cent of the vote while Ms Rayner received 19 per cent. The Green Party’s Carla Denyer was the third most popular with 11 per cent, Stephen Flynn for SNP received 10 per cent and Penny Mordaunt, the leader of the House of Commons, took 7 per cent of the vote. Daisy Cooper, the deputy leader of the Liberal Democrats and Plaid Cymru’s Rhun ap Iorwerth took 5 per cent and 2  per cent respectively. The debate saw Britain’s main seven political parties clash ahead of the general election on July 4.  Mr Farage, who returned to frontline politics for Reform this week and is standing as an MP in Clacton, challenged his political rivals on immigration and net zero policies.
    • Hi CAG Team, I'm seeking your skills and help for a NtK my partner received through the post earlier this week. To give a little backstory, my partner and I, along with our young children (4 and 7), decided to go on a camping holiday about 3 hours away from us. We took a car each because we didn't have enough room in one car. We arrived at the services at very similar times as we followed each other the whole way. So, two cars. My partner has received this NtK, but I haven't. This NtK dropped through the front door on Wednesday, June 5, 2024.  We both parked in the Burger King car park, not in BP; we got out, all went for a toilet break, got some food from the BP garage and returned to our cars to eat.  After eating, we took the kids to the toilet again before leaving to complete our journey. I didn't notice any parking restriction signs and can't get back to the location due to how far away it is. I noticed another person had an issue here and reported it to you, and they managed to get the fine dropped. See below. To me, it looks like they have cameras at the complex's entrance and exit. I'm not sure if they own the land/car park by Burger King, so I'm not sure if this is a legal contract or not.  I find that 30 mins limit at a Services that serves hot food to be ridiculous and unfair, especially as we had kids to feed and water.  And the fact that I didn't receive the same NtK despite us driving in and out together is just crazy.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I owe about £4k in total to 5 different credit cards. Its been going on about 9 months and alot of phones calls (which i ignore) and letters. A neighbour said there was someone in a flash car round asking about me and a letter managed to make its way to my sisters house in which i have never lived and she is married with a different surname! (that was embarrasing)

 

I've just found out about the CCA letter so i've been busy typing up the letters.

 

Heres who's been chasing

 

Capital One - Lowells

Halifax - iQuor (new name)

Barclaycard - Credit Security Limited

Mint - Fredrickson International Limited

Royal Bank of Scotland - Buchananclark & Wells

 

Along with some tame legal threats from Debt Solicitors coming off these debt agencies.

 

Letters posted, i'll let you know how i get on. Feel a bit lighter now i'm dealing with it.

Once the replies start coming in let us know what they are saying and we will

help you to put them straight. {I am using "straight" in its widest possible context :D}.

If the debts themselves are a few years old you shouldn't hear too much from the your CCA requests as the original documents have probably disappeared. If that is the case some of them might try and pass off an

application form as the real deal instead.

with regards to the letter that went to your sisters, was it addressed to you and opened by mistake or was the DCAs name on the outside of the envelope?

Yes it was addressed to me and had that blue colour around the edges as if it was important so she opened it. It said something about someone calling at her house and she was very worried. She called the company up and gave them a good telling off without mentioning she knew me. :)

It may give you some insight as to the way they do things, although they've treated others on CAG far worse than me.

 

Hopeful1 and I are sharing the same CCA timescales with this lot and they've well exceeded them. Not heard anything since they acknowledged my CCA request on 21st May. I reported them to Trading Standards and Financial Ombudsman Service a few weeks ago.

i'm just a little confused on my next course of action. If they do find the CCA i then send a the S.A.R - (Subject Access Request) about getting the extra charges removed. If they don't find the agreement am i right to say its unenforcable and i do not make any offers?

 

Also would it get passed back to the OC and i make an offer to them instead?

Normally what happens if they can't find a copy of the agreement the debt get's passed back to the OC. If they can't find the agreement then yes the debt is unenforceable. The debt may get passed to another DCA by the OC (even though it is unenforceable) and the fun and games start again. That is why when they can't find a copy of the agreement it is important to push for closure on the account with the OC.

 

If they can find a copy of the agreement and it is enforceable you would then send a SAR and dispute the amount owing. It is important to note though that not all credit agreements are enforceable as they are required to contain all the prescribed terms under the Act.

Buchananclark+wells - 'cease all action' placed on my account with immediate effect... they are asking OC to revert back to me within 28days.

 

Credit Security Limited - In the Circumstances we will take no further action and have returned your account for our Clients attenion.

Hi Everyone,

 

Well its been almost a month now since i sent the letters. Only one company (MINT) managed to find the original credit agreement, it looks pretty legit (signature, interest rate, credit limit) and came with about 50 pages of statements.

 

So i now send them a S.A.R - (Subject Access Request), where has the template gone?

 

What do i do with the others now?

 

I'm not really in a position to pay as i have no free cash at the moment, my income is similar to my outgoings. Should i try to push for closure on these accounts as i am not in a position to pay or make a small offer. I have friends and family willing to help.
