    • I'm still waiting for them to kick out sunak and bring Johnson truss and farage in late as it is - as an act of desperation. Tossuss and some others as well as those who were (alleged) brokering a farage ennoblement deal are promoting it aren't they?

And for those who lose their seats, they will be looking for new employment.  Sunak is like an accountant, suddenly put into a leadership role, but without the intelligence required to think in a multi dimensional way.

So after a 14 day investigation with p2g i had a live chat with them yesterday ( 8th June) who said they didnt know where the parcel was but closed the case as i didnt take out their protectiove insurance.  So now at 07.33 on the 9th of june i was repling to this thread with all the relivent information to start a claim and i check the tracking of the 'Lost' parcel for specific dates to find the tracking has updated and the parcel is now at the recipients local depot  ? which is annoying because ive already refunded the buyer as i didnt want any negative feedback as it was an ebay listing and id want a refund if i was in his postion. So i posted the parcel with Evri on the 20/5/24  The delivery date was missed due to it being sent to the wrong depot and a case was opened on the 25/5/24 14 Investigation failed to locate the item in Evri's system and case closed on the 8/6/24 and now the tracking has updated on the 8th saying its at the recipients depot so is likey to receive it in the next few days .... Typical.  Oh well nevermind , thanks everyone

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

sparkie this sounds like someone is scared! Joyce Tudor may well end up as the sacrificial lamb as the Data Controller ultimately carries resonsibility for the whole company.

Far too complex to explain on Pauls thread its all on my own RBS thread ...I have been fighting RBS since 2003 and I still am this is only one small aspect of my fight.

Nope, but as my MP stated the meeting was just "a further step" to get to the bottom of RBSs handling of my accounts...the next step would be a meeting with the Chief Exec, or An FSA investigsation...don't you think?

The is more than enough in this thread alone to warrant an FSA audit IMO. Unfortunately, as I've said before, I cannot see the government allowing the FSA to find prima facie fraud at the heart of a bank that it owns. Even if the FSA were to audit the banks accounts I'm absolutely convinced they would give it a clean bill of health, despite what is blindingly obvious to anyone who's read this or Sparkie's thread.

Hi all, going through the (now ex's) rbs paperwork to get the next complaint letter done and something jumps out at me from the 'apparent' print outs of his notes.....the words Debt Manager Credit Management Router Account,

 

in fact hold on and will scan this in for opinions....

Debt manager is the program which would include the router ie its not the router itself but the means to activate one/set one up.

Read it now and I was going to post a one word response "shocking". Except it isn't shocking. Its another example of an MO that these fraudsters have/had been operating for years. I'm disgusted, angry and frustrated. How any of you have kept your sanity is beyond me. Beyond that I'm lost for words
