    • Thanks for that, Bazza. It sheds some more light on things but I’m still by no means sure of the OP’s father’s likelihood of successfully defending the charge. This in particular from the guidance stands out me: He does not meet all the s88 criteria. S88 is clear and unambiguous: It makes no provision for either the driver or a medical professional to make a judgement on his fitness to drive under s88. S92(4) and the June 2013 guidance you mention defines in what circumstances the SoS must issue a licence. It does no modify s88 in any way. However, delving further I have noticed that the DVLA provides a service where the driver can enter a relevant medical condition to obtain the correct documentation to apply for a licence: https://www.gov.uk/health-conditions-and-driving/find-condition-online I haven’t followed this through because I don’ have the answers that the OP’s father would give to the questions they will ask and in any case it requires the input of personal information and I don’t want to cause complications with my driving licence. It is possible, however, that the end result (apart from providing the necessary forms) is a “Yes/No” answer to whether the driver can continue to drive (courtesy of s88). With that in mind, I should think at  the very least the OP’s father should have completed that process but there is no mention that he has. But the significant thing which struck me is that it is only the least trivial version that does not require a driver to report his condition to the DVLA. But more significant than that is that the SA Trust makes no mention of continuing to drive once the condition has been reported. The danger here is that the court will simply deconstruct s88 and reach the same conclusion that I have. I accept, having looked at the DVLA guidance, that there may be (as far as they are concerned) scope for s88 to apply contrary to the conditions stated in the legislation. Firstly, we don’ know whether there is and secondly we don’t know whether the OP’s father would qualify to take advantage of it. Of course he could argue that he need no have reported his condition. The SA trust certainly emphasises that the condition should not be reported until a formal detailed diagnosis is obtained. But the fact is he did report it. As soon as he does that, as far as I can see,  s88 is no longer available to him. Certainly as it stands I maintain my opinion that he was not allowed to continue driving under s88. The only way I would change this is to see the end result of the DVLA exercise I mentioned above. If that said he could continue driving he would have a defence to the charge. Without it I am not confident.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi to everyone in the HSBC forum.

 

I think I have 'Sorted' Barclays out and now intend to go after HSBC. I had huge problems with them after my first wife died, after clearing the mess they left me in I changed banks in 1999.

 

So, first off, S.A.R. to find out what information they still hold on me.

 

Also I had better take time to consider what interest to charge.

 

This could be a long haul, but with everything you guys have taught me, I feel like a challenge, particularly as Barclays are funding it. I am watching the 'Six Year Treads' with great interest.

O.K., A quick update.

 

I walked into my old HSBC branch today and asked for my old account No's. A very helpful Clark took my details and went behind her P.C.

As I closed this account in Jan. 1999 I did not hold out much hope.

Surprise, surprise after a few minutes and a few security questions she reappeared with my old info. RESULT 1 !!! :D

 

This tells me that if they have that info. at the branch they should have my statements somewhere. ;)

 

Some advice please :- I intend to go after my old HSBC current account charges, my even older Midland account charges and a old Midland card services credit card. Do I split this into three claims or keep it as one ?

I now have all the account No's

 

Also does anyone have a link to a good 'Pre 6 years S.A.R.' please, I have seen so many over the last 2 weeks. :confused:

I would personally do it as three separate claims and if you've got the time, tackle them one at a time so as not to get too confused :)

 

I would imagine the current S.A.R. would be sufficient, just altering minor details for your own circumstances. In fact just having another read through the standard S.A.R. letter, it should be fine.

 

They'll most likely try and delay past the 40 days saying something along the lines of "Please give us more time as the information you have requested is held in archive format etc..." It's up to you if you decide to or not BUT I personally wouldn't and once they go past the 40 days under the DPA, file for Non-Compliance, info here http://www.consumeractiongroup.co.uk/forum/bank-templates-library/6986-data-protection-act-non.html

Indeed, if they can call up an old ac no, then what else can they do? :-D

The data request asks for all data held on you... this is what you require, all the data no matter how old it is :-D

Oooooooo very interesting. Ive already been into my local branch basically requesting the same. The lady was much less then helpful and made me wait ages and ages and finally came back saying "I suppose it to reclaim bank charges huh ?? I just said , no actually, its to help find where my money went, Im getting a divorce........ a lie I know, but I thought it worth a try, she just grinned knowlingly and said, well sorry we dont hold records going back that far. We cant help you Im afraid........ but nvm Ive sent off SAR to HSBC Data Protection address and will just have to wait and see what they come back with. But now I know they have some info going back much further I will challenge them with this if they come back with NADA on my SAR letter. But thanks crusher for the reference to this post. Hi Pattacake,

 

I am sorry I don't know your claim, but unless it's very large with a number of older charges on it, it is properly not worth trying for overdraft interest.

It can be very difficult to work out and easy to make a mistake, but I stand to be corrected ??

Interest charge is usually the interest charged for being overdrawn the total charges relate to when you have gone over an agreed limit both of these charges can be claimed back. :-)

Hi Alex... Well have read your sar... looks fine to me... however only one observation.. I'd leave out reclaiming the £10.00 fee, This is for a service and is not seen as a penalty... Anyway its more than likely they'll send it back??

Is anyone else going a ' Pre Six Year Only ' claim with HSBC. As I have no 'post six year' charges from them (that was Barclays job ;)) I wonder how much of a problem this will put in my way ?

(CCA request have different timescales Ie 12 days, and after a further 30 days it is an offence, this is why I sugessted that you do this seperately to avoid confusion.)
