Think I have come to a plan dx please correct me if I am getting you wrong but I am going to go down the route you suggest. simply stop payments for now until I receive a DN and it gets marked on my file. Then contact each lender and start making token payments to each one. i then assume most like they will then at some point sell to DCA. Once they are sold I’ll be coming back to see how best I deal with it.  Let me know if I am making some error in judgment or missing anything with my plan

    • I googled "prescribed disability" to see where it is defined for the purposes of S.92. I found HMRC's definition, which included deafness. I don't  think anyone is saying deaf people cant drive, though! digging deeper,  Is it that “prescribed disability” (for the purposes of S.88 and S.92) is defined at: The Motor Vehicles (Driving Licences) Regulations 1999 WWW.LEGISLATION.GOV.UK These Regulations consolidate with amendments the Motor Vehicles (Driving Licences) Regulations 1996...   ….. and sleep apnoea / increased daytime sleepiness is NOT included there directly as a condition but only becomes prescribed under “liability to sudden attacks of disabling giddiness or fainting” (but falling asleep isn't fainting!), so it isn’t defined there as a “prescribed disability”  Yet, under S.92(2)(b) RTA 1988 “ any other disability likely to cause the driving of a vehicle by him in pursuance of a licence to be a source of danger to the public" So (IMHO) sleep apnea / daytime sleepiness MIGHT be a prescribed disability, but only if it causes likelihood of "driving being a source of danger to the public" : which is where meeting / not meeting the medical standard of fitness to drive comes into play?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I think you're a little confused ... the contractual compound interest isn't what you've been charged - it's what you charge the bank. Basically you have to decide what you want to claim ie ...

 

charges only

charges + interest paid on these charges

charges + interest paid on charges + contractual interest (this is you charging the bank for 'borrowing' your money)

 

It's up to you to decide what you actually want to claim back and what the implications are for you. Whatever you decide to claim, you must make sure you FULLY understand your claim & the arguments so you can 'fight' your claim if/when it goes to the courtroom.

 

It sounds like you've already started the process - have you done a prelim & LBA etc?? What schedule did you send? If you haven't followed this procedure, my advice would be to hold fire with your claim until you fully understand what to go for then basically start again. The best way I found was to spend a few weeks (yes weeks!) reading the forums for folk with similar claims to me & to familiarise myself fully with the process & the likely moves/tactics/replies etc from the bank. It sure does build your confidence in what you are doing when you read someone else doing the same & winning!

 

Once you decide which way to go come back & one of us will be more than happy if you need further assistance with your spreadsheet :)

 

A good idea also is to start your own thread in the relevant section to track your progress with your claim & to post any Q's you may have then folk can answer on there. GOOD LUCK & Hope I've helped ... :)

Should the bank pay out on LBA would the contractual interest still stand ? or would u only be able to request this on court claim. Hope my question is clear I have looked around the site but could nt find the answer.

hi tumble ... you claim contractual interest from the outset so if the bank pay up without it (regardless of when they do this) then they haven't settled your claim in full ... it's up to you at that point if you decide to accept the offer in F&F settlement or not.

 

If it goes to court then you can't claim the 8% statutory on top of this .. it's contractual only.

Claiming it is interest they are charging the bank for "borrowing their money".

To do this, would you just charge them what they have charged you? ie. what the spreadsheet says they charged you, fairness and mutuality malarky I think I heard it referred to as.

Hi there ... that's the contractual interest! Compounded is just the way the interest is applied & there are various rates being used ... authorised/unauthorised rates etc & yes it's on the basis of 'mutuality & reciprocity' basically what's good for the goose ....

Hmmm seems I have my wires crossed, I thought contractual is the rate at which they have been charging you rather than the 8% stat rate

 

Little crossed me thinks although you're right in what your saying about the rate .... you can claim back.....

 

the charges only

 

OR the charges + the interest they've charged you on your charges + contractual interest

 

OR charges + interest they've charged you +8% statutory BUT ONLY IF/WHEN it goes to court ...

 

You can't claim statutory (8%) interest if you go for contractual ... it's one or the other although lots are now claiming cotractual then claiming 8% as an alternative for the judge to decide not the banks

Hi I am looking at doing a my spready for claiming bank charges.:D

 

The spreadsheet seems straightforward enough me thinks, however if I copy some info from my O/H bank statement perhaps one of you kind peeps could tell me exactly what date from the bank statement I should enter under DATE PENALTY APPLIED column. the reason I ask is because on the date column on the statement is the date it entered the account, however on the details of charge their is another date and am abit confused (and it doesnt take much to do that!):D

 

Date Details Withdrawn Paid in Balance

8 Aug 2002 BROUGHT FORWARD 278.85 OD

 

30 Aug Charges UNARRGD BORROW FEE

1 JUL - 4 AUG

£14.00 PER PERIOD 14.00

INTEREST

1 JUL - 4 AUG

 

 

-------------------------------------------------------------------

 

Now do 30 August for both cahrge and interest or 4 August:confused:

 

On later statements their is just one date as it changed.

 

example the charge came out the account 31 August. However on the statement it now says 30 JUL A/C XXXXXXXX 20.00

 

So again do I put 31 August or 30 July:confused:

Milly - the date that the charge was actually deducted from your account is the date you put in the spreadsheet. If, on the same line that the charge appears, your account balance drops by that amount, then that is the date the charge was actually deducted.

My assumption is then.....I put as in my example above, 30th August then as thats the day thay were actually debited from the account and not the 4th august as that was the period it applied to.

 

The same for the interest when I get to that column. :)

Yeah, that looks right to me, Milly. The actual date the money was deducted from your account is the date you were actually charged. The same goes for interest on the account, it's the day you were actually charged it, and not the day you were simply warned about it.
