I did not request the refund so will mention that in my letter as well.

    • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

You will need to print it out and send a copy each to the court and the bank. The court address should be on the Moneyclaim site - it's in Northampton I believe.

Hi,

Just to get sure I was understanding things right. I doubled check your spreadsheet with the interest calculator from Bank Action Group. When entering a £10 charge incurred on the 31/03/02, BAnk Action Group finds £2.64 interest whereas your spreadsheet find £2.90 (both calculators show the same numbers of days) It's no big deal but I thought you might want to know.

Sorry if this has been asked before but I cant see it anywhere. Apparantly it is important to use the correct spreadsheet depending on where you live. I`m in Scotland and the spreadsheet example is different from the google one, so which one do I use. Also the google one has a bit that says "DATE OF JUDGEMENT OR PAYMENT". Do I just leave this bit blank when filing my claim at the sherriff court.

Any advice would be great as I`m tearing my hair out. Thanks

Sorry if this has been stated before , but it has just occoured to me.

If when filling in the intrest side of spreadsheet and your account is in credit, you might be paid intrest on this, Howerver you should get far more intrest than you did due to the charges that were taken from you. Should we not look at a way to get this back also? I think it would definatly be agreable to a judge .But might be too complicated to work out , not impossible though

I am new to all this and have been reading as many posts as I can, but im even more confused now and probably very very thick!!!

 

Ok, I have clicked on the excel spreadsheet on the first page and got a sheet which was alrady filled in as a sample I assume. Should I be using this sheet or am I missing something and should be using something else? I have all my statements which I got successfully (hurrah, that bit wasnt so hard) and have entered all the o/d fees, excess o/d fees and DD recalls which comes to a tidy amount over the past 4 years. BUT, how do I calculate days since offence and am I supposed to add interest? I thought that was to be added only if it went to court?

 

Sorry for waffling, but I am getting confused now and starting to get a little frustrated.

Clare the days actually calculate automatically from the date you enter - have you overtyped the info on the spreadsheet or did you delete/clear the info first? You should always overtype as if you delete you will delete the formulas in the spreadsheet which calculates for you.

 

You only add the 8% stat interest to your claim when you go to court - depending which sheet you are using you may decide to claim upfromt the interest charged on the charges incurred. Lots of people (myself included) are also claiming Contractual interest too which is basically charging the bank for borrowing your money & charging at the rate they would have charged you ... it's your choice!

I have just attempted a different tach. I have made my own spredsheet and entered all my transactions, payments and re calculated the interest they should have charged, omiting the late payment and overlimit fees that they have charged. This has meant that I am now claiming interest from them for all the months I should have been in credit. It seems to me that it is only fair that I should be back into the position I would have been in, had they not aplied these unlawful charges, and if they can charge me 2.2% per month for being in debit then it's only fair that they should pay the same rate to me if they have collected to much money from me.

Why have you omitted these? You can claim those too! Also, there are spreadsheets in the Vampiress chambers that calculate contractual interest too - there is also a compounded version ..

am I right in saying, that if you claim the contractual interest, from the begining, when it comes to filing the mcol, you do NOT add the statutory interest too? its one or the other? you only add the 8% if you haven't already done the contractual interrest? Has anyone won with the contratual interest? My over limit interest rate is 29% that makes a big difference in interest compared to the 8% rate, infact over £1000.

What your doing is actually working with contractual interest rate.

It's one or the other I'm afraid. If you use contractual interest you cannot claim sec. 69 interest.

Thanks for that, when I sent my charges to Natwest first, I used the contractual interest rate, On Friday, I filled in my MCOL against them, but was scared to use the contractual rate, so changed to the sec. 69 interest, would it be too late for me to get intouch with the courts and have it changed?

If you filled in moneyclaim on friday (after 4pm) it wont be processed until monday morning at, I think 10am. I did something similar on one claim and phoned them up. If you phone before they issue it they will probably cancel the claim and refund (by cheque) the fee. You can then issue another claim using the contractual interest. Best thing now is phone them first thing monday and if it's not been issued ask about cancelling it.

 

Several people have claimed contractual interest and settled their cases now so I would go for that.

Will do thanks very much, it makes a big differnece to my claim!

 

It makes a huge difference, One claim I did was for about £900 in charges over 6 years and about £1500 in interest :)

 

I found the court at Northampton very helpfull when I phoned them about the claim I needed to cancel but you do have to phone before the time they stipulate on the MCOL site. In my case I actually totalled the claim wrongly (had a senile moment) and was claiming too much :rolleyes:

I am just about to send my claim to RBOS but am not sure what I should put as the date of service on the spreadsheet. I am using the excel simple Scotland one. Should I use the date the last charge was incurred (19/02/03), the date the account was closed (27/02/06) or the date I am sending the claim? Thanks

The date of service is usually the date the court paperwork is served on them, so use the date you send in the claim.

Sorry Chezt, you seem to have misunderstood my post. What I have done is to recalutate all of the statements as I believe they should have been done, without the late payment fees and overlimit fees, so that I can show exactly what interest I should have been charged without the guess work, and demonstrate to the company, and the courts that I am only seeking to be restored the the position I would have been in if they had not impossed these unlawful charges in the first place. Since this has led to me paying more money to them than I needed to, my account should have been in credit for much of the time, therefore I shall be claiming back interest at the rate they have charged me, ie 29%APR. I believe this is known as contractual interest. I started with VAMPIRESS'S spreedsheet but found the calculation of interest a bit arbitrary. Having said that the difference wasn't great, but mine was slightly better and, I think, easier to demonstrate the accuracy to the court.
