    • Hi I had to leave Dubai back in 2011, during the financial crisis. And only now have I received a letter from IDRWW. Is this anything to worry about about as I have 2 years left until it’s been 15 years(statute barred in Dubai). Worried as just got a mortgage 2 years ago. Could they force me in to bankruptcy? Red lots of different threads on here. And unsure what true and what isn’t.

    • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Any advice welcome.

 

Started this process on 12 October against HSBC filed MCOL 21 December after no response to 2 letters before action. Surprise, surprise, after this the letter about concluding their investigations arrived. Turned down an offer from Colin for £750 less than my claim of approx £2500 in mid January. DG filed a defence at the 11th hour and my AQ is due by 4pm Tue 6 Feb. Sent the info DG asked for by recorded delivery same day requested, which was signed for on 22 Jan. Keep trying to ring DG but continually getting an answerphone. The way things are going it looks like I will have to spend another £100 to file my AQ as no further offer received yet.

 

I just don't know what is going on when other people seem to be getting sorted fairly quickly. I am beginning to wonder if I will ever get my money back.

Know how you feel. But there does not appear to be reason why some get settled quicker than others. I have often wondered. Dont worry be patient.

 

Dont miss AQ deadline whatever happens.

 

Just keep on at DG fax phone email etc.

i told a mate of mine in work about my claim with barclays in november so he started his claim with hsbc in december and got a full settlement after sending off his LBA ,took about four weeks and they even paid interest which he never asked for.

mine is still ongoing 4 months later and i get some right stick in work.

bloody weird innit.

My AQ deadline is 4th Feb and I have already submitted it (taking no chances) There are lots of us at this stage at the moment so take heart you are not alone. I have heard DG have a backlog of 2-3 weeks, so things are taking a bit longer. :)

My AQ is due 6th Feb will be sending it special delivery tommorow unless of course I get an offer from DG this morning (and pigs might fly)

They told me last week that it will be 2-3 week looks like that delay will cost me and then them another £100
