    • Hi, I just wanted to update the post and ask some further advice  I sent the CCA and CPR request on the 14th May, to date I have had no reply to the CCA but I received a load of paperwork from the CPR request a few days ago. I need to file the defence today and from the information I have read the following seems to be what is required.  I would be grateful if some one could confirm suitability   Claim The claim is for the sum of £255.69 due by the Defendant under an agreement regulated by the Consumer Credit Act 1974 for a PayPal account with an account reference of xxxxxxxxxxxxxxxx)  The Defendant failed to maintain contractual payments required by the agreement and a Default Notice was served under s.87(1) of the Consumer Credit Act 1974 which has not been complied with. The debt was legally assigned to the claimant on 15-09-21, notice of which has been given to the defendant. The claim includes statutory interest under S.69 of the County Courts Act 1984 at a rate of 8% per annum from the date of assignment to the date of issue of these proceedings in the sum of £0.00. The Claimant claims the sum of £255.69   Defence  The Defendant contends that the particulars of claim are vague and generic in nature. The Defendant accordingly sets out its case below and relies on CPR r 16.5 (3) in relation to any particular allegation to which a specific response has not been made. 1. Paragraph 1 is noted. I have had financial dealings with PayPal  in the past but cannot recollect the account number referred to by the Claimant. 2. Paragraph 2 is denied. I am not aware of service of a Default Notice by the original creditor the Claimant refers to within its particulars of claim.  3. Paragraph 3 is noted. On the 14/5/2024 I requested information related to this claim by way of a Section 77 request, which was received and signed for by the claimant on 20/5/2024. As of today, the Claimant has failed to respond to this request, and therefore remains in default of the section 77 request and therefore unable to enforce any alleged agreement until its compliance. 4. Therefore it is denied with regards to the Defendant owing any monies to the Claimant, and the Claimant is put to strict proof to: (a) Show how the Defendant has entered into an agreement and: (b) Show the nature of the breach and evidence by way of a Default Notice Pursuant to s.87(1) of the Consumer Credit Act 1974. 5. Paypal (Europe) S.A.R.L is out of the juristriction of English Courts. 6. As per Civil Procedure 16.5 it is expected that the Claimant prove the allegation that the money is owed. 7. By reason of the facts and matters set out above, it is denied that the Claimant is entitled to the relief claimed, or any relief.
    • Thanks @dx100ukI followed the advice given on here... then it went very quiet!  The company was creditfix I think then transferred to Knightsbridge (or the other way around) The scammer independent advisor was Roger Wallis-having checked his LinkedIn profile just this morning, it does look like he's still scamming vulnerable people... I know I was stupid for taking his advice, but i do wonder how many others he has done this to over a longer period of time (it came as a  massive shock to him when our IVA suddenly failed). Lowell have our current address (and phone numbers if the rejected calls over the past couple of days is anything to go by!) No point trying the SB because of the correspondence in 2019? Thanks

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Just a little point on my changing opinion on certain aspects

 

I WAS a big believer in Nuclear energy, repeatedly stated here, but seeing updated stats (sanity checked as much as possible given Guv selected 'independent(NOT)' assessments)

I'm not any more. Nuclear is off my list until a better version with lower costs is available.

 

Wind solar and hydro with green hydrogen 'gas' stations seems to be clearly the optimal way forward.

 

Lots of reasons and sources, but the following (with all it faults and omissions) summarises a number of the core issues and with them a number of my reasons. Its breaking down what was long withheld Gov reports. I wasnt sure before, but I'm pretty well sure now. The Russian invasion of Ukraine and the energy fallout has pretty much cwashed away any of my 'maybes'

I am hearing quite a lot of discontent being built up with people fearing the coming months. Some are struggling financially now and think it will get worse for their families. And with Government out of action while they wait for a new PM, they don't have any confidence there will be help coming that would reduce the financial impact that will be suffered.

 

For business owners it must be incredibly difficult to plan at the moment, as they don't know what support the Government will be offering. Do they reduce number of hours the business is open for to save on energy usage ?  Perhaps a 4 day working week for offices to save on energy costs ?  Would Supermarkets cut back on hours of opening to save money ?  What would this mean for part-time staff relying on the hours they could work in the evenings ?

 

Don't believe Government have considered all aspects to the energy/cost of living crisis

Of course they have - they have made it quite clear that they consider BP profits 'a British success story

and 'no more windfall taxes as its 'unconservative'

 

I'm just waiting for the temporary bribe with our own money just before a general election, in their hope that enough plebs will be utterly stupid enough to vote for them based on it.

decisions decisions, is it greener to keep a 20 year old Audi A2  TDI running remembering I live in a rural location, or go for broke with a basic EV where the grid is dodgy in winter?

 

Think I'll give the EV a miss for now we have abysmal charging infrastructure, and an insecure grid with regular blackouts already when the wind blows hard.

I'm in a similar position although mine is a euro5 1.6 diesel since retirement (cat and DPF)

45+ mpg on very short runs, 75mpg + on longer runs

 

Walks through its emissions test every MOT.

This winter might be the breaking of the EV paradigm, friends who are using EV vans on delivery for DPD have Range Anxiety , as have a 30 mile each way trip to depot to pick up parcels, do their round then 30 mile each way to depot and home, they are screwed if they can't get a top up on round, and no charger's at depot either.  How things will pan out on a cold winter with a potential 50% drop in range due to low temperature is anyone's guess.

Which is a failure of infrastructure rollout to support the electric/hydrogen cell vehicles

Which rollout is now essential - as those transport businesses simply wont be able to compete with ever increasing fossil fuel cost

 

.. or do we wait until the saudis demand conversion to Islam to ensure future supplies?

- they are ALL (Russia, sauds, BP, Shell) already demanding tribute

- now aren't they?

 

And does the current situation not clearly, beyond any doubt, show that there is no fossil fuel security in the UK - even with 'british' energy companies and british fossil fuels ..

At least I know I can squeeze 80 ish mpg on a run and 60plus round town, EV usually around 2 - 3.5 miles per Kwh

Not if theres no diesel as its rationed and price trebles and quadruples

(next 10 years)

 

and theres no range anxiety with hydrogen fuel cells if the hydrogen infrastructure (which is needed anyway) is put in place. You just top up with hydrogen just like you do diesel

 

You cant fill up your tank with nuclear. let alone in 30 seconds  - even if you live next to sizewell - but you can hydrogen

You would be in same boat as me then at moment TJ, I see hydrogen as a valid alternative for future  it loses out to pure electric when it should be part of mainstream.

Hydrogen fuel cells would perhaps be a better compromise for many, perhaps all who travel fairish distances on a regular basis,

perhaps even a better solution overall full stop, although my jury is still out but leaning that way

- unless battery tech takes a massive leap forward from currently being materially  poisonous beasties

I dont think we will see much progress until the beast that is fossil fuel is beheaded

- its simply NOT in their interests

Ah but wheres the taxpayer funded and supported development of high profits on drilled/fracked oil, sold on the open market for the highest prices, with the profits going into tax havens which could be in Britain (but dont worry, you wont be allowed to know) in ten years time with that green renewable stuff?

Issue with fracking in the UK is that companies looking to do this would be taking a huge risk in spending money on exploration and then not knowing how much supply they will find.  And if there are many incidents of earth tremors and environmental damage, then the costs of compensation may exceed revenues. UK is totally different to US due to size of country and proximity between drilling sites and residential areas.

 

Is fracking really a viable option in the UK ?

I suspect it's less efficient than the green alternatives and it's short term once any gas that's down there runs out. After all, they're only resorting to cracking rocks because the easily available gas is at an end.

 

What isn't mentioned by the fans of fracking is that it involves huge amounts of water that we don't necessarily have [I don't know if the water is fit for use afterwards] and harmful chemicals are used in the process.

So @unclebulgaria67 tell us roughly how much did the frackers pay for the damage caused by the earthquakes which stopped fracking not so long ago?

 

and how much has been spent at taxpayer expense in the USA cleaning up abandoned fracking wells that no longer, or NEVER did  pay profits?

No, it isn't.

There is absolutely ZERO actually honestly defined benefits. Zero, nil, nada. Sweet F*** all

- except to a few investors benefiting from government subsidies via large salaries.

- Just look at the financial state of fracking businesses across the world - they make UK water companies look like environmentally green scions of efficiency.

All the claimed benefits are purely 'blown up' speculation on the high end possible total content, NOT on the amounts that realistically could be extracted,  which are commonly far less than a tenth projected amount at BEST, and at 2-3 times (minimum) the 'projected' costs

- even without any cleanup costs and just abandoning the wells - as evidenced by ALL prior fracking activities across the world.

 

 

Given the earthquakes from single wells, let alone any environmental and climate damage, does the UK taxpayer really want to fund 10's of thousands of fracking wells with associated earthquakes and poisoning?

Personally, I favour other forms of energy prodiuction.   Fracking would take took long and is too much of a risk for a small Island nation.

 

Surely tidal energy must be the way forward as an island in the north Atlantic and also more wind turbines.
