Wow, what an eye opener! I always suspected that the banks were ripping me off, but I was unsure whether there was anything I could do about it. I thought about threatening to change banks, but a) it probably wouldn't bother them and b) it was probably the same procedure across banks.

 

I am sending off my SAR letter today, with the £10, for 2 HSBC accounts (one of them closed now, but only 6 months ago), I suspect my claim will be quite significant (although probably under £5000) as I remember getting very irrate seeing 3 months in a row where I was losing £100 each month in charges, that is just not right!

Sounds like you're taking the correct steps. Don't forget to read up in the meantime on the next steps. Spiceskull had a big claim from HSBC that you may be interested in, especially if yours is just as large. They paid out to him, so be encouraged.

I had read through quite a bit of spiceskull's thread before starting, to see what I may come up against, very interesting, and I'll continue to read.

 

Also, I have just posted a reply on the General forum with regards to the thread 'Will it affect my credit rating???' as this is what I have heard as well, which worries me slightly.

Hi all,

 

I have sent off my DPA letter to HSBC, I then recieved an acknowledgement back a few days later saying that they don't keep records of charges alone, but they will be sending me my statements for the last 6 years, the statement have arrived but there are large chunks missing, i.e. I think I only have 2 months of 2001, none in 2000, quite a lot missing from 2003.

 

My questions are as follows

 

1) Should I wait a little longer to see if the rest come through?

 

2) Is this normal with HSBC?

 

3) Is this becuase maybe the months that I don't have, had no charges, if so, should I trust that or request the rest?

 

4) I have read elsewhere that you can get all 6 years on line at HSBC, is this true?

Don't trust them with anything!! They've lied to you about your charges for a start!! Perhaps best to wait a few more days. If by the end of the 40 days they still haven't turned up, you've got something else to bash 'em over the head with!! :D

28/07/06 - Prelim letter sent to HSBC for £3648

31/07/06 - Letter rec'd at HSBC

14/08/06 - LBA sent to HSBC

16/08/06 - LBA rec'd at HSBC

22/08/06 - Finally!! first reply from HSBC offering £2000

23/08/06 - Letter to HSBC declining offer, saying I want ALL my money!!

31/08/06 - MCOL filed for £4551.96, to be deemed served on 06/09/06

05/09/06 - HSBC Acknowledge claim

22/09/06 - DG Solicitors offer full amount in settlement, I accept!!

27/09/06 - Full amount paid into my acount

28/09/06 - Full amount taken out of my account!!!!!:mad:

29/09/06 - Cheque arrives, FOR SOMEBODY ELSE!! with all their account details in a letter adressed to me!!!

29/09/06 - HSBC refuse to pay money back into my account

It has only been a week and a half since I sent the DPA, so not too long, I think I will check on-line tonight to see if I can get them there, if not I think I will chase up on Monday and remind them they only have a few more weeks until I report them.

 

I think you are right, I won't trust them and will request ALL statements.

oh yes you can get them online if you've got online banking but if you only sent it a week and a half ago hen you probably will get them in stages until the 40 days are over its a stalling tactic they use

Well, I got mine within about 3 weeks and they all came over about three days in about 50 envelopes, lol. They didn't send my credit card ones though, so I sent them the DPA LBA giving them 7 days to send or i'd take them to court!! haha

 

got my credit card statements within 5 days, hehe

 

im gonna send another dpa lba now though because thye didnt send the manual interventions, which i now need as evidence for another complaint i need to make against them. nothing to do with charges though!

Hi everyone,

 

I have just started (and a little way now) on my journey, just wanted to check if I am on the right lines and what I am to expect next.

 

Sent DPA letter and recieved statements, some missing but got those on-line so not too bothered.

 

Added up total in simple spreadsheet for 2 accounts (should have used the advanced one, but too be honest I really didn't have the time).

 

Just sent my PRELIM letter to HSBC (local branch, I think I read somewhere that if it goes to court I will only have to attend my local court) for both my accounts as the total was under £5000 and I just edited the letters to show both my accounts on there. I also included a printout of both the accounts simple spreadsheet, minus the 8% interest column.

 

I guess I am just wondering if that is all ok, and what I am likely to recieve next, I assume I'll recieve a standard latter saying that I am not allowed to claim this, is that right?

Hi

 

When you file the claim you can either do it at your local county court, or on the MCOL website. If you file online then Northampton County Court will start the process then transfer the claim to your local county court.

I have just sent off my LBA after recieveing only a standard letter back from HSBC which was along the lines of

 

'Hi I'm xxxx, and I will be investigating your case here is your reference number, etc, etc'

 

no date, not even the year in which they would get back to me after investigating.

 

I know they have had quite a few claims lately, but after reading numerous forums and the FAQ I still took this as a delay tactic, has anyone else had these sort of letters and did they wait or are they still waiting. I'm not sure if I should have given them a bit more time (I had given them the stated 14 days in the PRELIM and an extra 7 days).

 

I Just edited the LBA in that instead of stating that they hadn't responded to my PRELIM, I changed it to read that they hadn't responded in a satisfactory manner to my PRELIM.

 

Has anyone else got any comments?

Yes - unless they send you money, or an agreement to send you money, stick to your timetable, and the letters as they appear in the library - ignore everything else that the bank says to you. It is your claim, do not let them take control of the process...and have some fun as well :)

I have prepared my MCOL in readiness for a non reply from HSBC, I am claiming from 2 accounts, but only claiming charges not overdraft interest, so I have edited the MCOL to show all of this, can someone just have a quick glance to make sure I haven't forgotten anything. Total 1,076 characters and 14 lines, I heven't filled in the 8% interest yet as this is done from the date you fill in the MCOL (I think?)

 

1. The Claimant has accounts xxxxxxxx and xxxxxxxx with the Defendant, opened January 1996 and March 2001 respectively 2. Since 05/01/01 on account xxxxxxxx and 13/09/02 on account xxxxxxxx the Defendant debited charges in respect of purported breaches of contract. 3. Defendant is aware of all details as a list of charges has already been supplied. Another copy will be sent. 4. Claimant contends: (a) The charges exceed the Defendant's losses caused by the breaches; (b) The Term permitting the Defendant to levy such charges is unenforceable under the Unfair Terms in Consumer Contracts Regulations 1999, Unfair Contract Terms Act 1977 and at Common Law. 5. Claimant claims: (a) return of the amounts debited of £1589, total of both accounts; (b) Interest per S.69 County Courts Act 1984 of 8% - £xxx, total of both accounts, continuing at 8% until judgment or settlement at a daily rate of £0.35; 6. Alternatively, if the charges are a fee for a service, then they must be reasonable under S.15 of the Supply of Goods and Services Act 1982. 7. Costs allowed by the Court.

Hi all,

 

Just to let you know, I received an offer from HSBC 4 days after sending them the LBA, the offer was £1,430 out of a claim for £1,500, so I think I am going to accept. Will make a donation after I have received the money in my account as I understand that not everyone is doing this, and if it wasn't for this site then most of these people wouldn't have had a chance to get thier money back.

 

I will also be startnig a claim against BarclayCard and will continue to try and help others when I get time, cheers everyone who helped!!!

I'm probably in the minority, but I'd hold out for the £70 too. They've been playing hardball with you for ages, now it's time to give it back - and it's your money! Plus if they don't cough up you can stick on interest and re-claim charges which will make it all the more satisfying.

 

But anyway, yeah, I say get every last penny, unless you're absolutely deperate for the money.
