      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

With my LloydsTSB bank account claim settled, I'm eager to start on both my credit cards now, Halifax & Cahoot.

 

I made a subject access requests to Halifax a few weeks back, and have today received my statements. Pressumably the two fee's claimable with credit cards are "overlimit fee's & late payment fee's"?

just a quick question, did you get all your info from your SAR in one lump?

I'm really perplexed as I got mine today but all I have is from 2003 - beg of 2006, just wondering whether to hassle for the rest of it they might come seperately?

My statements start from 2003 and continue till present. I estimate I am missing approximately 2 years worth (2001 - 2003). I have sent a non compliance letter and suggest you do the same.

Halifax are the only ones that cashed my £10 cheque so it's even more important I get all my statements from them.

 

I have sent my prelimary letter as I can adjust the amount right up until I file the claim. That gives them 28 days to forfill my request.

Have received a letter from the Halifax this morning.

 

It says that my account was opened on the 1st of April 2003. However I know it was opened before then.

 

I had reported my card lost/stolen once and I was given a new account number. I'm presuming that the statemetns they've sent relate to just my new account number and not my old one.

 

If this is true, I presume I would need to write to them again with the old account number (if I can find it) and send a seperate SAR? Aslo it would be 2 claims to start?

 

Has anyone else had experience of this?

Probably worth giving them a call. There should have been a name on the letter they sent to advise they were sending statements out, although there may not be a number. Try 01422 380880, the main switchboard at Trinity Road.

 

If you can find the old account roll number then ask them to provide details on that as well, pointing out the problem that caused the account to be changed.

 

Depending on the total, you could lump them together in your claim. Just keep the details seperate so they can also do the calculations.

Sorry for the lack of update....

 

I have today received (in response to my LBA) a letter saying...

 

"To demonstrate our commitment to you as a valued customer I have refunded your account with £565.00 which represents the total charges on the account."

 

Its the full amount I asked for, with no conditions attached and I didn't even start the MCOL.

 

RESULT!!!!!!!

 

Another donation on its way!

well i never had my account closed or my limit reviewed, but i cannot guarantee they won't. have a look at your card issuers sub catagory and see how they deal with their claims.

hi, just received credit card statements from the Halifax this morning, but only upto August 2006. I called them up and they said after 2006 they were only charging the £12.00 pound charge and would not be refunding those charges. Is that correct or can I claim for those aswell.

 

Also did you only ask for 8 % interest , as they have charged purchase interest and also cash advance interest and have shown the interest rate on the statements. Should I be asking for the 8% on top of those each month

 

I know I sound a bit thick, however I already claimed through my bank account and got full amount plus 8% and costs. Dont want to rock the boat but some of the purchas interest is as much as 15 a month.
