    • I understand what you mean. But consider that part of the problem, and the frustration of those trying to help, is the way that questions are asked without context and without straight facts. A lot of effort was wasted discussing as a consumer issue before it was mentioned that the property was BTL. I don't think we have your history with this property. Were you the freehold owner prior to this split? Did you buy the leasehold of one half? From a family member? How was that funded (earlier loan?). How long ago was it split? Have either of the leasehold halves changed hands since? I'm wondering if the split and the leashold/freehold arrangements were set up in a way that was OK when everyone was everyone was connected. But a way that makes the leasehold virtually unsaleable to an unrelated party.
    • quite honestly id email shiply CEO with that crime ref number and state you will be taking this to court, for the full sum of your losses, if it is not resolved ASAP. should that be necessary then i WILL be naming Shiply as the defendant. this can be avoided should the information upon whom the courier was and their current new company contact details, as the present is simply LONDON VIRTUAL OFFICES  is a company registered there and there's a bunch of other invisible companies so clearly just a mail address

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

That Tiverton and Honiton result with the lib-dems turning a massive Con majority into lib-Dem majority is EPIC

(need to check the figures)

 

No leader of a party that lost 2 MPs to that sort of sleaze, let alone lost a safe seat w would do anything other than resign .. but we know Johnson the corrupt liar has not even a minuscule shred of morals or honor.

 

Lots more stuff coming out about getting his latest trollup well paid positions, including highly paid 'positions' with charities .. and dont doubt it was him leveraging others to do it.

 

The Lib Dems gleefully pointed out that the 24,239 Conservative majority in Tiverton and Honiton was bigger than the combined majorities of the 26 most marginal Conservative seats at the last election.

 

Isnt Johnson in Rwanda at the moment? He should stay there.

Sunday Telegraph reporting that Government looking to apply tariffs on steel imports to the UK.

 

This is apparently the issue the independent advisor on Ministerial code of conduct quit,  because applying the tarrifs would break international law and agreements signed up to.

 

Move seen as being popular with brexit voters, particularly those in red wall seats.

 

I thought Government were in favour of free trade without barriers and wanting businesses to be operating in a profitable way. Surely if the tariffs lead to higher costs, as the cheaper steel is no longer as good an option, it means companies making items out of steel will have to increase price of their goods  therefore they would be less competitive in the UK and abroad ?

It isn't joined up thinking, is it? Sounds a bit desperate to me.

 

Worse, Johnson told Beth Rigby of Sky that he'll coast through the next election and is making plans for a third term, taking his reign to the mid-2030s. If I were a Tory rebel, I'd be looking to get him out before he can run in another election.

I was idly wondering about two things earlier.

 

If the UK is going to have the lowest growth in the G7, how long is it before we don't qualify to be in the group any more?

 

And the other thing might seem far-fetched but could have happened in the US after their last election. What if Johnson is voted out as party leader but refuses to leave no10? Who would/could remove him?

He might be a Trespasser within the meaning of the Police and Crime Bill, so can be dragged off to jail as if was a Traveller in a layby.  Of course they wouldn't do that no matter how sorely tempted one of those Police Officer's was.

The officers on the ground might have been sorely tempted, but there seems to be amble evidence that the senior officers at the met are in Johnsons (via his supporters promoters) pockets ..

... unlikely to be the other way around although those 'seniors' are undoubtedly 'in the same club' as it were.
