    • Often with the Likes of Lowells/ Overdales that 'proof' doesn't stand up to scrutiny.   Think about it like a game of poker, they want to intimidate you into folding and giving up as soon as possible, and just get you to pay up and roll over, that is their business model, make you think your cards are rubbish. What they don't expect, and their business isn't set up for it, is for a defendant to find this place and to learn that they have an amazing set of cards to play. Overdales don't have an infinite number of lawyers, paralegals etc, and the time / money to spend on expensive court cases, that they are highly likely to lose, hence how hard they will try to get you to roll over.  Even to the extent of faking documents, which they need to do because the debts that they purchased were so cheap, in the first place. Nevertheless it works in most cases, most people chicken out, when they are so close to winning, and a holding defence is like slowly showing Overdales your first card, and a marker of intention that this could get tricky for them. In fact it may be,  although by no means guaranteed that it won't even go any further than that.  Even if it does, what they send you back will almost certainly have more holes than Swiss Cheese, and if with the help you receive here, you can identify those weaknesses and get the whole thing tossed in the bin.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

The huge thing with the covid infected rats in our sewers is mutations, and that due to UK water companies, their faeces are illegally flowing into our waterways along with our own,

 

Thats thanks to completely ineffectively managed and regulated water companies whose primary focus is profits and senior 'management' bonuses, which of course mean 'spend as little as possible on infrastructure to maximise profit

Went to chemist to pick up my wife's prescription, was a guy an elderly farmer it turned out' in the queue he was coughing people were moving away from him at warp 9, he was apologising profusely explaining he had 2 pfizer, but had clots on his lungs after his moderna booster. Said GP reckoned it was the mixing of jab that did it, hopefully he is OK.  He's only one I have seen mentioning anything beyond mild effects after a jab.

We could do with some help from you.

It is possible, if highly unlikely, and if the vaccine did cause it

(I also had the moderna booster but after 2 AZ which along with JJ was the jabs which were reported as having the highest incidence)

- then its VERY liikely the old boy wouild have had far more serious effects from a bout of Covid.

 

The great issue is inflammation, with the extreme being a cytokine storm. Covid itself of course causes inflammation.

So if the jab caused inflammation, then Covid itself almost certainly would have caused the same or more likely FAR worse.

 

I've long said I thought more jabs with smaller doses of vaccine seems to be the best way health wise, but actually getting people jabbed likely defines higher doses as more 'real world' effective

 

 

That Johnsons antics right at the start with the attempt at the great personal medical data ripoff tied in with the app, and the well dodgy claims re the AZ vaccine started the UK ball of on the wrong foot, which gave the conspiracy nuts some real fuel for their gaslight fires

Oh and regarding people coughing and sneezing in supermarkets - I had a maskless one do that next to me

- I told them to F*** off to a reasonable distance and get a mask on

 

They said 'I've go asthma

I said, like f*** you have and if you had, you'd be wearing a mask as covid would almost certainly kill you - now take your sneezes away from me you selfish Piers Morgan

 

I have 2 friends with quite severe asthma one has had had the injections and they changed his life, the other is now looking at getting them. Both wear masks conscientiously for their and others benefit.

 

- my O/H has mild asthma and only occasionally needs an inhaler when certain pollen is around.

Just a little more detail challenging the points of the current whining of the Oxford professor that 'unjust' criticism of the AZ vaccine may have caused thousands of deaths.

 

1. The app was intended as a public medical data grab and sell

- complete lack of honesty and professionalism

 

2. The vaccine was 'authorised' on a handful of test subjects, with the results blatantly over sold. They were OK, but trust was again breached

- complete lack of honesty and professionalism

 

3. The UK crapped on the EU, where half was manufactured and tried to keep it all for themselves apart from an attempt to sneak some manufactured in the EU to Australia - to try to convince them to give Boris a good trade deal - the EU crapped back on the UK as it had little to gain and much to lose using a vaccine controlled by a demonstrated enemy, and Australia crapped on Truss and Johnson over the trade deal

- complete lack of honesty and professionalism - and common and business sense

 

4. The UK then decided to use India, one of its alleged brexit pals to mass produce the vaccine - who in true Brexiter fashion - decided to keep the vaccine for themselves

 

5. Then the clotting issue - which just piled doubt on doubt, just as Johnsons government did.

 

6. The AZ test data NEVER has met the USA's requirements.

Meanwhile, Peston says he hasn't found anyone from the SAGE and Nervtag who thinks there was scientific advice to stop self-isolation for people testing positive. The consensus is that it's political, to keep Tory backbenchers happy.

Just my thoughts on the origins of sars cov-2

 

Although cov2 is not found as is in bats (Horseshoe bats) ALL the components that make cov2 from other cov variants have been found in horseshoe bats

 

There is NO clarity on how it passed to humans.

Theories are via: Pangolins,snakes, civit cats, and other felines ... (often declared due to aspects of the genetics of the virus)  but there is no certainty as yet.

Some think its direct via the horseshoe bat being eaten as delicacy - as it is in the regions where it broke out, but the genetics seem to declare otherwise from what I understand. More than happy to be corrected.

 

Understanding that horseshoe bats are NOT vampire bats, and largely eat insects .. so they aren't landing on animals and biting them as far as I am aware .. (happy to be corrected)

... there seems to me to be two things to be considered

 

1. Bat feces are collected used as fertilizer in many regions - bringing the bat feces into contact not only with humans, but animals roaming around the fields where that bat guano is used

 

2. Bat Fleas, which do bite.

Hopefully the Governments risky strategy will work and Covid will remain a mild virus for most.

 

But there has been information in the media about new variants which are under investigation and also worrying increase in deaths in Israel, where they had similar vaccination rates as UK.

 

When I speak to people who are against vaccination and for dealing with Covid similar to flu/colds, they believe number of Covid daily deaths is likely to be people old or with health conditions where they would have died anyway from say getting flu. 

 

And I am hearing some health experts saying UK close to herd immunity.  But immunity against what exactly?  Is this against all forms of Coronavirus ?

I have heard a few health experts talk about immunity, Covid infection versus vaccination.  The consensus, is that they don't really know for sure.  Most say you are best to have had vaccinations, as they should prevent serious illness for about 6 months. And having Covid may also provide protection, but mostly upper respiratory system and not so much if Covid re-infection manages to penetrate further.

The i newspaper thinks the number of covid cases is being under-reported. I think one of the Sage/Indie Sage statisticians said numbers were likely to be higher than government figures as well.

Just had a surprising incident

 

Coming out of Aldi this morning, two older women (65+ or really let things go) chatting right against and between the entrance and exit doors with masks (literally)  over their chins

 

One was saying as I went past a foot away (no choice other than ask them to move):

are you ill?

other - no just test positive

 

.. and they toddled into the store with masks over their chins ..

... and given that almost all the ALDI staff have not been wearing masks for many weeks claiming exemptions

Interesting this for a number of reasons, especially the report that vaccinations AFTER having Covid and while suffering from long covid, improves the condtion of long covid sufferers

.. I have not done ANY checks on this report, but if true and not a placebo effect, then it perhaps opens the door for a new understanding of the interactions
