    • Yep let us have a good laugh eh from today’s Telegraph 🤣😂🤣 the rest must try harder    Farage won Friday’s election debate, a poll finds Nigel Farage won Friday night’s seven-way BBC election debate, according to a poll.  A snap poll of 1,031 voters by More in Common found most thought Mr Farage won the debate, followed by Angela Rayner. Mr Farage received 25 per cent of the vote while Ms Rayner received 19 per cent. The Green Party’s Carla Denyer was the third most popular with 11 per cent, Stephen Flynn for SNP received 10 per cent and Penny Mordaunt, the leader of the House of Commons, took 7 per cent of the vote. Daisy Cooper, the deputy leader of the Liberal Democrats and Plaid Cymru’s Rhun ap Iorwerth took 5 per cent and 2  per cent respectively. The debate saw Britain’s main seven political parties clash ahead of the general election on July 4.  Mr Farage, who returned to frontline politics for Reform this week and is standing as an MP in Clacton, challenged his political rivals on immigration and net zero policies.
    • Hi CAG Team, I'm seeking your skills and help for a NtK my partner received through the post earlier this week. To give a little backstory, my partner and I, along with our young children (4 and 7), decided to go on a camping holiday about 3 hours away from us. We took a car each because we didn't have enough room in one car. We arrived at the services at very similar times as we followed each other the whole way. So, two cars. My partner has received this NtK, but I haven't. This NtK dropped through the front door on Wednesday, June 5, 2024.  We both parked in the Burger King car park, not in BP; we got out, all went for a toilet break, got some food from the BP garage and returned to our cars to eat.  After eating, we took the kids to the toilet again before leaving to complete our journey. I didn't notice any parking restriction signs and can't get back to the location due to how far away it is. I noticed another person had an issue here and reported it to you, and they managed to get the charge dropped. See below. To me, it looks like they have cameras at the complex's entrance and exit. I'm not sure if they own the land/car park by Burger King, I'm not sure if this is a legal contract or not.  I find that 30 mins limit at a Services that serves hot food to be ridiculous and unfair, especially as we had kids to feed and water.  And the fact that I didn't receive the same NtK despite us driving in and out together is just crazy. This is the location - I also uploaded a map image.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

to some extent, i agree with you about the layout - always thought it was because my computer skill are almost non existant. but put the step by steps on your farourites, then you can jump back and forth to them as needed. i thought i sounded a little harsh earlier - hope you didn't take offense - just want you and everyone else to get what is owed them.

i guess maybe that's why it is a self-help site - you do have to do the majority yourself - i think there are plenty who have taken this info and gone into business for themselves - they do it all and then take a portion of your money - same as the bank, really. so self help means you do it and it is your responsibility and your reward! good claiming (14 days after your lba is sent).

we are a tetchy bunch around here aren't we. it's hard for me - a real technophobe to gauge emotion on printed words. thus, we do sound harsh sometimes - not meaning to. but it is so frustrating when the new people just think it's waltz in here and someone will find it all and do it all for them or they think it's going to be simple to get a lot of money back - it's not simple (relatively straighforward but not simple if you aren't used to this stuff -computers and law stuff). and they think it's going to be quick. it isn't that either. but, as you've found out, when you read the faqs, follow the steps it becomes clearer and then use us all as reference for specific questions and support - that's where we shine!

so, beresd, you are doing fine. keep at it and babs and i won't shout at you any more! lol. btw, she's a teacher and i'm a very old playgroup leader, so we are used to shouting, too much, i think!

beresd, now that you have submitted your MCOL, the court will now send the claim to HSBC and send you a 'Notice of Issue'.

 

The 'Notice of Issue' letter will show the date the Bank is deemed to have received your claim.

 

Count 14 days from the date that HSBC is deemed to have received the claim. If HSBC have not sent in 'Acknowledgement of service' to the court by that date, you can progress to Judgment by Default.

Sorry to clog things up with another thread, but this site is pretty confusing, I have spent the past 90 mins searching FAQs and not come across anything that may alay my discombobulation...

 

Yesterday, according to the time line and step by step guide written on the site (14 days after LBA, 6 weeks since I sent my prelim letter), was the day I could submit my MCOL, but as I hadn't heard anything from the bank itself, I asked on here if this was normal, I was told to 'be patient', so what is it!? Follow the instructions on this website or wait?! but if I wait...what am I waiting for!?

 

I did get a letter from some geezer at HSBC this morning saying 'we will look into this, here is a leaflet', so how long do I wait before I do actually put my claim in?!

 

sorry to sound so bloody stupid guys, I look foward to being someone who can actually advise other newbies one day

Ok submit your claim you have given them time to respond. The reason we wait is so that we can say we ahve been reasonable in trying to settle the action before going to court. If they choose not to respond or fob you off then sod them.

so, are you doing on-line with mcol? are you ok with it - it's pretty straightforward - the only dodgy bit being trying to fit your particulars into the limited space - there is a template to use in the library and also, i'd be glad to send a copy of my partics. just for comparison. it is do-able - just keep at it. yes, go ahead and file - you've given them long enough.

OK, after gettinga rubbish response from the 'quality team' I rang them up to enquire how they were doing, they said to me they only recieved the bank submitted LBA on the 28th even though I submitted on the 19th AND have a recipet for posting from the same day, yet they havnt actually got that on file the idiots.

 

The woman just said they have 8 weeks to look into it, so I submitted my claim while she whitered on, fingers cross, I feel I may be the one they cite 'incompetence' as many people on here will concur with :oops:

you'll be notified of the service by post shortly,

then the acknowledgment. when it arrives - send 3 copies of your breakdown to the court referencing your claim number and 1 copy to dg - address on pg 2 of the ackn. then you wait......

Afternoon guys (cough, I am ill :()

 

So, I got a letter from HSBC this morning! my total claim is now (inc interest and costs) £2800, but they have offered me 1926, but also say they are prepared to go to court as they 'believe we would successfully resist any legal challenge in relation to fees.'

 

Obviously I would like the full wack, so do I just write back and say thanks but no thanks?

this is what I am ready to send them, it is sans court proceedure info mind you, is it important?

I respectfully decline your offer of £1926.00 as settlement and request, once again that you return to me all charges imposed on this account, interest and court fees now totaling £2703.86.

 

I will accept the sum offered only as part settlement and on the clear understanding that I will pursue recovery of the remainder.

 

I will be willing to withdraw my claim upon receipt of unconditional full settlement of my claim. Please see the schedule of claim for charges attached.

 

I trust this clarifies my position.
