Hi guys,

 

I am about to print off my STAGE 1 letter, and the wording says 'banking history' but everyone talks about the previous 6 years.

 

Can this action only go back 6 years under the Data Protection Act?

Hi,

 

28 statement envelopes arrived this avo, from Oct 2000 until Dec 02, I may be a bit premature (wouldn't be the first time) but can I expect the rest (Until Nov 06) in tomorrows post or are HSBC pulling a swifty,

 

also, I have Dec 2001 to Dec 2002 duplicated...does this happen often or do I have to chase them up for the missing years?

Yeah, I would expect them in the next couple of days. The always send them out in batches. Just to annoy!!

 

They seem to be duplicating a lot of them too. Wasting a few more trees!

I am currently receiving mine in batches.

27th October: Data Protection Act 1998 Subject Access Request

8th November: Letter received from HSBC - Statements to follow

9th November: Bank statements arrive

12th January: Preliminary Approach for Repayment

22nd January: Letter received from HSBC - they will be looking into matters raised

30th January: Letter Before Action sent

24th February: Letter received from HSBC (dated 6th February) offering £240

28th February: Claim issued via Money Claim Online for £326.28 (including 8% interest)

1st March: Letter to HSBC declining offer

5th March: Notice that Acknowledgement of Service has been filed

29th March: Notice of Transfer of Proceedings

25th April: Notice of Allocation to the Small Claims Track

15th June: Court Bundle sent to Court

25th June: Offer received from DG Sols.

Hi guys,

 

Just going through the 52 (300 plus pages!) envelopes of statements,

 

now, I was under the impression I could only charge back for returned charges, going over my overdraft limit and such like but on writing out my prelim approach letter, it has a space for the overdraft interest they have charged me over the years for this (around 15 quid per month), but I have ignored this as I thought I couldnt claim the interest back as well...

 

can someone clear this up for me?!

There are 2 instances of interest you can claim:

 

1.When you go overdrawn the bank will charge you interest, perfectly lawfully.

 

However, if part of your overdraft is made up of penalty fees, they are also charging you interest on these too and it is this interest which you are entitled to claim back, but it's tricky to separate out from the total interest figure.

 

Vampiress has a spreadsheet, (the advanced one), in the bank templates library, which attempts to calculate this

 

It's quite complex and unless your claim is large may not amount to that much, so for simplicity's sake, some people don't bother

 

This is the interest referred to in the preliminary and LBA letters.

 

2. Section 69 8% interest on your claim, but only when you submit a claim at court. Don't add this interest before moneyclaim

Thanks Michael, aye, it seems pretty complex sifting through what the interest would be on the charges that go over my OD limit, so I will pass for now so I can get my prelim letter posted!

Hi guys, ok, my 28 days is up on Monday, and as yet, I have not heard a thing from HSBC, getting a bit worried...

 

It would help if there was an actual person or title included in step by step instructions, I just sent mine to 'HSBC, po Box 230, 8 Canada Sq' and I am worried that wasn't enough and it has now been 'lost in the post'

Hiya Beresd,

it won't make a jot of difference..I used the details EXACTLY as in the help here and got a full offer today, after they had entered a defence at the end of the 28 days. Have a look at my thread, I've been just as worried and annoyed about the lack of communication but it will happen.....be patient and follow the steps!

Prelim sent to HSBC 10/10/2006 for £5035

no response :x

LBA sent 24/10/2006

no response :x

MCOL filed 10/11/2006 :eek:

MCOL issued 13/10/2006

HSBC acknowledged MCOL 17/11/2006

HSBC entered defence + case transferred 12/12/06 :mad:

Ok, so who ever said just send it to HSBC was wrong!

 

I went into the bank on Thursday to asky why I hadn't heard anything, and the bloke had a lok at my details, the letter was recieved and scanned onto the system, but as it was just to 'HSBC, 8 Canada Sq' it was ignored, my adivce is to take it to a branch and hand it over.

 

The bloke said he would fax it over and someone should be in contact, bt the 28 days is up on monday, so i shall be submitting my second letter including the 8%.

the second letter does not include 8% interest. please read the faqs and if you want a result - stick to the plan.

99.9% of the letters have been ignored, not because they were sent to any particular address. it really doesn't matter who you send it to - it will get where it needs to go - if you have waited 28 from the prelim and are now thinking of adding 8% to the lba - i think you need to go back and reread the step by steps and the faqs. i'm sorry to be so blunt - but if you don't follow the steps precisely - how can they possibly work. write back if you have specific questions after reading the info.

should you choose to hand deliver anything - also acceptable - please get a written receipt to add to your paperwork further down the line - should it be required.
