      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Could you be tempted to spend some.

 

Lose your battle between the Devil telling you to get stuck in and go for it.

Or the angel of reason telling you to go into the bank and say i think you have made a slight mistake.:!:

As you read this story and perhaps watch the video what is your brain telling you.

Would you be planning to lash out,travel the world,take a chance.

Where would you go or do,could you be tempted.

No problem.

 

I once has £40k put in my account in error and i told the Bank. I asked for the interest and they refused. They did not even offer me a reward for advising them quickly.

We could do with some help from you.

Thanks unclebulgaria67,i had you down as a honest man.

You should have received a thankyou letter with a few pounds.So inflexible the Banks.

Could have helped so many during the payday loan fiasco if offered small local loans but collected much on the back of the problem,if you ask me that is,not everyone will agree ,fair enough.

 

I have to admit the devil i feel would win me over.Perhaps not as i am older now.

See already i am confused.Devil and the angel of reason having a right go in my head.

I think it is the thought of free bed and breakfast at the prison that would stop me.

But if young,well i do not know.

 

I have no time for the Banks.Ripped so many off over the years.And probably still are.

If you have nothing ,you will not pass the gatekeepers.

If you come into a few pounds come into the managers office,have a coffee,let us see how we can invest your money.

I've seen a company allowed to keep 50k and it wasn't theirs to keep. I said write to them, apologise and tell customer it's an error and the account ls being debited. The error was found the next day so good to put right asap. The stance was not to rectify as you couldn't debit an account without customer permission. They rang customer who wanted proof it wasn't theirs to keep. The proof should have been on customer to prove it's theirs. Customer removed cash within a month which I warned them of and not drag their feet

I would pay a dodgy banker a million to let me know how to transffer the 4.6 to an untouchable account somewhere warm, then go to Heathrow and catch the first plane business class to heaven.

Sod the credit rating and bankruptcy.

I wouldn't even mind them taking my house 😊

hmmm...

 

i would use a magnetic strip writer to clone my own card.

 

i would then post that to a friend overseas and get then to withdraw as much of it as possible

 

give them a million or so for the trouble and get them to send the remainder to another account of mine

 

i would then report it as fraudulent withdraws and point out i couldn't have been abroad as i dont have a passport, then pointed out that it was the banks fault for mistakenly giving me a huge overdraft and making it tempting to theives, i would also point out that as i can prove i've not been abroad i cant be held liable for a cloned card...

I would have assumed that they were giving me similar bonuses to the RBS top executives

- as my bank account is at least in credit.
