    • Hello, firstly thank you for reading this. I know no one wants a long winded back story. So I’ll be breif. I entered a local store to buy some paint (which I did pay for) I am honestly not a bad person or a theif.   Didn’t have a basket or trolly as was on my lunch break. Whilst picking up the three tubs of paint placed some masking tape in my pocket (it was hanging out of so I had every intention to pay) just didn’t have a hand free. Paid for my goods (forgot about the £4.39 masking tape) I’ve got so much going on and im not well at all (like I say no one cares I get that) also have autism so wasn’t thinking particularly like others do maybe (who knows my minds going around and around) I left the store after paying, was pulled back in by security. Asked for the tape which I gave immediately  shook up. Gave them my ID and details. I was given some paper and told to expect a large fine in the post for their time and the tape and sent on my way. my questions are: I hardly ever go out without support so the ban I guess I can’t go there now for anything (their loss) - ok but is my photo going to be all over with my name? how much am I expecting in the post as a fine? I have sent them cash in the post recorded signed for delivery to arrive tomorrow (incident happened today) for my error. Their Address was on the bit of paper. i have read two posts on this page but they were from many many years ago so I hoped for updated advise please?

    • utter BS, doesn't matter you signed it. pers i'd be writing as per the other threads here rejecting the car as not as described under CRA etc and be done with it. as its a debit card you could also do a full chargeback within 120 days to your bank and simply dump the car back to BMW. 100's of like threads to read here. get your ducks inline. make sure you know what you are doing and off you go. dont take any BS from BMW, no matter what you sign it does NOT remove your consumer rights. p'haps it might be on the off chance you are a good manager , a quick phonecall tomorrow saying you dont want it because (no bla bla fitted) it might be resolved in 5 mins..i will guess to date you not tried

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

I have foolishly swapped items with wrong receipts at various tk Max's.

 

i have neen away & the police have been twice & left a note saying to ring them .

 

i just am too scared and have not done that .

 

help & advice me as to what I should do as I don't want police turning up again .

 

please answer ASAP as this has been going on since March.

Why what and how and so on!

 

Also how did the Police become involved, have you been caught before doing this,

I'm afraid that the best thing you can do is to go and see the police voluntarily and put all your cards on the table.

 

You may want to get a sister to help you before you do this and go with the system.

 

It is highly likely that they will be a prosecution that if you act voluntarily and completely openly about everything, then your cooperation will be recognised and will carry a great deal of weight when it comes to any sentencing decision.

Hi and welcome to CAG. My apologies to the site team already on this thread (too many cooks etc.) but we need clarity.

 

From what little you gave us, you swapped price tickets. Was this to get a cheaper price or to get a bigger refund. Either way, it is fraud. Have you done it before? If yes, how many times.

 

Were you stopped by store security?

If yes, did the police attend?

 

You have two options. The first is to go to the police station. The second is when they arrive to arrest you. I would go for the first option.

 

You will be entitled to some legal assistance if you are going to be in a recorded interview. I advise that you accept help offered to protect your rights.

 

Until we know more of what has happened here, these answers are purely generic in nature and may change dependant on your responses.

I swapped price tags just to get rid of stuff I was not using .security stopped me & police were called & just gave the matter to rlp. Who wrote to me for one year & then stopped .after one yr I did the same thing foolishly & now the police have been to my house twice & have left notes for me to ring them up .i am devastated.

Best thing for you to do is to go to your local station, get a solicitor and tell them the truth. DOnt try to run or hide as it wont end well.

The Police will continue coming to where you live, until they take you to a station.

 

Suggest that you visit your nearest Police station and just say that Police officers had visited looking to speak to you. I would suggest that you say that you don't know what it is about and if they wish you to come back on a given day/time, you will do so. You should NOT say anything to admit a crime, unless advised to by a Solicitor. The Police station can arrange for a duty Solicitor, if you are to be questioned about an offence. It is always up to the Police to provide evidence of a criminal offence being committed and you should wait to see what evidence they have. If the Police have evidence from TKMax, then your Solicitor will advise you what to say.

Would you want to be arrested at your home, possibly handcuffed and transported to the police station in the back of a police car? Neither would I!

 

I would present myself at the desk at the police station. Burying your head isn't going to make this go away. The sooner you do it, the lesser the chance of them coming to your door again.

 

Dependant on your income, you may qualify for legal aid but (I think) you should get access to a duty solicitor who will advise you of where you stand. I wouldn't advise being interviewed without legal representation.

 

Before you go, try and work out why you made these poor choices. This is called mitigation and may sway what the police do. Do not say you made a mistake as you didn't. You had choices.

you are now back on the police radar having being caught out a second time. The first time they were happy just to gather intel and leave it at that but now they are going to investigate this and may well seek prosecution.

If you respond to their notice and ask to speak to the named officer and tell the truth you will make the enquiry a lot simpler for all concerned and there will be a greater liklihood that it will be treated as a single event with a lower level of tariff

Just go to them, and youll likely just recieve a slap on the wrist or a simple caution. If they have to get a warrant for your arrest, then the penalties are much greater.

I wrote sometime ago & said police came to my house twice regarding a tkmax fraud .

 

 

all the people said go to the police station

.i did ring the police station

the policeman said tk max security want me to pay £83 for the stuff that I swapped wrongly & finish the case .

 

 

he said come for an interview to the police station .

 

 

I went for the police station for the interview , & didn't think I need a solicitor

as I was just going to pay £83 to finish the matter .

 

 

i was honest & told him I shop in tkmax all the time & on few occasions I had swapped the wrong items .

the policeman was very polite & said this is the end of the matter & don't do it again .

 

today I got a letter from tkmax that they want to prosecute me .

 

 

i am shocked & gutted & think this was like a trap for me..what can I do now .please help .

Did you pay the money they were claiming?

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!

TKmaxx wouldnt have said that at all. I bet it was RLP or a similar company saying they are thinking about it if you dont pay them as well.

Are you able to post up a copy of the letter? Please make sure that you obscure all personal details and that includes reference numbers and barcodes.

 

Until we know exactly who the letter is from, we cannot advise accordingly.

I have not seen the letter yet as am away ,will let you know when I see the letter ,but it says tkmax want to prosecute me ,even though I went to the police station & paid what they wanted & according to me & the policeman the matter was closed.

TKmaxx cannot prosecute you nor can the police, it is the Crown Prosecution Service that does that and they do so having taken advice from the police, not TKmaxx or anyone else.

For you to be prosecuted you will have to be arrested and formally charged and then the file passed on to the CPS for consideration. It is a process that takes time and you will be formally made4 aware of what is going on at various stages.

The store can ask the police to reinvestigate but I really doubt they will if you have paid money as part of a local restitution scheme. TKmaxx will lose thier membership if they play games like that and then the police wont turn out when the shop catches another shoplifter.

Sounds like you have a letter from someone trying to scare you into paying more money when this is now all done and dusted. We will need to see who the letter is actually from and what it really says to advise whether to take it seriously or not.

one of them is from rlp demanding 149 pounds for some card fraud ,which I don't know what they are talking about !!!

 

 

And the other letter is from tjx Europe ,

banning me from the tkmax store.

 

 

this is after the police told me that the matter is closed.

 

 

what should I do .
