Legal Professional Privilege is this now under threat?

'Lawyers are under a legal and professional duty to keep their clients’ affairs confidential. But LPP is particularly important because it prevents a third party – including a state official – from gaining access to and making use of lawyer-client communications without the client’s knowledge and consent.'

 

In October 2015 the Law Society said this >>

The statutory protection of legally privileged communications between lawyers and their clients should be high on the agenda when parliament debates major new surveillance legislation next month. The Bar Council and the Law Society have called for legal professional privilege to receive statutory protection in the forthcoming Investigatory Powers Bill.'

Intelligence agencies must not be allowed to spy on communications between clients and their lawyers. When you are defending yourself against the state or find yourself in a dispute against a public authority, it would be grossly unfair for them to listen in on conversations with your lawyer.

 

'We have seen too many examples of prosecutions wrecked because it was found that a public authority had eaves-dropped on a conversation that should have remained private.

 

So are they only asking for exemption for those cases that involve the state or public authority ?

 

Surely legal privilege is just that and ALL conversations between a solicitor/ barrister etc, and their clients should not be eavesdropped ?

 

Having said that, aren't GP's now being forced to provide third parties with extremely confidential information?

Bulk interception of communications or retention of communications data is questionable in a democratic society, but if such powers are approved by parliament, there should be special provisions to protect privileged communications between lawyers and their clients.

 

Make it harder for government to do - start writing letters and talking face to face with people rather than electronically by email / telephone !

 

We have been slowly seeing our privacy and freedoms eroded by government (whichever breed is in power) for many years now and no one seems to speak out.
