Hi there,

I have a huge issue with this insurance,

my motorcycle was stolen from the college car park and Hastings direct claim that my insurance does not cover going to college.

 

I had this motorcycle for a few months, and when speaking to their representative Im sure they as you for the purpose of using your vehicle.

I mainly used it to get to and from work, as I cannot afford another car (mrs has one).

When I asked for explaination they said they will back to me, but never did.

 

I must also say that I have never received my policy booklet, nothing, so I didnt have chance to verify it.

 

At work my friends are saying that going to college isnt like work, its your pleasure, same like you going to watch football every week.

 

I didnt even use this motorcycle to go to college on regular basis, because of a huge traffic in the morning.

 

My other friend advised me to speak to my MP, a local newspaper, watch dogs, etc.

and all them saying its disgusting what Hastings Direct did to me.

 

If possible would anyone give me any tips what to do and do I have any chance fighting for my rights?

 

I feel completely disappointed with my insurance, really thinking I was naive to believe in honesty of this insurer who I did not change for past 3/4 years!

Do you work at the college or are you a student ?

 

Further to the above question.

 

Are the attendances at college connected to your job eg are they part of a training course to do with your employment and / or sponsored / paid for by your employer?

 

What does your Certificate of Insurance say is covered under the section of Use?

No relations at all to my working place. I decided to do the Level 3 course, that's about it.

 

I took a loan to pay for this course.

 

I have never received the certificate of insurance. Just forgotten to ask them for one. This was my first "bigger" bike, and was very excited about it.

Then it's not a place of work. Keep us updated to what happens with Hastings.

 

It's not, that's obvious, unfortunately they refered me to their booklet, which I have never received. So I cannot check on what ground they reject my claim.

Insurance is basically a contract between you and the Insurer with the Policy Booklet forming part of the Policy. Fortunately Insurance comes with the protection of the Ombudsman and also the Consumer Insurance Act https://www.abi.org.uk/Insurance-and-savings/Tools-and-resources/How-to-buy-insurance/What-the-Consumer-Insurance-Act-means-for-customers

 

It's unlikely the Policy Booklet will have the answer to why your claim is not being paid out, I have a feeling they're referring you to it because it will contain a requirement for you to advise them of any changes in your circumstances eg new job etc.

Hastings are not a great Insurer and them declining a valid claim is not unusual.

 

To enable us to provide accurate advise, we need you to post up the exact reason they give for declining your claim in the letter they have sent you rejecting your claim, please post this up so we can give you the correct advice.

 

Could you also advise us whether you a student at the time of taking out the cover or did this change part way through the Insurance

Hi,

 

From the letter I understood that Hastings direct are only broker, the letter came from AXA.

 

They reffering me to Page 21, where "General exceptions" are stated.

 

From the letter:

 

"1. This Policy does not apply when Your Motorcycle is being used for purposes that are not specified in Your Certificate of Insurance.

 

We decline your claim because commuting to a single place of work or study is not covered by the certificate of insurance".

 

 

For previous 3 years I was insured with Hastings Direct using CBT and car driving licence. Then they told me over the phone that I have to start a new policy with the new motorcycle when I passed my A category licence.

 

I started studying in 2014 part time, as I work full time, then in 2015 I have started another part time course, and still working full time.

So they're saying you do not have cover to ride the motorbike to and from a place of work or a place of study eg you're also not covered to ride to work

 

This is important, what does your Certificate of Insurance say you're covered for under Use?

 

What do your previous Certificates say you're covered for under Use?

 

Do you have a copy of the application / proposal form from when you applied for this policy?

They say its Social Domestic and Pleasure cover. As I mentioned before I haven't received any documents from the insurer.

 

 

Yes, I know I was silly to ignore this. Unless they sent it out to my email address and it went into junk mail, spam, etc.

How did you buy the cover eg over the phone or online?

 

Have you looked at your previous covers to see if commuting was included?

 

I phoned them up.

 

If I had any previous insurance documents I have thrown them away as soon as I sold my previous motorcycle.

Since your college course is part-time and unconnected to work, does it not count, as identified above as social/pleasure. It definitely isn't work related, so they cannot use that as their get out.

 

Hastings (Currently) have an explanation next to their Use Question along the lines of

 

Social, Domestic and Pleasure - Excluding driving to work or for work

 

Social, Domestic & Pleasure - Including driving to a single place of work or study
