    • sorry but that letter needs to be much much better. you need to express that it was a stilly youthful mistake trying to be the big man and jumping the turnstile to look big infront of your peers. TfL prosecutors are on the email address on their first letter. get the court form sent back to the court , (but copy it first) stating you plead guilty and wish to attend to address the judge in person face to face to show your genuine remorse for your stupid youthful exuberance.      
    • I thought I should send the begging letter to the prosecutor. Does the hearing means the time I need to send back by? I hope that I could teach the lovely students again, which may not be allowed with a criminal record. I would please ask that you would please provide me a single opportunity to settle all outstanding sums owed outside of court without the need for legal proceedings which would have a determinantal impact on my teaching career.  I sincerely apologise again for my crime.     • Utter Rubbish!! lowell dont write and beg for deals once they start court. as for your attitude, we'll thats nothing new for you.😎 you wont be quizzed, it's not like TV, simply refer to your defence/WS when answering anything the judge may ever ask. well it involves chickens. dx

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi guys,

 

I was referred here by a colleague because you were helpful to him.

 

I was living with a friend up until recently. He has moved to Australia (15th September he left). Since his departure we have received many letters from various companies, but I have no idea of their names. The envelopes are blank, with nothing but his name and a return PO Box address on them.

 

This morning we received a hand delivered letter, which is the calling card of debt collectors I am lead to believe. Again I don't know the company involved.

 

I have spoken to said housemate about this, and he said that he knows his debts and will telephone them to sort it out, but I have little faith in this.

 

Obviously I do not wish to have debt collectors knocking at our door demanding money/goods/whatever, and I am wondering the best course of action.

Hi and welcome to CAG

 

As these are not your debts, if s debt collector did turn up, you could give them your flatmates new address and let them worry about it.

 

It does concern me that letters are arriving with no return address on them. Official letters need to have something on them for returned mail, even just a simple address on the back flap of the envelope.

 

With any debt collector, you can tell them to go away and they must. they have no power at all.

If you are asked to deal with any matter via private message, PLEASE report it.

As he has left you in it, the friendship seems a little one way, in that case, if you know his address in Oz, pass that on to the dca's.

 

Tell me about it. It's been... interesting. I will try to get his address. Thank you for the advice, having never dealt with anything like this I was unsure.

 

It does concern me that letters are arriving with no return address on them. Official letters need to have something on them for returned mail, even just a simple address on the back flap of the envelope.

 

There is a POBox address, but no company name.

 

With any debt collector, you can tell them to go away and they must. they have no power at all.

 

I had no idea of this, those American TV shows always show them forcefully taking belongings. Haha. It's reassuring to know that this won't happen, but it is still a hassle to deal with them. Thanks.

You can open the letters to see what they are about. It is only illegal if you committed an offence using the information.

 

Which company hand delivered a calling card ? If you can find out this, then it might help understand whether it is general debt collection or a process server for court actions.

 

If you are renting the house, get the letting agent or landlord to provide something which confirms your friend has moved out. E.g revised tenancy agreement or letter.

 

If you provide them with your friends Aussie address then they can chase them there, but it would be difficult to enforce the debt abroad.

 

Whilst it has nothing to do with you and should not cause you any problems, it would be wise to make sure everyone who contacts your address, know the situation. Keep a copy of any letter or tenancy agreement to provide to anyone enquiring.

No they don't :razz: in many ways US Citizens have more protections from Debt Collectors than in the UK - an unusual thing, Debt Collectors do not visit, for a very specific reason!

"Hi, mr Jones, I am from Lowell Fin BANG BANG" "Sorry officer, thought he was a burglar, and just happened to have my assault rifle out" "fair enough Mr Jones, have a nice day"

 

What you have seen are Repo Men, something quite different, and have you noticed that they always do it as quickly as possible, and hope to god the Debtor does not see them? Again, because they have little defence from being shot, US citizens have much stronger property rights - the law does not ban Repo Men from existing, but afaik it doesn't give them any special protections at all, its tresspass, and its generally ok to gun down tresspassers over there if you "feared for your life" and let's be honest, looking at the people doing the Repo work, you wouldn't assume they are Mormons, you would assume they are burglarls, or criminals of some sort, something backed up by the fact they generally do have long criminal records, its not the employment choice of normal, law abiding people for obvious reasons. It is why home evictions are carried out by specially employed members of Police and Sheriff's Departments, as gunning down a uniformed Law Officer IS an offence.

Don't bin the letters. Stick a label across your address and write on it "Return to sender. Not known at this address", then pop it in a post box. You don't need to stick a stamp on it, if any postage is due, the sender will pick up the tab.
