    • when did they (who) inform you there was a 'police case' and when was this attained? i will guess the debt is now SB'd as it's UAE 15yrs. have you informed the bsnk ever by email/letter of your correct and current address? you can always ignore anyone else accept the bank,  Block and bounce back all emails. Block any text messages  Ignore any letters unless it's: - a Statutory Demand - a Letter Of Claim - a Court Claimform via Northants bulk.  
    • I left Dubai 8 years ago and intended to return. However a job prospect fell through. I’d been there for 15 years. I decided to pay my credit card and the bank had frozen my account. There is no means to pay the CC so completely unable to pay when I wanted to other than the bank advising me to ask a friend in the UAE to pay it on my behalf!  fast forward bank informs there is a police case against me for non payment. Years later IDR chased me and after months/ years they stopped. Now Judge & Priestley are trying their luck. Now I have received an email in English and Arabic from JP saying the bank has authorised them to collect debts. Is this the same as IDR although I didn’t receive anything like this from them. Just says they are authorised?

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi All

 

I was looking to see if anyone had any advice as I can't seem to find a lot online.

 

My partner has received a £190 court fine for missing TV licence payments and we were only given 7 days in which to pay the fine.

 

The money is expected to be paid tomorrow and we cant afford £190 in one go, we could pay a bit now and more later in the month.

 

Does anyone know who to contact to see if they are able to negotiate a longer payment term?

I think you should contact the court ASAP.

 

Did you attend court or did you plead guilty by post? Did they not send you a form to fill re: income and expenditure.?

 

Better informed peeps than me can (hopefully) provide better info

If you are asked to deal with any matter via private message, PLEASE report it.

Hi, thank you for the response.

 

I helped my partner to respond by letter pleading guilty with income and expenditure completed.

 

I was unaware that the I&E was required 3 days prior to the hearing so am unsure if this was taken into account. It would have been received by the court the day before the hearing. I did email in advance to advise that it would be with them on the specific day.

You need to contact the court ASAP and inform them that you are unable to pay the court fine by the date they have stipulated.

 

Phone the fines officer at the court and ask if the payments can be reduced OR paid via instalments.

 

If you do nothing then they can/will use bailiffs to recover the fine an d the costs will double, if not triple!

 

In future, whenever one of these capita goons comes knocking your door because ''your property is unlicensed'' tell em to bog off and put the wood back in the hole.

You are under absolutely zero legal obligation to talk to these commission paid goons on your property.

Roll on when TV license is a thing of the past! I can understand 10-20 years ago need to pay for this but these day's, especially with how the BBC operates its just a joke!

You don't need a licence if you watch catch up, although in light of the governments latest profit pocketing exercise, the BBC is likely to try and keep failure to pay the telly tax a criminal rather than civil offence, either way, never paid never will.

Noticed on one of the 24 hour news programmes that catch up programming is likely to need a TV licence as well. It seems Osbourne is giving and taking at the same time! The BBC are going to have to fund the free over 70's licence and in return anyone who watches catch up or any form of TV on non TV devices will pay the licence fee - whch incidentally is supposed to increase with inflation that has taken place over the last few years.

 

So expect a hike in licence fees and more hounding to pay them if the catch up TV exemption is removed. Yet another 'tax' to clobber the less well off!

Yes correct, however, it is highly likely to become decriminalised by the end of this year anyway.....so their threats will carry about as much weight as powerless DCA's.

Just moved, so called them to say I don't need a license. Straight away started asking questions about what I watch and how. Eventually managed to mark down that I don't need a license for 2 years, (maximum they accept).

 

Shall I also call the local park bailiff to tell them I don't need a fishing license? Better call the DVLA and tell them I don't need a HGV license either while I'm at it.

You do have your licence for breathing ? Nothing is free these days !

missives addressed to ''The legal occupier', you've won!
