    • Hi Dave. This morning I had another message from the owner, saying she's rung Booking.com again to ask them to sort the cancellation. And I just took a call from what looks like Booking.com's UK number. They offered us alternative accommodation but I had already found something on the Booking.com site two days ago. So we aren't homeless next weekend and Booking.com said we can invoice them after our stay finishes, so they can refund us the difference in cost between the original booking and the new one. Without your information on how property owners deal with Booking.com, I'm not sure the owner lady would have sorted this, so a big thank you from us. HB PS An email has just arrived from Booking.com. They confirm that the payment due won't be taken from my card - this was a concern obviously. I checked both my cards yesterday and I didn't make a payment from either of them when I booked. I couldn't remember when the problem happened because I made the booking a while back.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Good afternoon everyone

 

 

My son has received a letter from Pastdue chasing an alleged BT debt,

as he is away in the army at the moment,

he has asked me to help deal with this.

 

 

This is a bit of a story so please bear with me and I will try to explain the best I can.

 

 

In 2011 my son left home and headed off to Minehead,

he followed his (then) girlfriend who lived there with her parents.

 

 

some 12 months or so later the relationship broke down and he turned to a housing association for help to house himself

(he was working at a powerplant) so able to pay his way.

 

 

Things then took a turn for the worse in 2012 as my dad passed away,

my son took this very very hard as his passing was sudden and hit the family very hard.

 

 

In 2013 my son signed a contract with BT to have broadband and a phone line turned on (service was already in the property but disconnected).

He recalls agreeing to a contract with BT in Feb 2013,

however, in March 2013 my son decided to come back home, and in May 2013 he did just that.

This is where things get a bit fuzzy,

 

 

today he has called Pastdue, who claim that he owes BT the best part of £800 for services provided during the period covering Feb 2013 - May 2013!!!

He has asked Pastdue to provide:* Proof of Debt* Copy of the contract* Statement of account* Itemised statements clearly showing the breakdown of money owed

 

 

The response from Pastdue was that they didn't have any of that information,

that he would need to contact BT

they were only collecting the money (oh and threatening 'further action' if monies remain unpaid).

 

 

Any advice on this would be gratefully received,

 

 

I presume that Pastdue are a 'usual' DCA and should be treated in the same ways as the others?

 

 

I want to be able to sort this properly,

he admits that he owes something but need to get to the bottom of 'what' he actually owes

and potentially extortionate charges!

I've had a similar thing occur with my daughter.

 

 

Although in my case, I agreed the contract online and paid line rental for the first year upfront.

 

 

BT said I had to do it this way and then once the services were up and running I could go online and change the name and bank details to my daughter.

I did this, and after six months my daughter moved to another address so we transferred the service and no further payment was requested.

 

 

She stayed at her next place for six months and then we informed BT that she was leaving and the service no longer required.

As far as we knew there were no outstanding charges.

..then I receive a phone call from CD UK (Collect Direct) asking for payment close to £300 - for what exactly I have no idea.

 

.upon checking Collect Direct on the FCA website,

their license to practice Debt Collecting is INACTIVE and has been since Dec 2014.

Therefore I will be ignoring all said texts, emails and calls as they aren't even allowed to be doing this.

Tell him not to worry about having a clean financial slate, I don't know of anyone in the forces who doesn't have some sort of

financial problems.

 

Unless he goes on to do a specialist role such as intelligence then the Army will never need to know of his finances.

 

Deal direct with BT, ignore the powerless DCA.

 

A SAR to BT regarding this will flag up just how they came to this figure!

Who ever heard of someone getting a job at the Jobcentre? The unemployed are sent there as penance for their sins, not to help them find work!
