Cabot gioing for 2nd CCJ on same debt with CCJ/CO already!!

Hello all,

 

Please I need help on how to go about this.

 

 

Sometimes in 2011 ,

Cabot took me to court through their solicitors and got a court order and a ccj on a card I can't remember I ever had back in 2005.

 

 

I had moved from that address so I did not see any court papers.

 

 

Recently checking my title at the land registry ,

I discovered that there is a charging order placed on my property because of that credit card.

 

 

Cabot instructed another solicitor on the same card and got another ccj through the Northampton business centre

and I was ordered to pay about £910.

 

 

When I contacted Cabot, they gave me the details of the credit card and

I realised that it was the same credit card that they had taken me to court for in 2011 and had a charging order on.

 

 

Please how do I go about this.?

 

 

When I called the other solicitor that acted for Cabot in 2011,

they told me that the charging order is £1600 now.

 

 

What I have done now is , I completed a n244 for the recent ccj to be set aside as I was not aware of the case

and I had moved address since 2009.

luckily got hold of the new ccj judgement through a friend that visited the tenants at the property.

 

Please how do I move this forward ?

 

 

Should I just tell the old solicitor thAt I have been taken to court again in which I am defending now ?

Or just keep quite and see if this new case will succeed ?

 

 

Please I need help ASAP .

you cant have 2 CCJ's on the same debt!

 

 

the new case should be struck out./discontinued

 

 

you need to tell the court

 

 

forget talking on the phone to silly fake solicitors

that are only interested in money by default uncontested judgements.

please don't hit Quote...just type we know what we said earlier..

DCA's view debtors as suckers, marks and mugs

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Well you wouldn't be if you hadn't informed them of a change of address.

 

 

..just set a side the second..

 

 

.ring them back and tell them and ask for the consent..

 

 

.then you wont have to pay £155 for the application only £55.

No. You're original CCJ and CO stands.

 

Are you sure that this new CCJ is for the exact same debt as the first one?

 

Yes I have two judgements and both are just the same debt. Spoken to Cabot and the old solicitor, they both gave me the same card number. .

Have you got grounds to set a side the first judgment...what would be your defence? You dont get a set a side unless you have a valid reason.

Have you got grounds to set a side the first judgment...what would be your defence? You dont get a set a side unless you have a valid reason.

 

Can't I use the fact that I was not aware of the court proceedings as I moved from my house ? Also the debt was not known to me as they said it was in 2005 and just balance of £100. Can't even remember I had that card honestly.

You cant use the fact that you had simply moved and not informed anyone. If you could prove that the claimant knew of your new address, then that might be a reason.

 

Even if you were to get the set aside on that basis, they could then simply issue a new claim and start all over again. Unless you have a reason to actually dispute the debt itself.
