    • Afternoon all Looking for advice before I defend claim for car tax payment that the DVLA claim I owe £68 from an idemity claimback from my bank and unpaid tax  So brief outline. Purchased car Jan 30th ,garage paid the tax for me after I gave them my card details so first payment £68 out in Feb 24  followed by payment of £31 from March due to end Jan 24 Checked one of my vehicle apps and about 7-10 days later car showing as untaxed? No reason why but it looks like DVLA cancelled it ,this could be because I did not have the V5 and the gargae paid on my behalf but not sure did not receive a letter to say car was untaxed.  Fair enough I set up the tax again staight away in Feb 24  and first payment out Mar 31st , and each payment since has come out each month for £31 , this will end Feb/Mar 2025 so slightly longer than the original tax set up so all good. I then claimed the £68 back from my bank as an indemity refund as obviously I had paid but DVLA had cancelled therefore it was a payment for nothing?  Last week recieved a SJP form dated 29th May stating that DVLA were claiming for unpaid tax and a false indemity claimback which of course is the £68. It also stated that I had received two previous letters offering me the oppotunity to pay that £68 but as I had not responded it was now a court claim that I must admit guilt for or defend. My post is held for weeks at a time from Royal Mail ( keepsafe) due to me receiving hospital tretament at weeks at a time that said I did not receive any previous letters from DVLA. So I am happy to defend this and go to court but wondering what CAG members think? In summary I paid an initial amount of £68 and then a DD of £31 , tax cancelled so I set up a new DD at £31 a month all in the month of Feb 2024, I claimed the £68 back from my bank. DD has been coming out each month without issue and I have paperwork to show the breakdown for both DD setup's plus bank statements showing the payments coming out . The second DD set up has extended payments up to Feb/Mar 2025. DVLA claiming the £68 was ilegally claimed back despite the fact they cancelled the original DD for reasons unknown. Is this defendable ? I will post up documents including the original DD conformations

So there's a clear marker on what is private and what is public.  These people keep parking on the private land side

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

What does it matter what aisle they are on? The aisle was open. It contains no alcohol. There was no law preventing them from selling the item. Coming back a second time was an unnecessary inconvenience for me. I'm as right as dodgers to complain about it.

 

I find your attitude and suggestion that my grievance is driven by an 'addiction' an insult.

 

Little thing called customer service goes a long way. Whoever decided to group non-alcoholic drinks entirely within the same category as all alcoholic drinks, including licensing laws, in the first place is a moron. This should never have been an issue, and based on that hardly anyone will probably ever want to buy non-alcoholic beer outside of licensing hours anyway then what's the harm in allowing it? Oh my god! He wanted a 6 pack of beck's blue and a pint of milk at 8.15am!

 

I drank one of these outside Tesco the other week and got so many dirty looks and comments made deliberately within an earshot, none of them realising it was non-alcoholic and that it was even illegal anyway. Why doesn't anyone ever complain about people smoking outside supermarkets, in the bike shed when I turn up out of breath, nice lung full of carcinogenic particles mmmmm

I agree there is no "law" to prevent a retailer selling anything, but there is also no law saying they must sell anything, there is also no law preventing smoking in the open air, so hospitals have banned smoking on the ground most schools do as well.

They can put stuff through as anything they want, it's at their discretion. They do that when something doesn't scan through. Or they could rebrand Beck's blue as a soft drink and put it along side the shandies, which also probably contain more alcohol and are less healthy.

 

That would involve applying common sense though.

 

When something does not scan it is not on their automatic ordering system or theres a technical glitch.

 

Scanning every non alcoholic drink through after hours will affect the book stock and cause problems with their ordering software. Remember if they were allowed to do it for you they would be allowed to do it for many others causing problems. Think bigger than just yourself.

I know why things don't scan in, I understand what a database is.

 

They have a system for accounting for stock sales in different ways. I have already offered a solution, put them by the soft drinks. Oh but that would encourage children to drink alcohol! And selling shandy doesn't?

 

Please don't fret everyone, I'm going to be ok. This is unlikely to ever happen again, I'll make sure I buy my non-alcohol beer within the same designated time frame as the alcoholic beers like a fine law-abiding citizen.

 

Think bigger than just yourself.

Well you do seem to be ignoring it. I gave you the info as it actually is as i work behind the scenes for one of the big 4 supermarkets. If you choose to ignore it and start some kind of crusade, by all means go for it. You wont make the slighest bit of difference to the policy. As brig said, there are all manner of reasons why some stores will not sell certain items to various people, or limit that item for sale in general.

 

Since you seem to be adamant starting an argument, even though correct info has been given, i will satisfy your desire and bow out of the thread.

Any advice i give is my own and is based solely on personal experience. If in any doubt about a situation , please contact a certified legal representative or debt counsellor..

If you have that short an attention span that you need reminding, why should trying again be any more effective?.

 

Your "consumer rights" are:

1) to whinge here, then grumble when people disagree with you. (Since no-one seems to be agreeing with you on the thread : should we be prepared for a rousing chorus of "the lurkers support me in e-mail !" ?)

2) To whinge to their head office, who might have a good chuckle and ignore you or send you a "pacify the irrelevant complainant " letter. If you are very lucky and catch someone on a good day you might get a "we are sorry you feel that way" response

3) Shop elsewhere. I'm sure they'll miss your custom & "slight argument"(s ).

You know, I said the other day in another thread I was going to donate something, and I actually had trouble with paypal that day so left it and have been busy since with a lot of things, not least having to go back and forth to supermarkets who wont sell me items they are legally entitled to if they want. I have been meaning to get round to making this small donation soon but you know, I've just been insulted so many times in this thread today that I might just not bother now.:|

It is a self-help website. You ask for opinions and you'll get them.

 

Those opinions may not coincide with yours. If that means CAG doesn't get a donation then the site team need to decide:

1) give in to the blackmail. ("Stop the nasty people disagreeing with me or I won't donate"), or

2) Say "hey, we allow posts that disagree, provided they meet CAG guidelines ; we accept that that may mean some people who get butt-hurt from not getting the sycophantic reception they expected might then not donate: but that's a price we are willing to pay "

 

Here's hoping the site team continue with option 2 .....

 

Incidentally, if you found the responses "insulted so many times" - you should reconsider if you have the emotional fortitude to venture onto the Internet . I saw only opinions that disagreed with you : rather than insults.

Person A says to person B : "You are an idiot who can't string 2 electrons together on a screen, and I want the oxygen you are wasting back " ; that is an insult. Not allowable by CAG posting guidelines as far as I'm aware.

 

Person A says to person B "I disagree with you because ......" : that is not an insult. It is disagreement. As far as I am aware, allowable by CAG guidelines. (Then again, I'm not 'site team ')

 

Any posts you think you've been insulted in, report.

Let the site team decide. Simples.

Oh right well thanks for clarifying that for me, I guess I'm just a born whinger and this is all trivial and silly. Now I can stop lying to myself and admit my own failings, that I'm addicted to Beck's blue and need rehab.

You have an aptitude for being pedantic, and a talent for argumenta ad hominem.

 

Nothing dishonest about what I did in the other thread. They accepted it back on the basis it had a small scratch on the screen and in fact it wasn't even mentioned, it was completely irrelevant anyway.
