    • Yes - ignore. Because of another MET victim today I looked at all our MET cases back to June 2014 ... yes, 10 years. They have never dared take a motorist to court and argue their case before a judge.  They have started the odd court case, but as a means of trying to intimidate the motorist into coughing up, when the motorist defended and refused to give in it was MET who bottled it and discontinued.
    • Unpaid wages should be pretty straightforward if you did the work. Don't be intimidated. You need only show you were due money, and did not get money.   The risk is that they have no money to pay you (and legal fees) - frankly a solicitor maybe be costing them more than your claim is for and I might have expected them to make a commercial decision to settle before this point regardless of the merits of the case.

    • Hello I am a resident of a communal block of flats owned by a Housing Association and since Tuesday 14th May 2024 Matthews and Tannert had put up scaffolding for a job on the roof last week, which was up for the best part of nine days. They had removed the scaffolding on Thursday 23rd May 2024 but my Sky box is still not working because of the satellite dish outside, and I was wondering whether the scaffolders had touched the dish while it was there and as a result had probably knocked the dish and probably made the dish go out of signal or whatever. I needed someone to check this out as well as to see my Sky box to see what could be the problem, and hopefully sort this out. I have had my Sky Digibox for many years and I have got recordings saved on them that I have had a long time - it would break my heart if I had lost them forever.       I contacted Sky but I almost made the mistake of accepting an offer where I would have to pay £31.50 and wait a whole month without television in my front room for it. I am in debt at the moment and I don't want all this on top of everything else - thankfully I have since cancelled it two weeks later when I told the person on the phone that it is the dish which is at fault as well as the fact that I live in a communal Housing Association property, and so that is one of very few weights off my mind. I emailed the Housing Association's Repairs department and they said that they will contact an electrical company to come out and see to the dish outside. I received a telephone call on Friday 24th May from the man to say that he will arrive on Wednesday 29th May 2024 to do the job. He arrived at around 9.40 am on Wednesday as promised; he went into my flat and had a look at the Sky box and saw the blue screen on my front room TV set, indicating no signal. He also looked outside as to where the dish was.  The main problem was that the ladders that he had with him were not enough to reach the dish outside as the dish was towards the top of the building - obviously the Health and Safety aspect of the job didn't allow him to do this. He then mentioned that whether he could do the job as a result of getting onto the roof and doing it like that as the dish is closer to the top. He said that he needed the key to enter the loft part of the building in order to reach this, and he needed to contact the Housing Officer at the Housing Association who had key to this, but lo and behold, he came on the Wednesday to do the job, and guess what? Wednesday was the Housing Officer's day off and so therefore he was unable to contact him for the key so that he could do the job! I just couldn't believe it myself. I am personally annoyed because this has not been sorted, and the man who came to do this is also annoyed because he came all the way to Nottingham from Peterborough, and he said to me that he won't get paid if he cannot do the job, so you see, we are both angry about this for different reasons. We are both in the same boat with regards to frustration, and we both want to see a conclusion to this, once and for all. Sometimes I wish that I didn't live in a flat which is in a communal building and I am thinking of getting a transfer to a one bedroom flat that isn't in that sort of place. I pay around £85 a month in a Direct Debit to Sky to receive their TV services which I cannot use at the moment, and I don't have much money in my bank account as it is due to one thing and another. I also pay nearly £14 a month to TV Licensing so that I can legally watch TV in my front room. I pay for Sky hence the fact that I want the Sky service in my front room and not Freeview. Also, as the General Election is coming up in five weeks' time, I want the satellite TV to be working properly so that I can catch up with what is on the news channels, and I feel rather "cut off" from that at the moment, and I want it working in time for Thursday 4th July 2024 for ovbious reasons . I have Freeview in my bedroom, but that is not the point  - I don't want to be limited to my bedroom every time I want to watch TV. I have tried putting the Freeview in te front room but it doesn't seem compatable for the same uses that I usually have Sky for.  Sunday 9th June 2024 is Day 27 of the satellite TV not working in my flat, and I feel that something needs to be done about this. You can take this message as a complaint if you like, but nevertheless, I want this message to be acknowledged and also something to be done about what has happened. I have enough on my plate with regards to health problems and depression without things like this making things worse. I would appreciate it if something was done.  I don't like naming and shaming but it is Matthews and Tannert's fault that I am in this situation in the first place, and sometimes I wish that I could sue them. In a nutshell, I have had more than enough after being without TV in the my front room for nearly four weeks. Also, at a time like this, I am missing so much of interest on TV what with the General Election comning up in just a few weeks.

      On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

Hi Everyone

 

I need some advice please since I have been out of work now for 2 1/2 years and can only get JSA for a single person,

I don't have any savings and water bill was and is still behind,

 

in March 2010 Severn Trent suggested I contact the trust fund,

I did and was with the trust fund from May 2010,

I had to pay £5 a week for 39 weeks,

 

I was doing so up until around December 2010,

I had paid 26 weeks, they had paid the same to my account, they check every 13 weeks,

 

when they checked in March 2011, they saw I had not paid the final 13 weeks, so cancelled the rest of the grant,

a friend did me a letter requesting to see if they could help, i

 

I tried for a crisis loan or something, but they said no,

everything went up in December 2010, food and everything, my electric is a key meter at present with eon,

but british gas are soon going to supply the electric with the gas, which is also a prepayment meter,

so after the trust fund refused anymore help,

 

I sent a letter to severn trent, in April severn trent replied and updated the records,

 

The trust fund suggested I contact severn trent to make a new arrangement, I did so early May 2011,

 

I told them it was obvious I could no longer afford the £5 a week,

so could they come to some sort of new payment arrangement,

 

a reply came a week later,

they said £5 a week was the minimum they could arrange,

and they would be making an applicaion for water direct and if successful would be deducted from my benefit each week,

 

I made enquiries in the mentime at the job centre to find out how much they would stop,

I was told £3.40 to cover any arrears plus a consumption allowance on top,

 

a friend a mine had this stopped from his benefit for water, and he had to pay £8.50 a week from his benefit,

the benefit for a single person at present is £135 every 2 weeks not £500 a month like this Government keep saying,

 

so you take away £17 each time for water then around £45- £50 for electric it does not leave much for shopping,

all my creditors are getting £1 per month from debts I had when I was working for 9 years previous to being unemployed,

 

I usualy spend around £30- £35 on shopping but remember this has to last me 2 weeks,

 

I don't smoke or drink and can't go out because I can't afford to,

 

every letter sent for a job is either not successful or you don't get a reply,

even after an interview most of the time you hear nothing else,

 

so as time went by I had not thought no more about the water until I was going through my paperwork just after christmas and filing it,

when I realised I had not heard anything from severn trent or the job centre regarding the water,

 

I asked my advisor in January this year,

all he said was nothing had ben set up and to ring them,

to ring them cost a lot of money, money I don't have, because like all phone numbers these days they are 0845 numbers which cost a fortune o phone,

 

the other day a telemessage came severn trent had at sometime had a system issue so no bills or reminders or anything had been sent out,

 

so this must have been since last May,

 

now they are wanting a figure for the back payment Immediately,

then another figure by April and the same in October, or I can pay the full bill in one lump,

 

there is no way I can pay any of the figures they mention,

I now do not no which way to turn,

they have been having a computer problem by the sounds of it,

but if they had accepted maybe £3 a week when I asked for their help,

i might not have had this problem now,

 

I am now depressed, and I suffer from Osteoarthritis,

I think it might the disability and my age of 54 which is stopping me getting a job,

even though it is against the law to discriminate anyone nowadays,

 

I understand about Equality and Diversity as we covered the subject on the College course I did last March

- June and got City & Guilds Certificates,

but to me it seems like it only applies to some and not all,

 

so any help what to do here would be helpful,

you cant see the C.A.B. without an appointment and you can't make an appointment as they have no e-mail and never answer the phone,

 

so please help if you can

I am sure there will be people along that can give you some advice on this but in the meantime while your waiting perhaps you could put some

paragraphs in to your post, this will make it easier on the eye to read.

I worked for Severn Trent Water in their facilities department last year on a six month contract.

 

They've obviously spent all their money on their brand spanking nearly new (it's been open about 15 months) Severn Trent Centre building in Coventry and need some extra from you :lol:

Hi Angel

 

Sir John Egan, Chairman and former Jag, is actually quite a nice chap; however water accounts are not a priority for poor folk because they cannot cut one off or send you to prison. I do not advocate not paying water accounts for solvent folk because they have curious powers beyond your usual DCA bandit.

I still have my bills to pay, so I am on a basic jobseekers of £72.40 a week now, which is paid fortnightly,

 

at the end of March due to british gas paying me some winter fuel allowance, I was able to re-budget

and saw someone from the Money Advice Service,

 

the only thing I had to catch up with then was the water bill, which is in arrears,

 

I applied to severn trent trust fund in 2010 and was paying £5 a week by water card, this had to run for 39 weeks,

I failed on the last 13 weeks due to rising costs of other things food, electric etc, so

 

I applied as advised by the money advice service to the severn trent trust fund on 8/4/14,

they contacted me to let me know they will contact severt trent water and tell them I had contacted them,

 

the money advice service told me, if it was £5 a week I could just about manage it, but it would not leave anything for any emergencies,

 

on the 14th May the severn trent trust fund said they could not help me,

 

on the 16th May Severn trent got in touch by letter,

in this letter they asked me to call them on an 0845 number,

 

I am on virgin and that means an extra connection charge plus the call to an 0845 number,

 

but it also said in the letter, You Can Apply to have your payments taken weekly from your benefit.

 

I have enquired about this before, and they charge for any arrears then a charge on top,

one of my friends had it that way, he was paying around £40-£50 a fortnight out his jobseekers to severn trent

I can't help you with your main query but I will say that I chucked my tv out several years ago as i don't need it. If you live on your own and have a comparatively modern pc then catch up and free online services might suffice. And that's $12 odd a month you don't have to spend.

Yes my TV licence expires at the end of July and I am not renewing it.

 

That said, it is very hard to live on JSA and priority debts which include water do need to take priority as catching up is hard. How long will these payments be going out for? ie how much is the arrears/debt? Well worth using your local food bank for the duration you need help with food. Many will deliber if you have no transport and you live too far from it.

Thanks for your reply, everything I own is old, either from car boot sales or from freecycle sites, I am still using xp, but no matter if you have a tv or not you still need a tv licence in the uk, a friend of mine was told if you can receive tv signals you need a tv licence, and the bbc has always said if you receive radio signals you need a tv licence, so now in the digital age you need a tv licence if you have a phone or tablet or whatever

You need to be covered by a valid TV Licence if you watch or record TV as it's being broadcast. This includes the use of devices such as a computer, laptop, mobile phone or DVD/video recorder.
If you watch programmes via iPlayer, 4od, or similar, a TV licence is not required. It is only needed if you watch live broadcasts (including live internet streams) - This includes services such as TV Catchup and (most) cable TV. Listening to the radio or using a TV to watch DVD/VHS does not require a TV licence. Nor does using a TV as a computer monitor.

 

I have a new fangled flat screen TV hooked up to a computer and a DVD player. The TV has never been tuned into a broadcast channel, so if the TVL goons call, the screen will just show static.

 

As to the JSA deductions - If no Attachment of Earnings Order has been applied for by STW, ask the DWP for copies of any authorisation signed by yourself. If you have not agreed to the deductions and no AEO has been granted, then the DWP shouldn't be making the deductions (in my opinion).

No authorisation for Third Party Payments is required as long as it does not account for more than 25% of benefit amount.

 

Third Party Payments are made pursuant to the Social Security (Claims and Payment) Regulations 1987, Regulation 35(1) and Schedule 9.

For anyone coming across this thread, Sched. 9 states:

Water charges

 

7. (1) Subject to sub-paragraph (2) and paragraph 8, where a beneficiary or his partner is liable, whether directly or indirectly, for water charges and is in debt for those charges to an amount not less than half the annual charge the adjudicating authority may determine that a weekly amount of the specified benefit shall be paid to the water undertaker to whom that debt is owed (or to the person or body authorised to collect water charges for that undertaker).

 

(2) This paragraph does not apply in a case where water charges are paid with rent.

 

(3) The weekly amount to be paid in accordance with sub-paragraph (1) shall be the aggregate of–

 

(a)in respect of the debt an amount equal to 5 per cent. of the personal allowance for a single claimant aged not less than 25 years (that 5 per cent. being, where it is not a multiple of 5 pence, rounded to the next higher such multiple); and

 

(b)an amount equal to the weekly cost necessary to meet the continuing need for water charges.

 

There does appear to be scope within the regulations to appeal against the Third Party payments if it causes financial hardship and raising the risk falling into arrears with a higher priority debt such as housing, council tax, or fuel bills. Might be an avenue the OP could consider if this TPP is likely to push him further in to debt.

I have just contacted by e-mail the regulator to see what they can do, I was not offered any payment plan as it said in the letter and it will leave me with £63.01 to live on, because these people say they could not fit a water meter outside in 2005, but because of my complaint to them when the letter came, they sent someone to look and arranged for a water meter to be fitted outside the following week, but they never tell anyone about water meters and charge rateable value instead with water
