Well yes and no as per my post #62 above...it can be successful subject to which Solicitor your Claimant is using...in a lot of money claims, mediation can only narrow the differences and not actually settle the claim...I personally dont think that mediation is fully compatible in civil money claims..yet...but its a European initiative and we have to follow...unfortunately.

 

With regards to your other point...mediations runs along side the claim timetable as an option.....not as an alternative...so even though you are (or trying in your case) participating in mediation...you must keep your eye on the directions of the claim also.

It is all seeming like a matter of process! a lot of process!

ok so can I please confirm i need to send a witness statement and what else?

 

 

I really want to get this right, this is all a bit daunting but I will put in the time and effort if there is any chance here.

 

I dont want the stress uneccessarily if it is to be a wasted effort,

life is challenging enough right now and

I certainly would not want that stress to filter to my wee man in any form.

 

 

I also have concerns how a possible CCJ can affect building a future for my son and I,

and maybe i would benefit more from an agreement plan with them.

 

 

That said if there is any chance of winning I would certainly want to take that opportunity,

I dont like being harassed!

 

I appreciate you deal with a lot of similar enquiries and

 

 

I cannot thank you enough for the advice,

 

 

it is impossible to get an appointment at the CAB and

 

 

I have restricted time capacity with work and a little one.,

 

 

a rather demanding little one at that ;)

Its is very much a process and in most cases its the claimant that fails to comply..hence the claim end up either getting discontinued or struck out.

 

Draft your WS ...post here for checking... 3 copies... court /claimant/your file.

Standard Disclosure is easy for the defendant...simply list all the documents you have referred to and will rely on within your Defence and Witness Statement..then attach said copies to the list...documents such as a CPR and CCA requests and any responses and anything that aids your defence.Send them to the court and claimant by stated date and keep a copy for your file.

 

And that's it...you have complied and done everything asked by the court...by then you are on the higher ground because the claimant as yet to serve you theirs let alone serve the court.

Hi Andy

 

 

i have received a letter today from Bryan Carter stating

please find enclosed by way of service

A notice of Discontinuance of this case!

 

Which I am assuming is the end of this matter!

 

Cant thank you enough for the advise

- takes a big weight off my mind especially for a debt I disputed from the out start.

 

I will be making a further donation to the site albeit a small one I am afraid at the end of the week.

 

Thank you again for your assistance and your constant prompt responses.

 

I assume I don't need to do any thing more?

Just check with the court that they have received same and then put this matter behind you.

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

Hi HV,

 

Well done for sticking it out to the end and calling BCs bluff.

 

 

As you may know I was following your thread with interest as we were both going through identical steps

and each one has resulted in BC pulling the same tricks,

issuing claim, agreeing to mediation then pulling out due to lack of staff,

continuing with the claim and then pulling out at the last minute.

 

It's a pity that he is allowed by the courts to continue to keep issuing these claims

and then abusing the system in such a way,

but I fear nothing will ever be done to stop these people making hopeful claims with no substance whatsoever.

happy to see we both won this chicken race ;)

 

 

I am sure this sort of behaviour and lack of professionalism is costing them!

 

 

Guess the lack of resources must reflect the fact they clearly have bit off more than they can chew!

My point exactly, why are people like him allowed to continually make a mockery of the system, why has he not been denied access to the mediation service for instance. Taking up valuable court staff time to process his futile claims. It really is poorly policed in my opinion.
