Backdoor CCJ Cabot/Mortimer - old Aqua Card Debt - now warrant.

my younger brother who lives with me has received Judgement for Claimant (in default) from Cabot and havent received the claims form, though he received letters from Mortimer Clarke before for Cabot/Aqua credit card account

he has been hiding this from only told me as he received Notice of Issue of Warrant of Control this week for bailiff action if not paid until 7th Feb. He is jobless since a year. Default Judgment date was 15th Dec 23

Whats the best way to resolve this and does he is still a chance to defend this default judgment, is starting point  to CCA ,  CPR , N244 in court to request set aside

to late for all that sadly if judgement was 15th December

i will gather he used to live elsewhere when he took the card out and never advised the debt owner at the time, be it aqua or cabot (after it was sold to them) of his move to live with you.

if the above is true, then they quite legally filed to his old address.

NO DCA has ANY legal powers whatsoever on ANY debt no matter what it's Type

and they

are NOT and can NEVER  be BAILIFFS. even if a debt has been to court..

If everyone stopped blindly paying DCA's Tomorrow, their industry would collapse overnight...

his address is still same since few years, card he took in 2020

Notice of issue of Warrant of Control is from 

Civil National Business Centre

Creditor : Cabot Financial

 

If no solution then even though he doesnt own anything in my house, bailiffs will be an issue for me with my cars parked outside

nothing to do with you, cant touch your stuff and its a consumer credit debt so there no right of forced entry.

to put it as simply as possible you /him simply ignore them totally, it'll get passed back to the claimant . 

the only downside is the addition of bailiff fees as its county court bailiffs the max will be £310 added.
