Iv had a knock on the doir from the police today asking if they can come round on Friday with the council due to Dog fouling.

I have been letting my dog foul in the street and I know I shouldnt I shall stop immediately.

But im worryed sick that both the council and police are coming to my house.

I dont want to face them them what rights have I got. Is it possible they have evidence and I may get arrested

Im so scared

Please advise.

I doubt you have any rights. If you're aware it's wrong why do it ? It only becomes a problem if you don't bother to clear it up. I'm assuming you don't and if not I have little sympathy. Sorry, but it's people like you that give responsible dog-owners a bad name.

pay the £75 fine, however if you are in social housing, your tenancy agreement will say about controlling your dog and cleaning up after your dog so they may take further action over that.

But I dont have much sympathy I clean up after my dog and many others do, but people like your self give us a bad name

I know my rights Mr DCA I'm with the CAG......hello hello where you gone Mr DCA8)

I would think yes, you would have to let them in. I imagine that you will be given a lecture and a fine.

Hello there.

I agree with the guys, I think it will just be a fine. In your place I would speak to them, because avoiding this could make it worse.

I'm also a dog owner and I know tidying up afterwards can be a pain, but it's what we accept when we get a dog. I really hate it when we're walking and there is dog poo around, it's really unpleasant.

My best, HB

Why do the police need to be present?

Because it is a criminal offence and you can be prosecuted for it.

There is no use worrying about what has happened or what they might say to you.

What is done is done and can not be undone, however if you have learnt a lesson that is good.

If they chastise you make it obvious that you realise your mistake.

You do not know what they will say and no evidence as to what they might say. Worry is counter productive.

Any opinion I give is from personal experience .

Hi fairy87

Try not to worry yourself to much about this and you have been given some excellent advice.

I would not refuse the Council and Police entry to discuss the dog fouling as has been stated this may make it worse not better.

All you can do is let them in listen carefully to what they say and be very apologetic and that you will ensure this wont happen again.

Now nobody can be 100% what will happen it may be a fine or just a warning held on record or both etc.

Have you had a look a your Councils website on Dog Fouling to see what it says.

I've found this thread very interesting and a very helpful link from citizenB.

My neighbour has two dogs and just opens the front door and lets them out, he then comes out a bit later to call them back in and I've yet to see him with a poo bag!

I live at the end of a cul de sac and there is a large grassy area where the dogs go, this is also very close to a first school, so not ideal for little children to be putting their feet in it!

There is a bin by this grassy area specifically to dispose of the bags and is used by many responsible dog owners, but we still have to dodge the dog mess on a path by this area which, as you can imagine its not ideal in the dark!

I think I'll try and have a wander outside, the next time I see him let them out and see what happens, it's not an easy decision to report a neighbour, but after having to suffer their constant barking for many years, I may find it a little easier!

Is there anything that can be done about noisy dogs? We seem to be surrounded by them!

I sincerely hope you do from now on bag their poo! I used to own dogs and picked up their poo each time they were walked.

I now own a toddler and am sick of him not being able to run free in any of our parks because it's full of dogs mess. Also sick of arriving home to find the buggy wheels are full of it.

I always took it that fines were 'on the spot' but not at all sure if they've changed things now. Let us know how it goes, be interesting to know if they fine for a verbal 'report' or if there has to be evidence of some sort.

I would certainly not admit to anything until you see what evidence they have against you.

Could have only been someone reporting you and that is very thin for them to try and charge you with anything unless

you confess that is.

Have 3 staffs myself and lucky we have a large separate garden that is well fenced off, dogs can mess and play

and I clean every week, Not the nicest of jobs but comes with owning dogs.

Nothing worst than a dog mess on the path on way to school in the mornings and always someone has stood in it

and a nice trail down the path.

Get your dog on dry food and the mess is always easier to bag if in public, Wet food is terrible.

George

When I was looking for information, I noticed that each Local Authority had its own site in respect of this.

it also depends if the area is subject to a separate Dog Control Order under the Clean Neighbourhoods Environment Act, this will cover leaving dog mess (level 3 fine £1000) and if you let the dog off the lead that will be another level 3 fine, but if its just under local authority dog fouling it will be a £75 fine. To give you a fine they will have to be a witness statement saying they saw the dog, saw it mess, saw it return to your address. If they have this you can take the fine and that will be the end of it or you will have the option of defending it in court, if they have a witness statement I would advise to accept the fine. Opting for court could mean you, if you are found guilty, getting a larger fine plus costs.

Like I said if you are in social housing the council may be attending to issue a warning through your tenancy for failing to clean up after your dog. Like has been said let them in after all they may be just coming to offer you advice and a warning, I use nappy bags for poo bags I get them from Tesco 35p for 100 (asda, morrisons, sainsburys all do them on their value ranges).

I know my rights Mr DCA I'm with the CAG......hello hello where you gone Mr DCA8)
