    • If you're set on pursuing the receiver then a complaint to his governing body (if any) might be a sensible low risk first step. You need to confirm what qualifications he actually has. I don't believe an LPA Receiver necessarily needs to be a licensed insolvency practioner, although he may be. Or he may a chartered surveyor. I note you say "LPA" and "fixed charge" receiver, but aren't those two different appointments with different remits? What relevant powers are given in the mortgage terms and security? Or if that's unclear then how was the appointment described to you? Ducking back to the comment I made earlier, you consulted a solicitor who advised a claim against the receiver.       On 15/1/24 booked appointment with Big Motoring World (BMW) to view a mini on 17/1/24 at 8pm at their Enfield dealership.  

      Car was dirty and test drive was two circuits of roundabout on entry to the showroom.  Was p/x my car and rushed by sales exec and a manager into buying the mini and a 3yr warranty that night, sale all wrapped up by 10pm.  They strongly advised me taking warranty out on car that age (2017) and confirmed it was honoured at over 500 UK registered garages.

      The next day, 18/1/24 noticed amber engine warning light on dashboard , immediately phoned BMW aftercare team to ask for it to be investigated asap at nearest garage to me. After 15 mins on hold was told only their 5 service centres across the UK can deal with car issues with earliest date for inspection in March ! Said I’m not happy with that given what sales team advised or driving car. Told an amber warning light only advisory so to drive with caution and call back when light goes red.

      I’m not happy to do this, drive the car or with the after care experience (a sign of further stresses to come) so want a refund and to return the car asap.

      Please can you advise what I need to do today to get this done.

    • We have finally managed to obtain the transcript of this case.

      The judge's reasoning is very useful and will certainly be helpful in any other cases relating to third-party rights where the customer has contracted with the courier company by using a broker.
      This is generally speaking the problem with using PackLink who are domiciled in Spain and very conveniently out of reach of the British justice system.

      Frankly I don't think that is any accident.

      One of the points that the judge made was that the customers contract with the broker specifically refers to the courier – and it is clear that the courier knows that they are acting for a third party. There is no need to name the third party. They just have to be recognisably part of a class of person – such as a sender or a recipient of the parcel.

      Please note that a recent case against UPS failed on exactly the same issue with the judge held that the Contracts (Rights of Third Parties) Act 1999 did not apply.

      We will be getting that transcript very soon. We will look at it and we will understand how the judge made such catastrophic mistakes. It was a very poor judgement.
      We will be recommending that people do include this adverse judgement in their bundle so that when they go to county court the judge will see both sides and see the arguments against this adverse judgement.
      Also, we will be to demonstrate to the judge that we are fair-minded and that we don't mind bringing everything to the attention of the judge even if it is against our own interests.
      This is good ethical practice.

      It would be very nice if the parcel delivery companies – including EVRi – practised this kind of thing as well.

could not believe the attitude of the Spurs fans when they stretched Theo off past them, the Police had to hold them back

 

Apparently it was the arse player Theo who unproffessionally gestured a two nil sign with his fingures to the Spurs fans as he was stretchered off. The Spurs fans then showered the ground around him with coins. I think that's what they thought of his behaviour. I hope Spurs players will not lower themselves to his level.

 

I take it you you are not a Spurs supporter?:madgrin:

lol you suppose right determindator! I am a Gunners fan lol, yeah Theo did a 2-0 win to the spurs fans but they had already started throwing coins at him well before that

nasty injury. as said didn't seem that bad at the time, and he got stick for being stretchered off. arse will still be in it, and if they make a decent signing in jan.

As a Man City fan : If we beat West Ham i hope we play manu. Sunderland have the hex on us and I think the bookies would make us favourites. Oh how I remember Wigan. I know it's all ifs at the moment but that's what being a fan is all about. Plus cheering (normally) anyone but united.

Looks like Moyes has lost the plot with his moaning over the refs. Oh well!!! I do feel sorry that we put 6 past the Hammers because I like them but we had 32 shots. I remember when we didn't have that many in a season.

moyes is struggling imo, partic without shrek and VP. see how everton are doing with virtually the same players, but a different manager!

32! how many on target? sounds familiar though, when lfc were battering teams with shots but couldn't convert and ended up losing on a goal to 2 shot ratio! :)

11 on target, I still have the memories of Liverpool ( and most others) giving City a regular thumping at Maine Road in the 80's when I had a season ticket. Moyes has been charged by the FA for his comments about the refs. I wonder if he changed the chair in the managers office or has he got an extreme case of whingeingitus off it. To think that manu fans call us "Bitter Blues".

6 out of 11, not bad. citys squad is v good, and i would be surprised if they don't finish top.

not surprised moyes whinging, fergie used to do it (but fergie tended to get away with it!).

Brent also got charged and fined 8k, fair dos (but did read a stat article supporting brent saying that v few 'wirral'/local refs have officiated mersey games, and according to the fa themselves the proposed ref (mike dean) for the lfc hammers cup final was 'substituted' due to poss inferences! pedantics, i know, but... :) ).

i know :) was expecting a draw or loss. but lfc seem to be gung ho atm. and with suarez anything can happen (he was three steps ahead predicting the defensive errors re his first goal). and now sturridge is back, excellent goal. :)
